Kingdom of Cambodia Nation Religion King Ministry of Interior Ministry of Commerce Ministry of Labour and Vocational Training No: Special Inter-institution Inter-ministerial Prakas On Sub-contract Management in Garment, Textile, and Footwear Industry Deputy Prime Minister, Minister of Interior Senior Minister, Minister of Commerce Minister of Labour and Vocational Training - Having seen the Constitution of the Kingdom of Cambodia Having Royal Decree No. NS/RKT/0908/1055 dated 25 September 2008 on Appointment of Royal Government of Cambodia Having seen Royal Decree No. 02/NS/94 dated 20 July 1994 on Organization and Functioning of Council of Ministers Having seen Royal Code No NS/RKM/0196/08 dated 24 January 1996 promulgating the Law on Establishment of Ministry of Interior Having seen Royal Code NS/RKM/0196/16 dated 24 January 1996 on Establishment of Ministry of Commerce Having seen Sub-decree No. 91 OrNKr.B dated 1 August 2007 on Organization and Functioning of Ministry of Commerce Having seen Royal Code NS/RKM/0105/003 dated 17 January 1995 promulgating the Law on Establishment of Ministry of Labour and Vocational Training According to the Directive No. 06 SRNN dated 15 July 2005 on Implementation of ILO’s Project for Improving Textile and Garment Factories in Cambodia According to the necessity of the markets of garment and footwear goods Decides Article 1: An Inter-ministerial Commission between Ministry of Commerce, Ministry of Interior, Ministry of Labour and Vocational Training shall be established with the composition as follows: 1- H.E Sok Sopheak, Director General of International Trade of MOC Chair 2- H.E Seng Sakda, Director General of MOLVT Vice Chair 3- Mr. Phann Sophal, Vice Director of Anti-Economic Crimes Police of Ministry of Interior Vice Chair 4- H.E Mean Sophea, Advisor to MOC and Director of Trade Preferences Department Permanent Member 5- H.E Var Rutsan, Advisor and Director of Intellectual Property Rights Department of MOC Member 6- Mr. Kim Meas So Siha, Director of Consumer Protection of Camcontrol Member 7- Mr. Nguy Rith, Deputy Director of Labour and Vocational Training Member 8- Mr. Ho Sivyung, Deputy Director of Bilateral Trade Department of MOC Member 9- Ms. Kong Sithyka, Deputy Director of Multilateral Trade Department of MOC Member 10- Mr. Kong Run, Chief of Anti-Economic Crimes Police Bureau of Ministry of Interior Member 11- Mr. Vin Bros, Chief of Bureau of Ministry of Interior Member Article 2 The Commission shall have its duties as follows: - Oversee and promote the implementation of the Royal Government policy over better working condition in the garment, textile and footwear. - Make local instruction, education and search for an appropriate implementation of Subcontract in accordance with the Labour Law of the Kingdom of Cambodia and international regulations. - Search for unregistered Sub-contractors, unjust labour practices, and review the report of the Secretariat and take necessary measures for ensuring that the Sub-contractors of the garment, textile and footwear factories duly comply with the regulations in effect. - Instruct and disseminate information to relevant departments and private sector about the policy of export promotion, national and international laws over unjust labour practices. - Come up with measures for seeking instruction from the leadership of Ministries in order to seek approval from the Royal Government for preventing and eliminating unjust labour practices. - Implement other tasks instructed by the leadership of the Ministries. Article 3: A Secretariat located in the Ministry of Commerce shall be established to assist the commission’s task. 1- H.E Mean Sophea, Advisor to MOC and Director of Trade Preferences Department 2- Mr. Khim Phally, Deputy Director of Trade Preferences Department 3- Mr. Chea Sovanna, Deputy Director of Trade Preferences Department 4- Mr. Sam Seryvutthou, Deputy Director of Trade Preferences Department 5- Mr. Mean Chamnap, Chief Trade Preferences Bureau Chair Member Member Member Member The Secretariat shall have its duties as follows: - Prepare all documents for submitting to the commission for review and decision - Research and compile statistics on garment, textile and footwear factories as well as unregistered Sub-contractors for submitting to the commission for review and decision. - Come up with plan and implement the measures taken by the commission. - Implement various tasks in accordance with the commission’s instruction. Article 4: The commission shall hold a regular meeting in every 3 months and if necessary the meeting shall be held at the request of the Secretariat. Article 5: All provisions contrary to this Inter-ministerial Prakas shall be abrogated. Article 6: All subordinated units under the supervision of the Ministry of Commerce, Ministry of Interior and Ministry of Labour and Vocational Training and as in Article 1 above shall be in charge of implementing this Prakas in an effective way from this date of signing herein.
