INCLUDING THE RIGHT TO SUE

ASSUMPTION OF RISKS, WAIVER OF CLAIMS
AND RELEASE OF LIABILITY
WHEREAS Maynard Enterprises Ltd., Maynard’s Tack Shop Ltd. And Maynard’s Southlands Stables Ltd. (collectively, the
“Companies”) are prepared to allow me to enter on and use their equestrian facilities at Maynard’s Southlands Equestrian
Centre,6767 Balaclava st. Vancouver, British Columbia (the “Facilities”) and participate in lessons, rides and other
equestrian activities (the” Activities”) at Maynard’s Pony Meadows, at Southlands Riding Club (7025 Macdonald Street,
Vancouver, British Columbia V6N 1G2), at Maynard’s Southlands Equestrian Centre, and in the surrounding area of
Vancouver known as Southlands, and/or to keep my horse on these premises;
AND WHEREAS I wish to use the Facilities and participate in the Activities and/or board my horse on the premises;
ASSUMPTION OF RISKS
I ACKNOWLEDGE the hazardous nature of riding horses, saddling and unsaddling horses, grooming
horses and other equestrian activities and I am aware that equestrian activities involve many inherent risks, dangers and
hazards, including but not limited to : ditches, fences, streams, roads and other obstacles; exposed rocks, mud, ice,
trees, bushes and other natural objects; weather conditions; changes or variations in the riding surface 9man-made or
weather-induced), impact or collision with horses or other animals, riders, vehicles or other moving objects; impact with
riding rings, jumps or other equipment used in equestrian activities; and loosening or breaking bridles, lead ropes, halters,
saddles, helmets or other equipment. I know that such risks, dangers and hazards exist whenever and wherever
equestrian activities occur and that many of these risks, dangers and hazards are not obvious or apparent. I am also
aware that horses act unexpectedly at times and there may be negligence on the part of other riders or the staff of the
Companies. I FREELY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF
PERSONAL INJURY, DEATH AND PROPERTY LOSS OR DAMAGE WHICH MAY RESULT THEREFROM.
PARENT ACKNOWLEDGEMENT, WAIVER OF CLAIMS, RELEASE OF LIABILITY AND INDEMNITY
I/We. The parents/guardian of children below listed (“my child”), in consideration of the Companies permitting my child to
enter on the Facilities and participate in the Activities, agree as follows:
1.
I ACKNOWLEDGE that I have read and understood fully the above Assumption of Risks, Release of
Liability and Waiver of Claims and have explained to my child the consequences of signing it;
2.
I WAIVE ALL CLAIMS I have or may in the future have against the releases;
3.
I RELEASE THE RELEASEES from all liability for any loss, damage, injury or expense that I may suffer as
a result of my child coming on or using the Facilities or participating in the Activities due to any cause
whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT AND BREACH OF ANY
STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE
OCCUPIERS LIABILITY ACT, R.S.B.C. 1979, c.303 ON THE PART OF THE RELEASEES;
4.
I WILL HOLD HARMLESS AND INDEMNIFY THE RELEASEES from all liability respecting all claims that
may be brought by my child as a result of my child coming on or using the Facilities or participating in the
Activities, INCLUDING CLAIMS ALLEGING NEGLIGENCE, BREACH OF CONTRACT AND BREACH OF
ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER
THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1979, c.303 ON THE PART OF THE RELEASEES;
