ACTIVITIES OF MATTHEW J. PETROVICH, GUARDIAN AD LITEM, 9TH MINNESOTA JUDICIAL DISTRICT Matthew J. Petrovich, guardian ad litem, 9th Minnesota Judicial District, is assigned to Case Number 60-FA-13-468 (HOLMSETH VS CALLAHAN). Petrovich’s statements, expressed interests, actions, and activities upon entering the case indicate he possessed considerable knowledge regarding my work as a journalist and author as it relates to the missing child HaLeigh Cummings. During Petrovich’s first interview with me in my home, he already possessed detailed knowledge about the activities of individuals that were actively cyber-stalking me, harassing me by telephone, and involving themselves in matters regarding my children. Petrovich knew the names of specific individuals that had telephoned me and threatened me regarding my children. He used the names of specific individuals that all claimed to be in contact with my son’s mother, Rhonda Callahan, Manvel, North Dakota. Petrovich proactively addressed the issue of the online harassment and phone calls, and immediately told me, “I don’t care”. He stated that the issues related to harassment against me, stemming from my work on the HaLeigh Cummings case as a journalist, were not relevant to his job or immediate goals regarding parenting-time and coparenting. Petrovich stated his only focus was to find a way for my son’s mother and me to coparent our son in a way that was sustainable. Petrovich’s subsequent actions and activities, however, completely conflicted with his professed indifference to matters regarding the HaLeigh Cummings case. His actions and interests, actually, strongly suggested that he was very interested, if not very preoccupied, with my profession as a journalist, author, and publisher. Petrovich actively monitors my website and emails me comments after doing so. Each time he contacts me about the content he makes ominous commentary about me as a parent, and suggests I am not going to look good in his recommendations to the Court regarding child custody issues. Petrovich’s activities can easily be recognized as being ‘Timothy Holmseth-focused’ as opposed to ‘child-focused’. While Petrovich presents himself as being concerned for the minor child, his actions seldom benefit the minor child in any way. Rather, Petrovich’s actions invariably create questions about the parental competence or mental health of “Timothy Holmseth”. Petrovich’s negative opinion of me has received no support from an entire community of medical providers, psychologist, psychiatrist, play therapist, nutritionist, social workers, teachers, and any other mandated reporters. Petrovich’s actions and activities streamline perfectly, and seem to provide support to the well-documented barrage of telephonic and online threats made by out-of-state individuals that claimed to have the ability to revoke, change, or alter my parental rights through the State of Minnesota. The activities of Petrovich, collectively assessed, strongly indicate he entered the case with plans to conduct an un-authorized and/or un-official investigation of Timothy Holmseth, designed to manufacture a bogus child-abuse finding. The following actions of Matthew J. Petrovich, guardian ad litem, 9th Minnesota Judicial District, should be closely examined by state and/or federal investigators: 1. Matthew Petrovich refused to arrange for supervised visits for me, to re-establish parental contact between my son and me, while an investigation of Respondent’s (false) child-abuse allegations were investigated. Petrovich’s refusal to arrange the supervised visits was in direct violation of a Court Order by Judge Donna K. Dixon, instructing him to do it. This arrogant action by Petrovich immediately upon entering the case in November of 2012 is the first sign he had an (un-official/improper) agenda adversarial to, specifically, me. 2. Petrovich recommended to the Court in his first Guardian Report that I be ordered to submit to a psychological evaluation, but did not make the same recommendation for the other Party, Rhonda Callahan. This action by Petrovich is the second indication he had an (unofficial/improper) agenda adversarial to, specifically, me. 3. Petrovich advised me that just because the CPS investigation found no child abuse doesn’t mean it didn’t happen. The findings by Grand Forks County CPS were so completely against the notion that abuse had occurred, that the entire 9-person team of esteemed professionals signed off on the Affidavit “No Services Required Or Recommended – No Risk Factors For Abuse” – not one checkbox in the ‘concern’ column had been marked. Petrovich continued to obnoxiously entertain Rhonda Callahan’s false child-abuse claims, long after CPS cleared the case, while blatantly ignoring the audio recordings of out-of-state individuals, that claimed to communicate with Rhonda Callahan, and predicted child-abuse claims would be brought, in advance, as well as made threats to have my children taken away by “CPS” and “State’s Attorneys”. 4. Petrovich repeatedly suggested/hinted I should respond to text messages from Rhonda Callahan (if the text messages were about REDACTED) despite an NCO (this would be a violation of Minnesota law on my part). When I refused to violate the NCO, Petrovich reported to the Court in his official report that I was making communication with my son’s mother nearly “impossible”. Through this malicious act, I was actually chastised by Petrovich for obeying the law. Such a statement by a GAL to the Court is diabolical and insidious. 5. Petrovich insisted REDACTED (6 years-old at the time) have a cell phone at all times to call him (Matt Petrovich) – thus creating the outward appearance of safety issues (that did not even exist) and causing the child to believe he was not safe with his father. This extremely improper action by Petrovich is the third strong sign he had an (un-official/improper) agenda that targeted, specifically, me. 6. Petrovich neglected to report to the Court in his Guardian’s Report, concerns that were conveyed to him by REDACTED’s play therapist, Kathy Colley, about parental alienation – “This child is not in a safe environment to develop a healthy relationship with his father” – Kathy Colley MSW, LICSW This action to deliberately withhold such valuable child-focused information from the Court establishes a pattern by Petrovich that cannot be explained away. 7. Petrovich made a report to Polk County Social Services (PCSS) that REDACTED made suicidal statement while with me – PCSS would not even act upon the ridiculous report – it was nothing short of a ridiculous lie. 8. Petrovich stated he had no concerns about Respondent lying in her Parental Capacity Evaluation, saying that if she did lie, she lied about things that occurred a very long time ago so it wasn’t relevant. 9. Petrovich misrepresented his actual authority and tried to suspend my parentingtime without a court order. In this instance, my son came to school, after sleeping at his mother’s house, and the school principal found a bed-bug on his sock. Based upon this, Petrovich sought to suspend my parenting-time. Petrovich’s action against me, of course, is malicious and obviously illogical and backwards. 10. Petrovich misrepresented his actual authority and tried to make me accept a downward modification of parenting-time in the summer of 2013. This action by Petrovich and Rhonda Callahan was to create time for Michael Callahan to be with REDACTED. Callahan is a non-Party, nonparent, ex-husband of Rhonda Callahan with no legal standing regarding the child. Callahan later came to my residence, threatened to kill me, and warned me I’d be found dead if I filed this Motion. Other Concerns: Play Therapist Kathy Colley MSW, LICSW advised Play Therapist Kristy Cavalli MSW, LICSW during a documented meeting, that in her entire career, she had never seen a case where the guardian ad litem was so deeply active and involved with a family, when the child was safe in both homes. Matt Petrovich ‘volunteered’ his coordination services to Court when the need for a go-between was created by a (very questionable) NCO filed by Rhonda Callahan. He seems almost eager to be involved. Rhonda Callahan has filed several motions and requests to the Court to have Matt Petrovich’s authority expanded. She told the Court she wanted Petrovich to be able to revoke my parenting-time without a hearing (something he has tried to do repeatedly). Petrovich monitors my businesses website and comments on it to me in emails.
