Early Booking Contract

This is a special breeding offer and must be returned signed with booking fee no later than December 31, 2011.
Fees: Mare owner agrees to breed stated mare to stallion identified above for the 2012 season. The stallion service fee is $800.00 which
includes the first collection/shipping and a non-refundable booking fee of $200.00 payable with this contract. If additional shipments are
needed the fee will be $300.00 per shipment and will include two (2) syringes. Payment plans are available and all fees must be paid in full
prior to requesting shipment unless other arrangements have been made prior to semen request.
Season: Breeding season begins March 1, 2012 and ends July 31, 2012. Contact us for alternate date consideration.
Container: The Flying Moose will use a disposable, equine approved shipping container unless the mare owner chooses to use his/her own
container provided it meets shipping requirements and the mare owner agrees to label the container and all of its parts. If using your own
container, it will be the mare owner’s responsibility to ensure the container is delivered to the collection facility at least 7 days prior to
requesting semen shipment. Stallion owner is not responsible for damaged or lost containers ______ (initial).
Semen Ordering: In order for semen request, collection and shipping to go smoothly, please adhere to the following: (1) if breeding mare
during foal heat, notify The Flying Moose via email of the foal’s birth or (2) if mare is not currently in foal, notify The Flying Moose via
email status of initial ultrasound. The Flying Moose understands the complexities of breeding and will make adjustment on a case by case
method. Shipments will be delivered to the address indicated on the last page of this contract unless mare owner/rep notifies stallion owner
of a different shipping location.
Request for shipment must be made no later than 5pm (cst) the day prior to shipping. Example, if a collection is needed for
insemination on Thursday, the request is due by 5pm on Tuesday. Cancellations must be made no later than 10:00am (cst) on day
of collection. Mare owner/rep understands the difficulties of stallion collection coordination and understands that stallion owner
will make every attempt to schedule your collection in a timely manner.
Mares on site for local AI have first priority of available semen. Shipped semen is first requested, first shipped.
Semen Handling: Mare owner is responsible for breeding mare and must comply with breed registry requirements. Mare owner agrees to
use a licensed equine veterinarian or mare management facility that is qualified and experienced in the use and handling of cooled shipped
semen to inseminate the mare. Mare owner agrees to use all semen for stated mare in this contract and no other. Mare owner agrees to
notify stallion manager if semen arrives in poor condition or if container has been tampered with or damaged.
Mare Owner Responsibilities: Mare owner is responsible for (1) mare to be healthy, free of infection; (2) in breeding sound condition; (3)
timely delivery of mare to AI facility; (4) all fees incurred at facility directly related to mare insemination to include board, examinations(s),
medication(s), and AI procedure. Person signing this contract is the recorded mare owner or authorized agent of the mare named above.
Return Breeding: The Flying Moose guarantees a live foal only if mare is (1) examined by a licensed equine veterinarian and (2) is
determined to be in foal by licensed equine veterinarian and (3) mare owner notifies The Flying Moose via email of pregnancy status at 16
days and again at 90 days. Non compliance may result in the loss of the option to re-breed and forfeiture of all monies paid.
Should the mare abort or the foal is stillborn, the mare owner must contact The Flying Moose within 48 hours of death and a veterinarian’s
certificate must be received within 10 days. The mare owner has the option of breeding the same mare the following season to the same
stallion without stallion fees incurred but mare owner/rep will be responsible for shipping fees. The Flying Moose reserves the right to
decline a re-breed and refund the stallion service fee less the booking fee to the mare owner/rep. Live Foal Guarantee is void if mare is
shipped in foal outside of the continental united states.
Warranty: Stallion manager make no warranty or guarantee that stallion will be available for collection within a certain time period.
Mare owner understands that stallion semen is available on a first-come, first served basis. While every effort will be made to AI mare with
viable semen, the stallion manager makes no guarantee that the semen will safely reach the insemination point without losing integrity,
quality or characteristics. Stallion manger/owner is not responsible for lost, stolen or damaged containers.
Guarantee: Stallion owner guarantees foal from resulting insemination will not be Sorrel, Chestnut, Bay or Black. If such color should
arise, stallion owner agree to re-breed the contracted mare with no stallion fees incurred but does not include shipping fees.
Liability: Mare owner agrees to diligently try to settle mare. If, however, mare fails to settle, mare owner agrees to hold harmless and
release stallion owner and affiliated persons. Mare owner agrees stallion owner and affiliated persons shall not be responsible for any
disease, injury, death or accident to the mare and/or foal.
Certificates and Substitutions: Breeder’s certificates will be issued when The Flying Moose has been notified that stated mare has foaled
and all bills incurred by mare owner have been paid. Mare owner is solely responsible for seeking registration of the resulting foal. If mare
dies or becomes unfit for breeding, the mare owner my use a re-breed the following season with an approved substitute mare under the
same conditions stated in this contract. The Flying Moose reserves the right to refuse any substitution.
Miscellaneous: This contract is non-assignable and non-transferable. Mare owner acknowledges that should the stallion die or become
unfit for service after the mare is pronounced in foal, the stallion owner shall not be in breach of this contract and is released from all
further responsibility. Mare owner further agrees that should stallion die or become permanently unfit for service prior to mare being
inseminated, any monies paid toward stallion fee (less booking fee of $200) shall be refunded to the mare owner/rep.
