HERALD SUN VB POP-UP PUB PROMOTION
TERMS AND CONDITIONS.
By entering the Herald Sun VB Pop-Up Pub Promotion, you are agreeing to the following
terms and conditions:
1) STANDARD TERMS
a) Information on how to enter forms part of the terms of entry.
2) WHO CAN ENTER
a) Entry is only open to all residents of Victoria 18 years or over.
b) Employees and their immediate families of News Limited, and their associated
agencies and companies are not eligible to enter. Immediate family means any of
the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by
natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle,
aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3) HOW TO ENTER
a) The competition commences on Thursday January 14, 2010 at 12.01am (AEDST)
and concludes on Wednesday January 20, 2010 11:59pm (AEDST) (“the
Competition Period”).
b) In order to enter the competition entrants must subscribe to the free News Limited
e-newsletter in their state of residence, by providing the entrant’s name, email
address, age and In 25 words or less entrants must describe why they should win a
Pop-Up Pub.
c) Entry is available at heraldsun.com.au/vb
d) Entry is only open to residents of Victoria.
e) Entrants (including winners) in the competition may enter once only.
f)
The time of entry will in each case be the time the online message is received by eServices.
4) PRIZES
a) There is one prize pack to be won as set out below:




A VB Pop-Up Pub
Mini LCD TV
A steel- belted cooler Coleman cooler
A VB Mini Bar Fridge
b) The total prize pool is worth $6000.
c) The prize is not transferable, exchangeable or redeemable for cash. In the event of
that any prize item is unavailable, The Herald & Weekly Times reserves the right to
substitute a prize item of equal or greater value. Any taxes (other than GST, if any)
which may be payable as a consequence of a winner receiving the prize are the
sole responsibility of the winner.
5) HOW TO WIN
a) Each entrant who has entered the competition over the Competition Period and
registered all details in accordance with clause 3 will be entered into the prize
draws. The winner will be judged at The Herald & Weekly Times 40 City Road,
Southbank on Thursday January 21, 2010 at 10:00am (AEDST).
b) The entry that is judged by a panel of The Herald and Weekly Times Pty Ltd
employees to be the most creative will win the prize.
c) The winner will be notified by phone within 3 days of the judging and a letter
advising winners of their prize will also be mailed out and their name published in
the Public Notices section of The Herald Sun on Friday January 29, 2010.
d) The Promoter’s decision is final and the Promoter will not enter into
correspondence regarding the result.
e) It is a condition of accepting the prize that the winners may be required to sign a
legal release in a form determined by the promoters in its absolute discretion.
f)
An unclaimed prize judging will take place at The Herald and Weekly Times, 40 City
Road on Monday February 14, 2010 at 10:00am (AEDST) and winners will be
published in the Public Notices section of Herald Sun on Tuesday February 15,
2010.
6) NO LIABILITY
a) In the case of the intervention of any outside act, agent or event which prevents or
significantly hinders the Promoter’s ability to proceed with the competition on the
dates and in the manner described in these terms and conditions, including but not
limited to vandalism, power failures, tempests, natural disasters, acts of God, civil
unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion
cancel the competition and recommence it from the start on the same conditions,
subject to State Legislation.
b) The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged
consumers are advised to consider the safe drinking levels recommended in the
National Health and Medical Research Council Australian Guidelines to Reduce
Health Risks from Drinking Alcohol. A full version of these guidelines are available

c) The Herald & Weekly Times and Foster’s Australia Ltd and their associated
agencies and companies will take no responsibility for prizes damaged or lost in
transit, or late, lost or misdirected mail.
d) The Herald & Weekly Times and Foster’s Australia Ltd and their associated
agencies and companies will not be liable for any misadventure, accident, injury,
loss (including but not limited to consequential loss) or claim that may occur:

during the draw;

in the participation in any prize;

as a consequence of late, lost or misdirected mail;

in relation to failure of an online entry message to be received by the
promoter on account of technical problems or traffic congestion;

arising from or related to any problem or technical malfunction of any
telephone network or lines or mobile communications network related
to or resulting from participation in this promotion;

due to circumstances outside the Promoter’s reasonable control.
e) The Herald & Weekly Times and its affiliates assume no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorised access to, or
alteration of, entries, and reserves the right to take any action that may be
available.
f)
If, for any reason, this competition is not capable of being conducted as planned,
including, but not limited, due to tampering, unauthorised intervention, fraud,
technical failures or any other causes beyond the control of the Promoter which
corrupt or affect the administration security, fairness, integrity or proper conduct of
this competition, the Promoter reserves the right, in its sole discretion, to disqualify
any individual who tampers with the entry process, take any action that may be
available, and to cancel, terminate, modify or suspend the competition, subject to
State Legislation.
7) PROMOTER’S DETAILS
a) The Promoter is The Herald & Weekly Times Pty Ltd (ABN 49 004 113 937) of 40 City
Road, Southbank VIC 3006.
b) Entry details remain the property of the Promoter, The Herald and Weekly Times Pty
Ltd and its related entities. The promoter is collecting the entrant's personal
information for the purpose of conducting and promoting this competition (including
but not limited to determining and notifying winners). The entrant may request access
to his or her personal information e-mailing privacy.officer@adv.newsltd.com.au
