Brimbank City Council July 2015 Rev B 12/50582 REC.LAW.002.5 Page 1 of 5 Guidelines Doorknock Collections City Compliance PO Box 70, Sunshine, 3020 Keilor Office 704B Old Calder Highway Keilor Victoria 3036 T 9249 4000 F 9249 4351 W brimbank.vic.gov.au General Local Law 2008 In accordance with the Brimbank City Council General Local Law 2008 the following guidelines are considered in determining conditions and issuing permits relating to Doorknock Collections. A registered charitable organisation includes local charities, hospitals, churches, community and sporting organisations. 1. Guideline objectives a. Provide a clear indication to registered charitable organisations collecting under what circumstances Council would consider the issuing of a permit b. Ensuring that residents and other persons who wish to make a donation to a registered charitable organisation are able to do so and for that purpose and clearly know who they are donating to 2. Application procedure a. Applications shall be made on the application form associated with this document and all details on the form must be completed b. The application shall then be assessed in accordance with the criteria detailed in these guidelines 3. Guidelines a. Collectors must wear a badge which is easily read by the public indicating whether they are paid workers or unpaid volunteers and show the name of the registered charitable organisation they are collecting for b. Doorknock collections may only be undertaken for registered charitable organisations c. Only one doorknock collection will be permitted in an area at any one time d. The applicant must produce a current public liability insurance policy to the value of $10 million e. The applicant must produce written indemnification of Council against liability for activities authorised by the permit f. Persons collecting must be over 18 years of age g. The applicant must produce a current insurance policy that covers its collectors for any injury that may be caused by the collection activity h. The applicant must comply with any other Act, Regulation or Requirement that is applicable to this activity. This includes compliance with the Fundraising Appeals Act 1998 4. Permit a. i. On assessment of all the criteria specified in this document, Council shall: • Brimbank City Council issue a permit which may include various conditions which are required to be adhered to; or July 2015 Rev B 12/50582 REC.LAW.002.5 Page 2 of 5 • ii. b. refuse the application The holder of any permit shall at all times ensure that the conditions of the permit are adhered to at all times Penalties: i. Any proven contravention of any condition of the permit could result in a maximum penalty of $1,000 being issued and in situations of continued breaches, further permit applications may be refused ii. NOW THIS INDENTURE WITNESSETH that in consideration of the Council granting such authority to conduct a Doorknock collection: at On the following dates In consideration of the Council granting such authority the applicant agrees to take out and keep current during the period of the authority a liability insurance policy insuring, for a minimum sum of ten million dollars ($10 million), the applicant against all actions, costs, claims, charges, expenses and damages which may arise under the indemnity set out below. The applicant agrees to indemnify and keep indemnified the Council, its servants and agents and each of them from and against all actions, costs, claims, charges, expenses, penalties, demands and damages whatsoever which may be brought or made or claimed against them or any of them arising directly from the applicant’s negligent acts, errors or omissions. The applicant’s liability to indemnify the Council shall be reduced proportionately to the extent that any act or omission of the Council, its servants or agents, contributed to the loss or liability. Nothing in this Indemnity shall constitute an agreement by the parties to contact out of their respective liability as determined under the Wrongs Act 1958 (Vic).
