This Cat/kitten (“Cat”) is sold as a pet. Breeder can only give Breeder’s assessment as to the potential
quality of the Cat at the time of the sale and this classification is in no way a guarantee of the ultimate
quality of the Cat.

In the event the Cat is not altered prior to Delivery, Cats sold as pets or alters shall be altered prior to
eight months of age. The only exception to this condition of sale will be written statements from two
licensed veterinarians in unrelated practices that the Cat has a health problem which would make
surgery detrimental to its health, in which case Purchaser shall alter Cat immediately upon the
determination by one of the veterinarians that said Cat has recovered from the health problem. In the
case of a sale of an unaltered Cat which is over eight months of age, Purchaser agrees to alter said Cat
within 60 days of purchase. Failure to meet this requirement is a breach of this contract and
automatically entitles Breeder to repossess the Cat with no refund or reimbursement to Purchaser.
Cats sold as pets will not be shown in competition without written permission of the Breeder.
Breeder will advise Purchaser of what vaccinations or boosters have been given to the Cat and when
they were last given. Purchaser will not give the cat a FIP vaccine. All warranties and indemnifications
are void if the FIP vaccine is given to cat.
This Cat is believed to be healthy (as defined herein) upon Delivery (defined below). Healthy for
purposes of this Agreement means free of contagious viral and bacterial diseases, fungus infections,
and internal parasites. Should the Cat be diagnosed with any contagious disease or ailment described
above within seven days of Delivery, Breeder will reimburse Purchaser for reasonable veterinary
expenses, excluding initial exam costs, as provided below. This warranty is void if Purchaser does not
have the Cat examined by a veterinarian within 2 days of Delivery excluding holidays and Sundays
and/or fails to meet any of the care requirements listed in Section 7. Breeder will not be responsible for
the cost of testing which yields no abnormality on initial examination. Delivery occurs upon the earlier
of Purchaser taking possession of the Cat from Breeder or Breeder placing the Cat with the shipper if
the Cat is being shipped. If the veterinarian feels the Cat was ill prior to Delivery, the Breeder will be
contacted immediately, before any treatment has begun except in emergency situations. Upon
certification from the veterinarian that the Cat was ill prior to Delivery, receipt of a copy of the invoice
detailing the services rendered, and an adequate description of the Cat on whom the services were
performed by the veterinarian, Breeder shall reimburse Purchaser for the reasonable cost of the medical
treatment (“medical expenses”) not to exceed $100.00 or on half of the purchase price of the Cat
whichever is lower if and only if the Cat is retained by Purchaser subject to the limitations contained in
this agreement. Any veterinary expenses owed Purchaser under this section will first be applied to the
purchase price balance remaining on the Cat. If Purchaser should purchase more than one Cat at the
same time, the allowed medical expenses for all Cats purchased may be applied in the aggregate to any
or all of the Cats purchased but the total liability of the Breeder for any or all Cats shall not exceed the
aggregate liability. Breeder has no liability for illness or injury incurred by Buyer, people and other
animals caused by the Cat.
EXCEPT FOR THOSE WARRANTIES AND INDEMNIFICATIONS EXPRESSLY CONTAINED
HEREIN, BREEDER MAKES NO OTHER WARRANTIES, INDEMNIFICATIONS OR
REPRESENTATIONS. IN NO EVENT WILL BREEDER BE LIABLE FOR MORE THAN THE
MONIES RECEIVED FROM PURCHASER UP TO THE PURCHASE PRICE OF THE CAT IF
THE CAT IS RETURNED. BREEDER WILL NOT BE RESPONSIBLE FOR REFUNDING ANY
MONIES PAID OTHER THAN THE PURCHASE PRICE OF THE CAT AS PROVIDED HEREIN.
IN NO EVENT WILL BREEDER BE RESPONSIBLE FOR ANY INJURY OR DAMAGE CAUSED
TO PEOPLE, ANIMALS OR OTHER PROPERTY AQUIRED FROM THE CAT OR RELATING
TO THE CAT. IF BREEDER OFFERS AND PURCHASER ACCEPTS A REPLACEMENT CAT
OR KITTEN, THE REPLACEMENT CAT OR KITTEN SHALL BE PURCHASERS SOLE AND
EXCLUSIVE REMEDY.
The Purchaser agrees to:
(a)
Isolate Cat from other animals in the household for a period of no less than 14 days;
(b)
Feed the Cat in accordance with Breeder guidelines during the first 14 days and gradually
change to another quality food if you wish thereafter (abrupt changes of food can cause
diarrhea or gastrointestinal upset especially during times of stress such as a change in
domicile);
(c)
Give the Cat quality bottled water during the first 14 days and gradually add the water
Cat will drink to the bottled water thereafter until the Cat is accustomed to the new water
(abrupt changes of water can cause diarrhea or gastrointestinal upset especially during
times of stress such as a change in domicile);

Ensure the Cat gets a veterinarian exam on at least a yearly basis and to maintain all
vaccinations;
Ensure Cat gets all reasonable and necessary veterinary attention. If the Purchaser is in
doubt, the Purchaser will contact a veterinarian;
The Cat will not be allowed outside;
The Cat will get a proper diet in the appropriate amounts for the individual Cat and shall
have fresh water at all times;
The Cat will not be declawed without Breeder’s written permission and other possibilities
have been acted upon;
The Cat will receive frequent and kind human attention;
If for reasons other than the Cat’s health you cannot retain ownership of the Cat, the
Breeder may assist Purchaser in finding a new home for the Cat and Breeder will be
given right of first refusal to take the Cat back at no charge;
Purchaser agrees to notify Breeder of any change of address or phone number or in the
event that the Cat becomes lost or dies; and
No Cat from this cattery may be sold or given to an animal shelter, sold or given to a pet
store, abandoned, or sold or given to a laboratory.
8.
Misrepresentation on the part of the Purchaser with regard to any provision of this contract, or the
conditions and lifestyle that this Cat will be provided with are grounds for immediate repossession by
the Breeder, with no refund or reimbursement to the Purchaser.
9. The Breeder reserves the right to cancel this contract without penalty until the time of Delivery. Any
deposit paid will be refunded at the time of cancellation by Breeder pursuant to this Section provided
cancellation is not due to Purchaser’s inability to take Delivery of the Cat within 2 weeks after the
expected Delivery date.
10. The laws of the state of Texas shall govern this Agreement, except for its conflict of laws provisions.
The parties agree and consent to venue and jurisdiction to be the city or county of Breeder’s domicile.
11. This Agreement is the entire agreement of the parties. This Agreement may be changed only upon
mutual agreement by the parties in writing and with a handwritten signature of each party.
