Qualifications for registration (7) Any grant of extension of time by the Board shall not affect any offence under any other Ordinance that the person who has failed to renew on time may commit as a result of that failure. (8) If the registration of a registered professional engineer has expired, the Board may require him to reapply for registration instead of renewing his registration. (1) The Board shall not register a person as a registered professional engineer unless— (a) he— (i) is a member of the Institution within a discipline; or (ii) is a member of an engineering body, the membership of which is accepted by the Board as being of a standard not less than that of a member of the Institution within a discipline; or (iii)has passed such examination in engineering and other subjects and has received such training and experience as the Board may accept, either generally or in a particular case, as a qualification of a standard not less than that of a member of the Institution within a discipline; and (b) he satisfies the Board that he has had 1 year's relevant professional experience in Hong Kong before the date of his application for registration; and (c) he is ordinarily resident in Hong Kong; and (d) he is not the subject of an inquiry committee or a disciplinary order under Part IV which precludes him from being registered under this Ordinance; and (e) he satisfies the Board by declaration in writing that he is competent to practise in the relevant discipline; and (f) he is a fit and proper person to be registered. (2) Without limiting the effect of subsection (1)(f), the Board may refuse to register a person as a registered professional engineer who— (a) has been convicted in Hong Kong or elsewhere of any offence which may bring the profession into disrepute and sentenced to imprisonment, whether suspended or not; or (b) has committed misconduct or neglect in a professional respect. (3) Where the Board is satisfied by an applicant that he is competent to practise engineering in a discipline and that the Board is later satisfied that the person is not competent to practise engineering in that discipline, the Board may refer the matter to an inquiry committee who shall deal with it as if it was a complaint under section 21(1). 18. Notice to Board on leaving Hong Kong A registered professional engineer shall notify the Board if he is likely to be absent from Hong Kong for a continuous period of more than 6 months. 19. Removal of name from the register (1) The Registrar may remove the name of a registered professional engineer from the register if he has notice that the registered professional engineer has— (a) died; (b) applied to discontinue his registration; (c) in the opinion of the Board, ceased to be ordinarily resident in Hong Kong; (d) failed to renew his registration; (e) ceased to hold a qualification by virtue of which he was registered; or (f) failed to notify a change of details required under section 11(3). (2) For the purposes of subsection (1)(c), if a registered professional engineer has failed to reside in Hong Kong for a period of 2 years or more, the Board shall not consider him to be ordinarily resident in Hong Kong. (3) Subject to section 26(2), the Registrar shall remove a name from the register if he receives an order of the Court of Appeal or an inquiry committee directing that the name be removed from the register. (4) Where the Registrar intends to remove the name of a registered professional engineer from the register under subsection (1)(c), (d), (e) or (f), he shall send notice of his intention by prepaid registered post to the registered address of the registered professional engineer and shall not remove his name until the expiry of a period of 28 days after the date of posting the notice. (5) If the Registrar gives notice to a registered professional engineer that— (a) the Board is of the opinion that he is not ordinarily resident in Hong Kong and, before the Registrar acts to remove his name from the register, the registered professional engineer satisfies the Board that he is ordinarily resident in Hong Kong; (b) he has not applied to renew his registration and, before the Registrar acts to remove his name from the register, the registered professional engineer properly applies to renew his registration; (c) he has ceased to hold a qualification by virtue of which he was registered and, before the Registrar acts to remove his name from the register, the registered professional engineer satisfies the Board that he holds the qualification; or (d) he has failed to notify a change in particulars required under section 11(3) and, before the Registrar acts to remove his name from the register, the registered professional engineer takes such action as will remedy the defect in the register, the Registrar shall not remove the name from the register for the reason set out in the notice referred to in subsection (4). (6) If the name of a registered professional engineer is removed from the register, his registration is cancelled and he shall return any certificate issued in respect of his registration to the Registrar. (7) The Board shall not be liable to refund to a person any fee, or any part of any fee, on the removal of his name from the register. (8) The Registrar may correct any error apparent on the face of the register. 15. Expiry of registration and renewal (1) The entry in the register of a person as a registered professional engineer under this Ordinance— (a) shall remain in force for 12 months from the date when he was registered; (b) may be renewed annually by application of the person so registered. (2) A registered professional engineer shall apply for renewal of registration to the Registrar in the form specified by the Board not earlier than 3 months and not later than 28 days prior to the expiry of the current registration. (3) A registered professional engineer shall pay to the Board the fee for an application for renewal of registration at the time of applying for renewal of registration. (4) If a registered professional engineer does not apply for renewal of registration before the expiry of his current registration— (a) the Registrar shall, on the expiry of the current registration, note in the register that registration has not been renewed; and (b) the person shall be deemed not to be currently on the register from the date of expiry of his registration. (5) The Board may reject an application for renewal if it is satisfied that the applicant does not continue to comply with the requirements for registration set out in section 12. (6) Where a registered professional engineer fails to renew his registration within time, the Board may extend the time for renewal of registration if the registered professional engineer pays to the Board the fee for the extension of time. 4 20. 28 Disciplinary offences (1) Any person who is aggrieved by any decision or order made in respect of him under section 14(1), 15(5) or 23(1) may appeal to the Court of Appeal. (Amended 33 of 1997 s.14) (2) The Court of Appeal may affirm, reverse or vary the decision appealed against. (3) Where a person appeals against a decision of an inquiry committee, the Court of Appeal shall consider the reasons of the inquiry committee and submissions upon the findings of fact and law of the inquiry committee made on behalf of the parties to the inquiry and may call for the original record of the evidence taken and any document put in evidence before the inquiry committee. (4) The Court of Appeal may, upon special grounds being shown, consider any additional evidence not adduced before the inquiry committee. (5) The decision of the Court of Appeal upon any appeal shall be final. (6) The practice in relation to any appeal shall be subject to any rules of court made under the High Court Ordinance (Cap.4) (Amended 57 of 1999 s.3) (7) The Court of Appeal shall not have power to hear any appeal against a decision or order made under section 14(1), 15(5) or 23(1) unless— (a) in the case of a decision made under section 14(1) or 15(5), notice of such appeal is given within 3 months after the applicant is notified in writing of the decision; (b) in the case of an order made under section 23(1), notice of such appeal is given within 3 months of the service of the order under section 26. (Replaced 33 of 1997 s. 14) (8) In deciding any appeal under this section the Court of Appeal may make such order for payment of costs as it considers reasonable. (1) A registered professional engineer commits a disciplinary offence if he— (a) commits misconduct or neglect in any professional respect; (b) has been convicted of an offence under this Ordinance; (c) has obtained registration under this Ordinance by fraud or misrepresentation; (d) was not at the time of his registration under this Ordinance entitled to be registered; (e) has held himself out to be a registered professional engineer in a specific discipline when he was not so registered; (f) without reasonable excuse, fails to attend before an inquiry committee when summoned either as a witness or as a person in respect of whom the inquiry committee is meeting; or (g) has been convicted in Hong Kong or elsewhere of any offence which may bring the profession into disrepute and sentenced to imprisonment, whether the sentence is suspended or not. (2) If a person who has been guilty of misconduct or neglect in a professional respect or has been convicted of an offence under this Ordinance or has been convicted of an offence likely to bring the profession into disrepute and sentenced to imprisonment, informs the Board of such misconduct, neglect or conviction when he applies for registration or renewal of registration and the Board subsequently accepts the person for registration or renewal of registration, that person shall not, for the purposes of registration or renewal of registration, be considered as having committed a disciplinary offence in respect of the disclosed misconduct, neglect or conviction. (3) Where the Registrar receives a complaint concerning a disciplinary offence, the Registrar shall submit the facts to 2 members of the Board appointed by the Board for the purpose, and the members, in consultation with the Registrar, shall determine whether the complaint should be referred to the Board. 21 Appeal to Court of Appeal 29 Use of title (1) A person whose name does not appear on the register shall not be entitled to describe himself as a “registered professional engineer” with or without a qualifying discipline or to use the initials “R.P.E.” with or without a qualifying discipline. (2) A person shall not use the description of “registered professional engineer” or the initials “R.P.E.” unless the person includes in the description the qualifying discipline either in full or by an abbreviation approved by the Board. (3) The Board may apply to a judge for an order restraining any person whose name is not on the register or on the part of the register which applies to a particular discipline from describing himself as a “registered professional engineer” or using the initials “R.P.E.” whether used with or without a qualifying discipline or with a discipline for which he is not registered. (4) A person, including a firm or company, shall not use the description of “registered professional engineers” or the initials “R.P.E.” unless— (a) at each place where the person carries on the business of engineering, that business is conducted under the supervision of a registered professional engineer of the appropriate discipline who does not act at the same time for any other person other than for a firm or company that has substantially the same beneficial ownership and management as the person (where the person is a firm or company); (b) where the person carries on a multidisciplinary practice, that business, so far as it relates to engineering, is under the full time control and management of a registered professional engineer of the appropriate discipline who does not act at the same time in a similar capacity for any other person other than for a firm or company that has substantially the same beneficial ownership and management as the person (where the person is a firm or company) Inquiry committee and rules of conduct (1) The Board may refer any complaint concerning a disciplinary offence to an inquiry committee for decision, and for that purpose the Board may establish an inquiry committee of not less than 3 members of the Institution in the same or a similar discipline as the registered professional engineer in respect of whom the complaint is made, to determine whether or not he has committed a disciplinary offence. (2) The Board may make rules providing for the conduct of its inquiries by an inquiry committee and for other matters relating to the investigation of an alleged disciplinary offence. (3) The inquiry committee shall not proceed to hear evidence of a complaint concerning a disciplinary offence unless the registered professional engineer in respect of whom the complaint is made is given 28 days’ notice of the complaint and the date, time and place of the hearing. (4) The registered professional engineer referred to in subsection (3) shall be entitled to attend and hear all evidence produced at the hearing and shall be provided with a copy of this Ordinance and any rules made under this section. (5) The Board may make rules for the rehearing of an inquiry by an inquiry committee. (6) Where a registered professional engineer is alleged to have committed a disciplinary offence under section 20(1)(b) or (g), the inquiry committee— (a) shall not be required to inquire whether the registered professional engineer was properly convicted of the alleged offence; and (b) may consider any record of the case in which a conviction was recorded and any other evidence which is relevant as showing the nature and gravity of the offence. (7) The inquiry committee may, in deciding whether a person has committed a disciplinary offence, have regard to any code of professional conduct or practice promulgated by the Board or currently in use by the Institution. (5) The Board may apply to a judge for an order restraining any person who holds himself out to be providing engineering consultancy services at a professional level from so doing if the name of the person does not appear on the register or if the person has not complied with the requirements set out in subsection (4)(a) or (b). 5 (g) 30 falsely takes or uses any name, initials, title, addition or description implying that his name is entered in the register; (h) not being a registered professional engineer, knowingly permits the use of or uses in connection with his business or profession the description— (i) “registered professional engineer”; (ii) “registered professional engineer” with reference to a discipline; (iii) “R.P.E.”; (iv) “R.P.E.” with reference to a discipline; or (v) initials or abbreviations of words intended to cause, or which may reasonably cause, any person to believe that the person using them is on the register; (i) not being on the register, advertises or represents himself as a registered professional engineer or knowingly permits himself to be so advertised or represented; (j) holds himself out to be ordinarily resident in Hong Kong at the time of making an application for registration when he is not so ordinarily resident, commits an offence and is liable to a fine of $50,000 and to imprisonment for 1 year. Offences and penalties Any person who— (a) having been summoned by an inquiry committee to attend as a witness or to produce a document or other thing under section 24 without reasonable excuse refuses or fails to do so; (b) attends as a witness before an inquiry committee and, without lawful excuse, refuses or fails to answer any question put to him by the inquiry committee; (c) fraudulently obtains registration as a registered professional engineer for himself or any other person; (d) obtains registration as a registered professional engineer for himself or any other person by means of any misleading, false or fraudulent representation or statement, either orally or in writing; (e) makes or causes to be made any falsification in the register; (f) impersonates or falsely represents himself as being the person referred to in any certificate or document presented to the Board or an inquiry committee in connection with its functions under this Ordinance; FOR ENGINEERS REGISTRATION BOARD SECRETARIAT USE ONLY HKIE Membership No.: Other Qual/s.: HKIE Disc: Prof. Cheque No.: Regn Fee Paid on: Regn Comm Decn: Regn from: Reason for rejection: 6 ENGINEERS REGISTRATION BOARD 工 程 師 註 冊 管 理 局 Registration of Registered Professional Engineer (Discipline) Notes to Applicants 1.0 Eligibility for Registration To help you to check if you are eligible for registration, please consider the following: 1. Do you hold a professional qualification acceptable for registration and have held it for one year? (Refer to Section 1.1) 2. Have you practised in Hong Kong for one year after having acquired the professional qualification acceptable for registration? (Refer to Section 1.2) 3. Are you ordinarily resident in Hong Kong? (Refer to Section 1.3) 1.1 Qualification for Registration The following are acceptable qualifications for registration: a) a professionally qualified engineer with Corporate Membership of the Hong Kong Institution of Engineers (the HKIE) within a discipline or b) a qualified Member of a professional body recognized by the Engineers Registration Board (ERB) as having a standard not less than that of a Corporate Member of the HKIE within a discipline. The following conditions apply to applicants who would like to make use of Professional Membership of these institutions as qualification for registration. General Conditions (i) Professional Members of the S:\Erb\151\Notes to Applicants Printed Version_(20042015) above institutions must have undergone a Professional 7 ENGINEERS REGISTRATION BOARD 工 程 師 註 冊 管 理 局 Assessment/Review which includes an interview by the parent institution. For the Institutions in the United Kingdom, Professional Assessment/Review mentioned in this paragraph must be conducted at the level which would enable the applicants to satisfy the registration requirements for Chartered Engineer. (ii) Applicants for registration who had obtained their professional qualification of the above institutions (with the exception of the Institution of Civil Engineers) by mature route are not considered as having acceptable qualification for registration. (iii) Applies only to Professional Members of the above institutions who have been admitted via normal procedures and do not apply to Professional Members of the above institutions who joined via their own reciprocal recognition agreements. (iv) The ERB may, at its discretion, require an applicant to undergo an interview and/or undertake a written examination of his knowledge of engineering within a discipline. In the circumstances that an interview/ a discipline matching interview is required, the applicant will be asked questions related to his/her competences. (v) The eligibility for holders of above professional qualifications to a particular discipline shall be assessed and allocated by the Engineers Registration Board. Additional Conditions Notes: A i) All applications made on and after 12 January 2010 shall be subject to the following terms and conditions. ii) Applies to Registered Chartered Professional Engineers of the Engineers Australia and Registered National Professional Engineers in Australia. iii) When applicants from Registered Chartered Professional Engineers of the Engineers Australia or Registered National Professional Engineers in Australia wish to apply for registration under the reciprocal recognition agreement between the HKIE and the Engineers Australia, they must fulfill the following:(a) Provide a continuing professional development record for the purpose of application; and (b) Attend an interview based upon submission of a training and experience report for the purposes of matching the applicant to an engineering discipline as stated in A(iii)(c). (c) This Agreement is only applicable to the following engineering disciplines: ‧Biomedical ‧Building ‧Building Services ‧Chemical ‧Civil ‧Control, Automation & Instrumentation ‧Electrical ‧Electronics ‧Environmental S:\Erb\151\Notes to Applicants Printed Version_(20042015) 8 ENGINEERS REGISTRATION BOARD 工 程 師 註 冊 管 理 局 ‧Fire ‧Gas ‧Geotechnical ‧Information ‧Manufacturing & Industrial ‧Marine & Naval Architecture ‧Materials ‧Mechanical B C Applies only to materials engineers who are assessed for Chartered Engineer (CEng) registration and are registered CEng with the Engineering Council by the IMMM. i) Limited to Senior Members (Senior Engineers) of the Chinese Society for Electrical Engineering (CSEE) or Chinese Mechanical Engineering Society (CMES) in the Electrical (ELL), Mechanical (MCL) and Manufacturing & Industrial Engineering (MIE) Disciplines only. ii) Applicants shall, for a period of at least five continuous years immediately prior to application, have been in a position of significant responsibility in the engineering field. iii) Applicants must attach a letter of certification from the CAST certifying that they have satisfied the requirements on reciprocal recognition with his Senior Membership (Senior Engineer) with the CSEE or CMES. iv) Applicants from the mainland who have substantive experience in the mainland should qualify through CAST and on the approval of the CAST, apply for Registered Professional Engineer in the Discipline(s) identified in C(i). v) The Discipline applied to the applicant shall be subject to allocation by the ERB. D i) Applies to Members of the IET who are Chartered Engineers (the Chartered Engineer status must be obtained through passing Professional Interview of the IET) in the Electrical (ELL), Electronics (ENS), Control, Automation & Instrumentation (CAI), Manufacturing & Industrial (MIE) and Information (INF) Engineering Disciplines. ii) Applicants for Registered Professional Engineer shall identify the discipline in which they consider it would be appropriate for them to be registered. Applicants are required to highlight their relevant experience, including duties and responsibilities in a particular project, in the applying discipline in the application. The ERB would then conduct assessment on the applications and if necessary, discipline matching interview might be required. Based upon the outcomes of discipline matching interview, assessors would reserve the right to conduct essay writing test in cases they think appropriate. iii) All applications made on or after 9 November 2009 shall be subject to the above terms and conditions. E Applies to Corporate Members of IPENZ who have been qualified through supervised training and have not less than four years experience; or those who have been qualified through having practical experience of not less than six years. Acceptance to a Discipline, however, be assessed by the ERB. Corporate Members of the IPENZ are not eligible for registration in Structural Discipline. F i) Applicants who have obtained their substantive training and experience in a jurisdiction shall apply for Professional Membership in that jurisdiction first. If these applicants wish to apply for Professional Membership in other jurisdiction first, they must possess relevant working experience in that jurisdiction of not less than 6 months at the time of submitting their applications in order to be eligible to make submissions under this Agreement. ii) Applicants for Registered Professional Engineer shall identify a Discipline in which they consider it would be relevant for them to be registered. Acceptance to a Discipline shall, however, be assessed by the ERB. The assessment will normally include an interview based upon education, training and experience reports for matching of Discipline. G i) Applies to Members of the BCS who are Chartered Engineers (The Chartered Engineers status must be obtained through Membership of the BCS). ii) Applicants who have obtained their substantive training and experience in a jurisdiction should normally apply for Membership in that jurisdiction first. If these applicants wish to apply for Membership in the other jurisdiction first, their submission under this Agreement within 12 months after successful granting of Membership by the other jurisdiction may be subject to a review which would consist of any or all of the following: (a) (b) (c) (d) Submission of a training and experience report; Interview; Essay test; Submission of record of continuing professional development. The ERB has the discretion to determine the extent and scope of the review. H i) Applicants who have obtained their substantive training and experience in a jurisdiction shall apply for Members in that jurisdiction first. If these applicants wish to apply for Members in other jurisdiction first, their submissions under this Agreement shall be subject to a review which may comprise any or all of the following: (a) (b) (c) (d) Submission of a training and experience report; Interview; Essay test; Submission of record of continuing professional development. The ERB has the discretion to determine the extent and scope of the review. The ERB has the discretion to determine the extent and scope of the review. iv) Applicants who are Members of the Institute in the jurisdiction where they have obtained their substantive training and experience may be required to submit a report on training and experience and record of continuing professional development for review, and to attend an interview. All applications shall be assessed on an individual basis. K i) All applications made on or after 26 September 2005 shall be subject to the following terms and conditions. ii) Applies to Full Members of the HKCS (including Fellows). iii) Applicants are required to possess all of the following professional formation. (a) An engineering/computing degree in a relevant subject accredited/recognized by the HKIE and the HKCS. (b) One of the following experience formation in Information and Communication Technologies/Information System (ICT/IS) work: 1) A minimum of 8 years post graduation experience for applicants who had been Full Members of HKCS for less than 2 years, or S:\Erb\151\Notes to Applicants Printed Version_(20042015) 11 ENGINEERS REGISTRATION BOARD 工 程 師 註 冊 管 理 局 2) A minimum of 6 years post graduation experience for applicants who had been Full Members of HKCS for not less than 2 years, or 3) A minimum of 4 years post graduation experience for applicants who had been Full Members of HKCS for not less than 4 years. (c) A period of responsible experience in ICT/IS work for not less than 2 years. This period of experience can be achieved through the period of post graduation experience required in (b). L iv) The ERB shall retain full discretion as to the Registration of any applicants for Registered Professional Engineer. The ERB shall assess each applicant in accordance with his/her individual merits and in cases necessary, conduct an interview in assessing a particular applicant. v) An applicant from HKCS shall submit a certificate issued by the HKCS to assist the assessment of the application. i) All applications made on or after 2 June 2006 shall be subject to the following terms and conditions. ii) Applies to Members of the IMarEST who are Marine Engineers or Naval Architects and Chartered Engineers (CEng), or Chartered Marine Engineers (CMarEng) (The Chartered Engineer status must be obtained through Membership of the IMarEST). iii) Applicants who have obtained their substantive training and experience in a jurisdiction shall apply for Members in that jurisdiction first. If these applicants wish to apply for Members in the other jurisdiction first, their submissions under this Agreement could be subject to a review which may comprise any or all of the following: (a) (b) (c) (d) Submission of a training and experience report; Interview; Essay test; Submission of record of continuing professional development. The ERB has the discretion to determine the extent and scope of the review. M i) All applications made on or after 30 May 2007 shall be subject to the following terms and conditions. ii) Applies to Corporate Members (Chartered Engineer) of IGEM. iii) Applicants who have obtained their substantive training and experience in a jurisdiction shall apply for Membership/corresponding Corporate Membership (Chartered Engineer) in that jurisdiction first. The ERB has the discretion to determine the extent and scope of the review. N i) All applications made on or after 26 May 2008 shall be subject to the following terms and conditions. ii) Applies to Members of the RINA who are Chartered Engineers (CEng) (The Chartered Engineer status must be obtained through Professional Review by the RINA). iii) Applicants who have obtained their substantive training and experience in a jurisdiction shall apply for Membership in that jurisdiction first. If these applicants wish to apply for Membership in another jurisdiction first, their submissions under this Agreement could be subject to a review which may comprise any or all of the following: (a) Submission of a training and experience report; (c) Interview; (d) Essay test; (e) Submission of record of continuing professional development. The ERB has the discretion to determine the extent and scope of the review. O i) Applies to Fellows of the SOE who are registered as Chartered Engineers with the Engineering Council of the United Kingdom (the Chartered Engineers status must be obtained through Membership or Fellowship of the SOE in the Control, Automation & Instrumentation (CAI), Mechanical (MCL) and Manufacturing & Industrial (MIE) Engineering Disciplines). ii) Applicants who have obtained their substantive training and experience in a jurisdiction shall apply for corresponding Membership/ Fellowship in that jurisdiction first. If these applicants wish to apply for corresponding Membership/ Fellowship in another jurisdiction first, their submissions under this Agreement could be subject to a review which may comprise any or all of the following: (a) Submission of a training and experience report; (b) Interview; (c) Essay test; (d) Submission of record of continuing professional development. If these applicants wish to apply for Membership in another jurisdiction first, their submissions under this Agreement could be subject to a review which may comprise any or all of the following: (a) Submission of a training and experience report; (b) Interview; (c) Essay test; (d) Submission of record of continuing professional development. The ERB has the discretion to determine the extent and scope of the review. iii) Applicants for Registered Professional Engineer shall identify the discipline in which they consider it would be appropriate for them to be registered. They are strongly advised to highlight their relevant experience, including duties and responsibilities in a particular project, in the applying discipline in preparing the submission for assessment. Acceptance to a discipline shall, however, be assessed by the ERB. The assessment may include a partial professional assessment consisting of examination of a report on training and experience, and an interview. Q Applies to Members of the IStructE at Chartered Engineer (CEng) level. The Mutual Recognition Agreement between the HKIE and the IStructE (the Agreement) ceased to exist on 1 January 2012. Applicants who obtained their MIStructE CEng qualification on or before 31 December 2011 and apply for registration as R.P.E. on and after 1 January 2012 would normally be considered as satisfying Section 12(1)(a)(ii) of the Engineers Registration Ordinance (Cap. 409). Applicants who obtain their MIStructE CEng qualification after 31 December 2011 would be assessed on an individual basis under Section 12(1)(a)(iii) of the Engineers Registration Ordinance (Cap. 409), taking into consideration the previous conditions that applied in the S:\Erb\151\Notes to Applicants Printed Version_(20042015) 14 ENGINEERS REGISTRATION BOARD 工 程 師 註 冊 管 理 局 previous Agreement. The following guidelines are used for those who have returned to Hong Kong after a period of residence outside Hong Kong: 1. Temporary absence of up to 6 months may not affect registration. 2. Engineers returning to Hong Kong who were either registered previously or who were qualified to be registered at the time they left Hong Kong may apply for registration on their return. In general they will qualify for registration, but the Board will exercise discretion on a case-bycase basis taking account of the requirements of particular disciplines and the time spent away from Hong Kong. 1.4 Declarations and Undertaking You must complete and sign the Declaration and Undertaking and should note that the Ordinance provides for heavy penalties for giving false information. If you are able to comply with the requirements, please complete and submit the application form together with the appropriate fee. If you are not a Member of the HKIE, you are required to present certified true copies of academic and professional qualification certificates (verified by Registered Professional Engineers, HKIE Members or employers) and reference letters from current and previous employers (past five years only) stating the date of attainment of professional qualifications, your positions, employment dates and detailed job descriptions. 2.2 How long will it take ? You should expect the process to take a few months. The process has 3 stages: secretariat checking, review by the Registration Committee and formal approval by the Engineers Registration Board. You will be notified of the outcome by mail. If your application is successful, you will be sent a Registration Certificate valid for one year. All registrations commence on the first day of the month following the Board's approval. Annual renewal is essential to maintain registration. After renewal, a new registration certificate in the form of a card will be sent to a R.P.E. 2.3 Payment All applicants for R.P.E. should attach a cheque for the application fee and the first annual registration fee. Details of the fees are enclosed in the attached sheet. 2.4 Can another discipline be added later ? If you want to apply for registration in an additional discipline, you will need to apply again and pay the fee. Following approval a new registration certificate showing the additional discipline with the current registered discipline(s) will be issued and the new certificate will be valid for one year from the date of registration of the additional discipline. 2.5 How to renew ? Three months before your registration is due for renewal, notification of renewal will be mailed to your registered address. Normally, no renewal notices will be sent to R.P.E. with overseas addresses. If you fail to renew your registration by the due date, you will cease to be a Registered Professional Engineer. However, if late renewal is received within three months of the due date for renewal, your registration will be reinstated for the remainder of the original renewal period following receipt of payment of the renewal fee. If the registration has expired for more than three months, a fresh application for registration will have to be submitted. S:\Erb\151\Notes to Applicants Printed Version_(20042015) 18 ENGINEERS REGISTRATION BOARD 工 程 師 註 冊 管 理 局 3.0 Engineers Registration Ordinance The Engineers Registration Ordinance was enacted into law on 2 May 1990 to establish the professional status of engineers practising in various disciplines, and to safeguard the rights of the consumer public. You are advised to familiarize yourself with the contents of the Ordinance as ignorance is not an acceptable defence in a case of failure to comply with the law. Under the Ordinance the registration of engineers is undertaken by the Engineers Registration Board. The Board acts independently and is primarily responsible to the public at large. The Government appoints one member to the Board and liaison between the Board and the Government is through the Development Bureau. All other appointments to the Board are made by the HKIE, which also provides the administration services under the direction of the Board. The concept of registration is to confer on suitable applicants a title, which demonstrates - both to professional engineers and to the public - a high standard of professional training, competence to practise, and a relevant background for working in Hong Kong. A person who is on the register may use the title "Registered Professional Engineer", or "R.P.E.", with reference to the discipline(s). It is an offence for a person to use this title if one is not on the register. Under the Ordinance, the qualification for registration is closely linked with the qualification standard for membership of the HKIE. However, HKIE membership is not a prerequisite for registration. Membership of an engineering body which is accepted by the Board as being of a standard not less than that of a Member of the HKIE within a discipline may also be acceptable, provided that all the conditions stipulated thereon are also met. To qualify for registration an applicant must be ordinarily resident in Hong Kong and must have at least one year relevant post-qualification professional experience in Hong Kong. Registration is required to be renewed annually and all registrants are required to make a written declaration of their current competence to practise, both at first registration and at each renewal of registration. Registration is entirely voluntary. It is emphasized that the register is primarily for the use of the public, to permit them to identify appropriately qualified engineers, either with reference to the register, or by selecting engineers who use the protected title, "R.P.E.". In certain circumstances, the Government, with the safety or well being of the public in mind, may require (by law or other means), or recommend, that certain duties be carried out only by Registered Professional Engineers in appropriate disciplines. In connection with the Personal Data (Privacy) Ordinance, all Registered Professional Engineers should be aware that their names, addresses, disciplines and qualifications are recorded on the register and are made available to the public on request in accordance with the provisions in the Engineers Registration Ordinance. Registration Application and Renewal 1. Fees for R.P.E. application or renewal should be paid by cheque drawn in favour of “Engineers Registration Board” or by cash. Payment by post-dated cheque and by credit card would not be accepted. 2. Payment by cheque will be deemed to be effected only when payment is made by the bank upon presentation. The Engineers Registration Board (ERB) accepts no responsibility if the cheque is dishonoured upon presentation. 3. Application fee for Corporate Members of the Hong Kong Institution of Engineers (HKIE) is different from that for non-members. The fee to be paid is to be determined at the date of application, i.e. an applicant needs to pay Corporate Member fee if at the date of application he is a Corporate Member of the HKIE. 4. Hong Kong experience means that all projects involved by the applicant must be situated in Hong Kong. 2. Major structural experience means design of a complete building, bridge, and structures of significant scale such as large retaining walls, water retaining structures, jetties/piers, space frames, pylons, overhead viaducts, falsework for large structures; and excavation and lateral support for deep excavations etc. 3. Time spent on design of minor temporary structures, minor structural alterations and additions, and supervision (safety or quality) of structural works on sites will not be fully counted towards the relevant structural experience. 4. Project coordination, project and contract management, cost estimations etc. for building developments or other types of projects will not be counted as relevant structural experience. Relating to the Personal Data (Privacy) Ordinance 1. The intention of the Personal Data (Privacy) Ordinance (the “Ordinance”) is to protect a living individual's right to privacy. Any information collected and recorded, whether on computer or manually, in relation to an applicant for registration (and renewal of registration) as a R.P.E. will be subject to regulation by the Ordinance. The Ordinance aims to control the collection, holding, processing and use of personal data. Personal data in these notes shall be referred to as "Data". 2. From time to time, it is necessary for all applicants to supply the Engineers Registration Board (ERB) in writing with data and of any change to the data after submission of application, in order to help the ERB in maintaining its records. Failure to supply such data may result in an inability of the ERB to process applications for registration and renewal of registration. 3. The purposes for which data relating to applicants may be used are as follows : as a basis for processing of R.P.E. registration and renewal of registration applications; and, for administration of the Engineers Registration Ordinance; 4. Upon successful registration as a R.P.E., the purposes for which data relating to applicants may be used in addition to the purposes stated in Paragraph 3 above are as follows: for daily operation of the ERB; for maintenance of R.P.E. records; for verification of R.P.E. registration status by departments of government or statutory bodies and the public; for activities and information relating to the ERB; for activities and information relating to statutory and non-statutory use of R.P.E.; for meeting the requirements to make disclosure under any law binding on the ERB; and, for all other incidental purposes relating to the functions of the ERB. 5. All R.P.E.s should be aware that as required by the Engineers Registration Ordinance, their names, addresses, disciplines and qualifications are recorded on the register and are made available to the public on request in accordance with the provisions in the Engineers Registration Ordinance. To facilitate public access to the information contained in the register, the same will be made available on the website of ERB (except addresses) and at the office of the Hong Kong Institution of Engineers. Other data held by the ERB will be kept confidential and safeguarded diligently but the ERB may provide such information to: any party in connection with the operation of the ERB; any other person under a duty of confidentiality to the ERB; and, any party with which the applicant has or proposes to have dealings. 6. ERB intends to use R.P.E.s’ data in direct marketing as follows and ERB requires the R.P.E.’s consent (which includes an indication of no objection) for such purpose:(a) the data that may be used by ERB for direct marketing is: name, address and other contact details; (b) conferences, seminars, workshops, talks, events, trips and social functions may be marketed.
