Minutes of the Committee of the Whole Meeting Monday, June 27, 2011 5:00 p.m. The Committee of the Whole met on Monday, June 27, 2011 at 5:00 p.m. in the City Council Chambers of City Hall at 232 East Jackson Street, Macomb, Illinois. Mayor Inman called the meeting to order and a moment of silence for former Alderman James Chambers who passed away this week and served on the City Council from 1987-2001. Members present: Ryan Hansen, Kay Hill, Louis Gilbert, Tom Koch, Dave Dorsett, Tim Lobdell, Clay Hinderliter, Donald Wynn and Dennis Moon. Nine Aldermen being present. Others Present: City Administrator Dean Torreson, Legal Counsel Kristen Petrie and Deputy City Clerk Corrina Wells. City Treasurer Ron Ward being absent. There were no public comments. First item for discussion was on an ordinance to create a Class P liquor license for Jackson Street Market, LLC. There was no discussion on the above item. Second item for discussion was on the draft Right of Way Infringing Use agreement on Collins Avenue for the Parking of Vehicles. Alderman Lobdell stated if needed, the agreement is revocable at will by the City Council, with or without cause, giving the Grantee 120 day’s written notice. Alderman Moon asked if there was a map showing the right- of -way for the agreement. City Attorney Kristen Petrie replied an exhibit will be attached as soon as all the information is received. No further discussion on the above item. Third item for discussion was on McClure Engineering’s contract amendment for additional expenses occurred on Ward Street Phase I construction. Eric Moe representing McClure Engineering reported Midwest Bridge and Crane submitted a request to the City and IDOT for additional time billed due to delays in weather, utility, water/sewer and subcontractor issues. The original contract completion date was August 27, 2010 with the project being completed on December 21, 2010. Mr. Moe stated we have calculated liquidated damages which will be assessed to Midwest Bridge and Crane to deduct from the final payment in the amount of $15,570.00 and in addition McClure Engineering has attached an amendment asking for related costs for providing additional engineering services in the amount of $22,567.43. Alderman Koch asked why the increase in time. Mr. Moe replied IDOT had approved several extensions requested by the contractor. Alderman Dorsett expressed concerns tax payers will be left paying any additional expenses incurred due to contractor’s delays. Alderman Lobdell stated an engineering contract had been approved at the beginning of the project and does not understand why additional money is being requested by the engineers. City Attorney Kristen Petrie replied she has not had time to review the original contract but will and report back. City Administrator Dean Torreson stated the liquid damages from Mid-West Bridge and Crane will be credited back to the City. Eric Moe representing McClure Engineering stated they would be willing to cut their engineering costs in half to get this taken care of. Alderman Lobell moved, seconded by Alderman Moon to have McClure Engineering provide a more detailed report, accept their offer of $15,570 to satisfy the bill and place on the agenda for Tuesday, July 5 Council meeting, all Aldermen voting “Aye”, Mayor Inman declared the motion carried. Fourth item for discussion was on the draft policy for usage and selection of engineering firms. No further discussion on the above item. Alderman Lobdell moved, seconded by Alderman Moon to place the above item on the agenda for Tuesday, July 5 Council meeting, all Aldermen voting “Aye”, Mayor Inman declared the motion carried. Fifth item for discussion was on quotes received for lining 803 feet of sanitary sewer along Ward Street. Alderman Lobdell asked what this would consist of. Waste Water Treatment Plant Manager Daryl Phillips replied the work would be from Piper Street south two manholes. Alderman Dorsett moved, seconded by Alderman Lobdell to place the above item on the consent agenda for Tuesday, July 5 Council meeting, all Aldermen voting “Aye”, Mayor Inman declared the motion carried. Sixth item for discussion was on implementing a credit card payment system for the City of Macomb. Alderman Dorsett reported the City previously considered adding an ATM machine in addition to a credit card machine but has agreed to add a credit card swipe machine along with links to the city’s website. This service would benefit customers by accepting major brand credit cards, debit cards, pre-paid debit cards and payments being accepted in person, online or by phone. By offering the use of credit cards the city would forego costs and interest of an ATM machine but pay for electrical, internet connections and possibly a flat screen monitor when implementing a credit card pay system. Alderman Hill asked if an ATM machine would be added at a later date. Business Office Supervisor Vicky Williams replied with Council’s approval we could add an ATM machine anytime. Alderman Lobdell moved, seconded by Alderman Hinderliter to approve a credit card payment system for the City and place on the agenda for Tuesday, July 5 Council meeting, all Aldermen voting “Aye”, Mayor Inman declared the motion carried. Mayor Inman reported on storm damaged caused by high winds the night before causing several downed trees and electrical outages. Speaking with Ameren, CIPS and Public Works they assured the intersections, streets and outages should be taken care of by Tuesday afternoon. The City yard waste site will be open additional days starting Monday and continuing through Wednesday from 10:00 a.m. to 6:00 p.m. and then again for regular business hours Thursday through Sundays from 10:00 a.m. to 6:00 p.m. for residents to haul debris due to the storm. Committee of the Whole Minutes June 27, 2011 Page 2 Mayor Inman reported Macomb’s Fourth of July celebration will take place Monday July 4 at Hansen Field on WIU Campus with gates opening at 6:00 p.m. Entertainment prior to the fireworks will include: Jayme Larson’s Dance Academy, Susie Q’s, Stephen Lane and Friends, Macomb American Legion & V.F.W. Post #1921 and the Macomb Municipal Band with fireworks starting at dusk (approximately 9:00 p.m.). Flags of Love will also be displayed in Chandler Park on the fourth, rain permitting. The Macomb Eagle’s Club and Macomb Elks Club will be setting up at 6:00 a.m. and taking down at 6:00 p.m. if anyone would like to help. Mayor Inman announced on Thursday, July 7 the Macomb Municipal Band will conduct a free concert outside City Hall starting at 7:00 p.m. and ending at 8:30 p.m. so please come down and enjoy the performance. Alderman Lobdell moved, seconded by Alderman Wynn to adjourn into executive session for the purpose of a) pending probable litigation, pursuant to Sec. 2 (c) (11) of the Open Meetings Act, all Aldermen voting “Aye” and Mayor Inman declared the motion carried and they adjourned into executive session at 5:29 p.m. Alderman Dorsett moved, seconded by Alderman Moon to adjourn back into Open Session, all Aldermen voted “Aye” and Mayor Inman declared the motion carried and they adjourned back into Open Session at 5:53 p.m. There being no further business, Alderman Moon moved, seconded by Alderman Dorsett to adjourn, all Aldermen voted “Aye” and Mayor Inman declared the motion carried and they adjourned at 5:53 p.m. ____________________ Deputy City Clerk
