STANDARD TERMS AND CONDITIONS
OF OPEN ACCOUNT AGREEMENT
1)
TERMS OF PAYMENT
The terms of payment are “NET 30 DAYS” from the date of service. All services are subject to Time Price
Differential 1-1/2% per month (18% per annum) which shall be charged to you and payable by customer on all
invoiced amounts not paid at the “NET 30 DAYS” term.
2)
DURATION
The duration of this Agreement will depend on the volume of business. Open accounts are reviewed annually. If
$2,000 of revenue is not generated annually you may lose your open account status.
3)
WARRANTY
All warranty work must be performed during the regular business hours of 8:00AM to 5:00PM Monday through
Friday. Warranty not valid nights, weekends, or Holidays!
Nelson Brothers Sewer and Plumbing, Inc. (Nelson) warrants its work for a period of 90 days for plumbing repairs
and 30 days for sewer and drain maintenance from the date of completion of work. The warranty period may be
eliminated on sewer or drain cleaning due to, abuse, heavy roots, foreign objects, drains in need of repair or
replacement, or sewers greater than 100ft in length without an additional cleanout. Nelson Bros. provides a one-year
warranty on fixtures and 90-days on labor for the installation of company provided fixtures and related parts. Nelson
Bros. provides a one-week warranty on jetting service. Nelson Bros. does not warrant restaurant waste lines, toilet
augers, urinal snaking and roof vents.
Nelson Brothers Sewer and Plumbing, Inc. sole warranty responsibility is to replace or repair, at Nelson's sole
option, any parts or workmanship found to be defective during the warranty period. This warranty shall not apply to
any damage or defects caused by unauthorized repair work, use of unauthorized repair parts, misuse or abuse on the
part of the customer, damage caused by acts of God, or defects in parts that are attributable to the manufacturer.
Work to be done pursuant to this warranty does not include repairs, remediation, or replacement of damaged
property or any other consequential damage resulting from defective parts. The remedies of the purchaser are as set
forth here and are exclusive, and the liability of Nelson with respect to its work is limited to that which is covered or
furnished under this warranty and shall not, in any event, exceed the price of the labor and materials required to
complete the work.
4)
CUSTOMER REQUIREMENTS
Nelson Bros. agrees only to perform services as requested by Customer. Technicians may make suggestions about
future repairs or services needed, but will not perform said services until authorized by Customer.
5)
PRICES
Services performed for Customer shall be at Nelson Bros. Sewer & Plumbing, Inc., current prices in effect at the
time of service.
6)
REMEDIES
In the event any proceeding is required of taken by Nelson Bros. Sewer & Plumbing, Inc. to enforce its right to
collect any amounts due under this agreement, in addition to Time Priced Differential stated in Paragraph 1 above,
Nelson Bros. Sewer & Plumbing, Inc. shall be entitled to recover and Customer shall be obligated to pay, all
expenses incurred by Nelson Bros. Sewer & Plumbing, Inc. in such proceedings, including but not limited to, court
costs and filling fees, recording fees, expenses of litigation, and actual attorney fees. The remedies provided herein
are in addition to, and not in lieu of, any other remedies Nelson Bros. Sewer & Plumbing Inc. may have at law or in
equity and the pursuit at any one remedy shall not be construed to be a waiver of, or bar to, the pursuit of any other
available remedy.
7)
LAW AND VENUE
The laws of the State of Michigan shall govern this Agreement and the venue for the resolution of any dispute
arising under this Agreement shall be at the 44th District Court or Oakland County Circuit Court.
8)
ENTIRE AGREEMENT
The face of this agreement, together with any written addendum or attachment hereto, executed by both Nelson
Bros. and Customer, constitutes the entire agreement between Nelson Bros. Sewer & Plumbing, Inc. and Customer
and supersedes all other prior, oral and written understandings or agreements. This Agreement may not be modified
except by a written amendment signed by both Nelson Bros. Sewer & Plumbing, Inc. and Customer.
