Colonial Athletic Association Processing Level I and II Secondary Violations 1. Develop a written institutional policy to describe the process used to investigate, document, report and monitor all self-reports. Include this information in Compliance Manuals and Student-Athlete Handbooks as appropriate. 2. When a secondary violation is discovered and the institution is preparing the report for the CAA and/or NCAA it is important that you always check the NCAA Secondary Infractions website to determine whether the violation is a Level I or Level II, and to apply the prescribed Level II penalties. It can also be beneficial to search for similar Secondary Violation cases on LSDBi and read the institutional and enforcement penalties that were prescribed. The CAA can assist in this process upon request. To access the Level I and Level II Secondary Violations website from LSDBi go to: LSDBi > Resources > Enforcement/AGA > Secondary Infractions To access the Level I and Level II Secondary Violations website from www.ncaa.org and select “Member Login” then go to: Governance > Compliance & Waivers & Reinstatement > Secondary Infractions > Division I (Level I or II) 3. The CAA Secondary Violation Reporting Process. A. Level I: - SAR required. If the Level I violation affects the eligibility of any prospective or enrolled student-athletes and the institution is seeking reinstatement of eligibility then the violation must be submitted directly to the NCAA via AMA Online Case Management System. - SAR not required. If the Level I violation is considered "de minimis," eligibility is not affected and you do not have to declare the involved prospective or enrolled student-athlete ineligible, or request reinstatement of eligibility. You do, however, need to report the violation to the enforcement staff. If the violation is considered a "restitution" violation, eligibility can be immediately reinstated upon the value of the benefit received being donated to a charity, if that value is $100 or less. In that case you do not have to request reinstatement. However, the prospective or enrolled student-athlete is not eligible to compete until restitution is made. Further, you still need to report the violation to the enforcement staff, and your report should include documentation of repayment. Submit these Level I reports directly to Chris Strobel at cstrobel@ncaa.org using the CAA Level I & II Reporting Form or the NCAA Level I Reporting Form. B. Level II: If the violation is on the Level II violation list then submit the violation via email in Microsoft WORD format to Kathleen Batterson at the CAA (kbatterson@caasports.com). Any supporting documentation (e.g., letters of admonishment, receipts showing repayment or donation to charity) should be emailed to kbatterson@caasports.com or faxed to the CAA at 804.754.1973. The conference office will communicate with the institution and indicate whether or not the institutional actions/penalties assessed for Level II Secondary Violations are appropriate. 5. On a quarterly basis, the conference office is required to submit to the NCAA a summary report listing all Level II Secondary Violations. Therefore, we would appreciate it if you would submit Level II Secondary Violation reports and required documentation at your earliest convenience.
