“TERMS AND CONDITIONS OF STALLION SERVICE CONTRACT FOR FOXLEIGH
STUD”
1. The service fee is nonrefundable and is payable to Foxleigh Stud prior to
collection and dispatch of any semen.

2. All costs associated with collection and transportation of semen is the
responsibility of the mare owner and are payable to the collection station, in
full, prior to collection and dispatch of the semen or by arrangement. Unless
terms are altered in contract above. Minimum 24 hours notice is required for
the collection.

3. In the event that the stallion is sold, dies, or is unable to be bred (ie medical
reasons), the mare owner is entitled to a full refund excluding costs already
incurred.
4. The mare owner agrees to notify Foxleigh Stud whether a pregnancy has
resulted. Pregnancy testing must be conducted between 14 - 18 days and
between 42 - 45 days after the date of insemination. Failure to notify will
result in no service certificate being issued.
5. The onus is on the mare owner to provide all relevant information required
for completion of Service Certificates.
6. Should any mare fail to conceive after three (3) inseminations, a full
reproductive exam including a uterine swab/biopsy must be performed with
the results posted/emailed to Foxleigh Stud.
Should the examine show the mare to be infertile the mare owner may
request to transfer this contract to another mare of their own. Foxleigh
Stud reserves the right of refusal of any mare for any reason and reserves
the right to charge handling fees for further collections.
7. 48 hour Live Foal Guarantee (LFG). Should the mare fail to produce a live
foal that can stand and suckle, the mare owner shall be entitled to a return
breeding, for the same mare to the same stallion, for the following season. A
certificate by a qualified veterinary surgeon which positively identifies the
mare in the above contract and certifies her failure to produce a live foal
must accompany any claim. The certificates must be received within 14 days
of her due foaling date or the birth of the foal.
8. In the event of a return service the following breeding season, an
administration/handling fee of $275.00 will be due and payable to Foxleigh
Stud prior to any further collections.
9. The Live Foal Guarantee will be null and void if, in the opinion of a qualified
veterinarian, the mare owner was negligent in management or provision of
such management for the mare during the term of the pregnancy and/or at
the time of foaling, which could contribute to the death of the foal.
10.Foxleigh Stud reserves the right to refuse any mare for any reason.
11.Semen Availability. The 2013/2014 season will be defined as 01.09.2013
through to 28.02.2014 unless by other arrangement.
12.The mare owner hereby acknowledges that it is their responsibility to
understand and abide by the terms set out in this breeding contract. It is also
the mare owner’s obligation to familiarise themselves with other charges that
do not form part of this contract.
13.Foxleigh Stud accepts no responsibility for any delays, damage or defects to
shipping containers, semen, etc that have occurred after the semen has been
dispatched.
14.Contractually the semen is not to be used for Embryo Transfer (ET). If you
wish to utilise a service for ET please contact Foxleigh Stud for terms and
conditions.
15.All prices in this contract are inclusive of GST.
