2. SUPPLEMENTARY PLANNING GUIDANCE FOR
TALBOT AND BRUNSWICK INTEGRATED
NEIGHBOURHOOD IMPROVEMENT AREA

Matter for consideration:
1.1
The approval for adoption of Neighbourhood Supplementary Planning Guidance
attached at Appendix 2a for the Talbot and Brunswick Integrated
Neighbourhood Improvement area (TABINI).
Please note that coloured copies of Appendix 2a are attached separately for
Executive Members only and can be viewed on the Council’s internet site or are
available from Democratic Services – telephone 01253 477051.
This guidance describes how policies contained within the new Local Plan
2001-2016 will be interpreted and applied in considering development
proposals within this priority neighbourhood.
Appendix 2b details responses received, and amendments made following a
second period of consultation on the draft guidance. It also reports on the
consideration of objections to Local Plan policies for the Talbot and Brunswick
Integrated Neighbourhood Improvement area that have a potential bearing on
the guidance.
The guidance will have been considered by the Development Control
Committee at its meeting on the 12th June and any comments will be reported
to the Executive meeting.

Recommendation(s):

That the Talbot and Brunswick Integrated Neighbourhood Improvement
Area Neighbourhood Supplementary Planning Guidance be adopted and used
as a material consideration in applications for development in the Talbot and
Brunswick area.
2.
That delegated authority be given to the Acting Head of Planning and
Transportation to undertake necessary revisions to the introductory text entitled
‘Making Integrated Neighbourhood Improvement Happen’ to replace out of date
text and reflect the current situation with regards to the Local Plan.

The guidance is supplementary to the new Local Plan 2001-2016. The policies
contained within the guidance are derived from policies contained within the
Local Plan, particularly policy BH2 (Talbot and Brunswick Priority
Neighbourhood) but give a local interpretation. Having been out to public
consultation, unopposed sections of the guidance have, for some time, been
used as a material consideration in considering applications for development
and the means by which the Council promotes development that would
contribute towards Integrated Neighbourhood Improvement and resists
proposals that would undermining that ambition. Adoption of the guidance will
increase the weight that can be afforded to it by the Council and by Inspectors
at appeal, when considering planning applications.
The Final Draft of the Neighbourhood Planning Guidance along with a
Sustainability Appraisal of the guidance was considered by the Executive on
17th November 2004, and was approved for a further four-week period of
formal consultation. The consultation on the amended Final Draft commenced
on 14th January 2005 and closed on 11th February 2005, where comments
were invited on the changes made to the guidance. Further proposed revisions
to the guidance and its formal adoption have been delayed by the necessity to
take into account proposed modifications to Local Plan policies arising form the
Local Plan Inquiry.
Consultation Responses
The Appendix 2b lists the 8 responses and comments received from the second
round of consultation and sets out the Councils observations on the comments.
None of the responses raised major objections or proposed significant
amendments to the guidance.
Accompanying relevant updates to supporting text, the only revision to
guidance proposed as a result of those representations is as follows:
TAB Area 4 – Devonshire Road Hospital
The proposed re-wording of the guidance at this stage is to clarify the Council’s
position regarding the retention of the ‘architecturally interesting buildings’. The
previous guidance set out advice on acceptable uses and on the form of
development, should the site no longer be required for health purposes. This
has been redrafted to consider that whilst the buildings are not listed, their
retention should be explored, irrespective of the sites future use.
Changes to Local Plan Policies
As mentioned earlier in the report, after this first period of consultation, the new
Local Plan 2001-2016, at Revised Deposit Draft stage underwent a Public
Inquiry, where comments and objections were received and considered by an
Inspector relating to all policies including those which are parent to policies
within the draft Talbot and Brunswick Integrated Neighbourhood Improvement
Area Neighbourhood Supplementary Planning Guidance. The policies or
sections of policies within the guidance affected directly by objections to the
Local Plan were highlighted in the revised draft guidance with a box around the
relevant text (TAB Hsg1 and TAB Shop1).
At the Public Inquiry the Inspector recommended, based on comments or
objections received, minor amendments to policy wording or supporting text of
13 of the 25 policies parent to those in the guidance. The Inspector
recommended more substantial change to one further policy (HN3 - Phasing).
No modifications were proposed to the remaining policies. The Council
accepted all of the Inspectors recommendations relating to these ‘parent’
policies and they were subsequently advertised as ‘Proposed Modifications’ to
the Local Plan for a statutory consultation period of six weeks from 9th
December 2005 to 20th January 2006. Specifically, the Inspector recommended
no change to Local Plan policies HN2 (Site H18 – Caunce Street Sawmills) or
BH14 (Local Centres – Safeguarding Caunce Street Local Shopping Centre) in
relation to objections received. No further amendment is required to these two
areas of guidance (TAB Hsg1 and TAB Shop1) or to any other part of the
Supplementary Planning Guidance as a result of the Inquiry and associated
modifications to the Local Plan. The highlighting of these sections of the
guidance has therefore been removed.

Consultation undertaken:

The TABINI Neighbourhood Supplementary Planning Guidance is the product
of initial consultation with the community during 2002. Consultation has also
taken place with officers in the Development Control team who deal with
planning applications and enforcement action on a daily basis. A four-week
period of formal consultation (alongside the Blackpool Local Plan 2001-2016
Revised Deposit Draft) took place during February/March 2004; amendments
were made in light of responses received. The Final Draft (alongside a
Sustainability Appraisal of the guidance) was subject to a further four-week
formal consultation period during January/February 2005.
