The Stallion manager reserves the right to refuse any mare. This Contract is entered into and accepted between the aforementioned mare “owner” and the stallion breeding “Manager” on this date…………….…………by both mutually agreeing to the following conditions of this contract. SECTION 1 Agreement The owner agrees to breed the mare listed to the Stallion “Simeon Champagne during the 2013/2014 breeding season. This season normally begins August 1st, and ends on January 31st unless special arrangements have been made with the stallion manager. The mare owner agrees the mare will be halter broken and free from any infectious diseases and in sound breeding condition. Any mare certified by the attending Veterinarian not to be in sound breeding condition, in his opinion shall, not be bred making this contract null and void. This contract may not be transferable by the mare owner. 2 SECTION 2 Agistment and Veterinary Fees The mare owner agrees to pay all charges applicable to the broodmare and/or the progeny that include. 1) Agistment fees, at the rate of $16.50 per day or to be agreed upon by private negotiation by the stallion manager and the mare owner. 2) Costs incurred in transport to and from the Stud. 3) All treatment, examinations, pathology tests and medications administered either by the Stud Veterinarian, employees of the stud or by others. 4) Any additional costs incurred by the stud during the broodmare’s and/or progeny’s stay at the stud. SECTION 3 Deposits The mare owner agrees upon a booking fee (deposit) of $150.00, plus a copy of the mare’s registration certificate (where applicable) to be forwarded upon the signing and completion of this contract within 7 days to reserve a breeding service. This deposit is deductible from the total breeding fee but is nonrefundable upon cancellation of this contract for any reason. SECTION 4 Payments The aforementioned fees (breeding fee$800 + gst ) and costs related to agistment, veterinarian costs, medications and transport fees of frozen semen, if required in the contract, must be paid in full by cash, bank cleared cheque or direct debit before the mare is released or the semen transported from the stud. SECTION 5 Service Certificate Once the mare’s owners have fully paid all fees and cost owed to the stud, the stallion manager will provide a Service Certificate within 28 days once the stud has been provided with a positive pregnancy result for the mare. 3 SECTION 6 Live Foal Guarantee If the mare does not become impregnated by frozen semen, or if the resulting foal dies within twenty four (24) hours of being born, the stallion manager will not be held responsible and is held harmless from all liability. Veterinarian certification of the foal’s death must be forwarded to the stallion manager within 7 days. In that event the mare’s owner will be entitled to a discounted rebreeding service the following year; however once more, the mare owners will be liable for the previous mentioned costs as agistment, veterinarian fees, handling and transport charges of frozen semen. If the mare was live cover, there would be a free return to the same mare the following season, once again by live cover. SECTION 7 Frozen Semen The Stallion Manager will notify Total Livestock Genetics to release the amount of frozen semen ordered. Please contact Total Livestock Genetics to discuss transport costs. The loss of or damage to the semen from the moment it has been released will be the reasonability of the mares owner or transporting company which is not affiliated nor employed by The Stallion Manager/Owner. We strongly suggest insurance on the semen. SECTION 8 Refund of breeding fee If the stallion Simeon Champagne is unable for any reason whatsoever to live cover the aforesaid mare, then this contract shall be rendered null and void and the booking and breeding fee will be refunded in full to the mare owners, this being the ONLY condition under which the fee may be refunded. SECTION 9 Fees Unpaid It is an specific condition of this agreement that the stallion manager shall have a legal right over the mare and/or progeny in respect of any unpaid fees or charges and further more shall have the power to sell the mare and/or progeny to recover such unpaid fees or charges, should the same not be paid within thirty (30) days after an account has been rendered or before the mare and/or progeny leaves the stud. In this respect the mare owner hereby appoints the stallion manager as the owners’ attorney with the power to sell the mare and/or progeny and to execute all necessary documents to achieve this end. SECTION 10 All Care No Responsibility The stallion manager and/or Stud Veterinarian shall give all care and attention to the broodmare and/or Progeny but shall not be held liable for any loss, damages or claims of whatsoever nature arising from disease, accident, injury or death caused or sustained by the broodmare and/or progeny whilst under the studs care and the control of its servants or agents. 4 SECTION 11 Contract Acceptances The mare owners signature on this contract attests to the fact that the mare owner has read and understood all of the terms outlined herein and accepts this contract as a legal binding instrument on behalf of the owner, owner’s heirs, successors and assignees. This contract constitutes the agreement between both parties. No other agreements, whether verbal or implied, are included. This contract is made legal in all States of Australia, regardless of the manner of solicitation, and shall be interpreted, enforced and transacted under the laws of Victoria, Australia. There is no live foal guarantee with the semen. If no foal results from the use of the dose, then the Purchaser can request further straws from the Owner or Agent at a discounted price. We typically freeze in 5 ml straws and one straw is usually an insemination dose. When purchasing a frozen semen breeding, it comes with a no live foal guarantee. If 1/2 ml straws are used, it can take anywhere from 3 to 4 straws per insemination dose to up to 12 straws per insemination dose.
