Did you know…any part of the net estate of a decedent not effectively disposed of by the will of the decedent shall
pass as provided in ORS 112.025 to 112.055?
Surviving Souse – inherits 100% if no children or if all children are of this spouse. 50% if anyone child is of a different spouse.
Children – inherit 50% if surviving spouse is not parent of all children, or 100% if no surviving spouse. Issue of deceased children inherit by
representation. Adopted children are heirs of their adopted parents and not of their natural parents.
Grandchildren – inherit by representation if parent does not survive. Issue of deceased grandchildren inherit by representation.
Parents – inherit if deceased had no surviving spouse or issue. An unmarried father must acknowledge his child in writing during the child’s
life.
Brothers and Sisters – inherit if no surviving spouse of issue or parents. They take by representation.
Nephews and Nieces- inherit if no surviving spouse, issue, parents or siblings. Issue of deceased nephews and nieces take by representation.
Grandparents – inherit where no surviving spouse, issue, parents or issue of parents.
Aunts and Uncles – inherit where no surviving spouse, issue, parents, issue of parents, or surviving grandparents. Issue of deceased aunts and
uncles take b representation. “Representation” is the method of determining the passing of the net intestate estate when the distributes are of
unequal degrees of kinship to the decedent. The estate is divided into as many shares as there are surviving heirs of the nearest degree of
kinship and deceased persons of the same degree who left issue who survive the decedent. Each surviving heir of the nearest degree receives1
share and the share of each deceased person of the same degree is similarly divided amount the issue of the deceased person.
First Cousin – inherit where none of the above survive. Issue of deceased first cousins take by representation.
First Cousins Once Removed (children of first cousins) – inherit where all of the above are deceased, Issue of same take by representation.
The State of Oregon – inherits if none of the above or their issue survive.
