XPTViewer User License Agreement I. Grant of License XPTViewer and documentation (“Software”) is a Freeware. You can download and use the Software binary executable free of charge provided you accept all the terms contained in this License Agreement. You can use Software for non-commercial and/or commercial purposes. II. Copyright Software is owned by Ephir, Inc. (Ephir) and is protected by copyright laws. No title, or ownership, of this freeware is transferred to you. You may not remove any copyright notice from the Materials. III. Distribution Rights You may distribute Software, only in its original binary format and without modification, to other individuals and organizations. Software must be distributed freely and you may not profit from the distribution of Software. Individuals, download sites, ISPs (Internet Service Providers), and other organizations may distribute Software via CDs, email, web sites, ftp sites, forums, newsgroups, etc., but only in its original binary format and without modification. Without the written consent of the author, Ephir, you may not distribute Software with any form of printed publication (e.g. books, magazines, manuals, etc.). IV. Other Restrictions You may not rent, lease, lend, sell, or sublicense Software. You may not modify, decompile, disassemble, or reverse engineer Software. You may not incorporate Software into another software program. You may not distribute Software for profit. V. Warranty Ephir, the developer of Software, expressly disclaims any warranty for this Freeware. ("Ephir") is willing to license the accompanying software programs CS2XPT and XPT2CSV and documentation ("Software") to you (“Customer”). If you do not agree to these terms, you should immediately delete all copies of the Software you have in any form. I. Grant of License Ephir grants Customer the non-exclusive, non-transferable limited right and license to use of this Software. All rights not specifically granted under this Agreement are reserved by Ephir. This Software is licensed, not sold. Your license confers no title or ownership in this Software and should not be construed as a sale of any rights in this Software. II. Copyright Software is owned by Ephir and is protected by copyright laws. No title, or ownership, of this Software is transferred to you. You will not remove any copyright notice from the Materials. You agree to prevent unauthorized copying of the Materials. III. Use of Software The Software may be used by the number of users and the class of computer hardware for which the corresponding fee has been paid. U.S. Government Restricted Rights If Software is being acquired by or on behalf of the U.S. Government or by a U.S. Government prime contractor or subcontractor (at any tier), then the Government's rights in Software and accompanying documentation will be only as set forth in this Agreement; this is in accordance with 48 CFR 227.7201 through 227.7202-4 (for Department of Defense (DOD) acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD acquisitions). VIII. Miscellaneous VIII.1. Customer is not permitted to transfer or assign Customer rights and duties arising from this license agreement to a third party. VIII.2. Any action related to this Agreement will be governed by Massachusetts law and controlling U.S. federal law. VIII.3. If for any reason a court of competent jurisdiction finds any provision or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect. ("Ephir") is willing to license the accompanying .Net SASXport Library in binary format, Sample Source and documentation ("Software") to you (“Customer”).
