TOWN OF CROSS PLAINS BOARD OF SUPERVISORS MONTHLY MEETING JULY 2013 The Board of Supervisors of the Town of Cross Plains held their regular monthly meeting on Monday, July 8, 2013 in the Community Center, 3734 County Road P, Cross Plains. Notice of the meeting was published in the July 3, 2013 issues of the Mt Horeb Mail and the News-Sickle-Arrow. The agenda was amended and posted at the Community Center, the Town Garage and at Morgan’s on July 2, 2013. Board Members Greg Hyer, Vera Riley, Jeff Baylis, Greg Haack, Tom Anderson, Town Treasurer Bonnie Krattiger and about 13 citizens were present for the monthly meeting. The meeting was called to order at 7:32 by Chairman Greg Hyer. Greg Hyer led the pledge of allegiance to our flag. Greg Hyer requested a change in the order of posted agenda items to accommodate citizens who are attending for specific issues. Approval of the Minutes of the June 10, 2013 Town Board Meeting. Minutes of the June 10, 2013 meeting were reviewed. Motion to approve the minutes as presented was made by Tom Anderson, second by Greg Haack. All Board Members approved. Motion carried. Review of Financial Report and Action on Payment of Bills. Motion to accept the June 30 Financial Statement was made by Jeff Baylis, second by Greg Haack. All Board Members approved the motion. Motion carried. The list of invoices for July payment was reviewed. Motion to approve payments totaling $50,201.60 was made by Jeff Baylis, second by Tom Anderson. All Board Members approved. Motion carried. Chair/Clerk Announcements – Clerk-None Chair: The DOT meeting at the Community Center scheduled for July 17 on the Hwy 14/Stagecoach Road intersection has been cancelled and will reschedule in the fall. The invoice to Boehnen is for Timber Lane washout repair. Jeff Baylis indicated another washout on Mineral Point with all these rains. Braun Road 2 will need some repair also. There is a hole developing on Union Valley Road. This is a cattle crossing that needs repair. Patrolman, Rick Hollfelder, will be adding a steel plate on the road for safety. The Plan Commission meeting in August will be looking at the County doing a mass rezoning. The State will no longer use Ag exclusive zoning as category anymore for several categories of parcels. Since we have the TDR we will be doing a blanket overlay on some properties to create sending areas. There are 3 old oak trees on Old Military Road are in the right of way that need to come down. Patrolman, Rick Hollfelder, knows someone who is willing to take them down. He will make sure they have liability insurance. David Shaw, Clerk/Treasurer from Middleton informed the Town they are doing some mapping at the Airport Road and Enchanted Valley intersection. It maybe something we will want to change in our land use plan. Middleton is reacting to the Village of Cross Plains map. The barriers to protect the sand runoff at the garage would be 12 feet minimum 16 feet max. We would need about 6 blocks. 1 Public Participation for Three Minutes on Any Item. Mike Pfrang spoke on the Hwy 14 meeting that the DOT was going to have. Between the time he announced it to the neighborhood and the meeting was cancelled, neighbors sent emails to me with comments for DOT. A list of those emails were given to the Board. Jeff Baylis indicated he will not be here for the August meeting. Action on Driveway Permit for Lot 1 of CSM 12785 at the SW intersection of W. Mineral Point and Garfoot Roads. Motion was made by Jeff Baylis and seconded by Greg Haack to give permission for a driveway access for Lot 1 of CSM 12785 at the SW intersection of W. Mineral Point and Garfoot Roads from lot line to about 100 feet west. Owners will need to come back with all site and drive construction details of the driveway permit. All Board Members approved. Motion carried. Action on cancelling membership in the Dane County Town's Association. Jeff Baylis gave some background on the Dane County and Wisconsin Town’s Association. There is concern as to whether procedures are being followed properly with Dane County Town’s Association (DCTA) and whether they are listening to Townships about by-laws needing to be changed as to procedures. There is also a concern of items being voted on at meetings that have not been noticed to members. Motion was made by Jeff Baylis and seconded by Tom Anderson to cancel membership in the Dane County Town's Association. Jeff Baylis is asking for the remainder of our dues back. Vera Riley asked if there is something that would not allow payment of dues back. Mark Hazelbaker gave background for the Town’s Association. DCTA does look for ways to do what is in the best interest of all members. It does not mean everyone is satisfied. Tim Roehl, executive on the DCTA Board hopes that the motion fails as he thinks DCTA provides a valuable service. If you want to see a change, you have to be part of the solution. An unwillingness to change is not true. Issue with CARPC and the BPP it is difficult to get a quorum. DCTA has taken votes on items not noticed due to this difficulty. Communication may be the problem. Recent areas of involvement for townships that DCTA has had success with are the RTA and the shore land zoning with regards to Dane Co. Water Quality and Appendix I. Jim Pulvermacher is the Town’s representative. He indicated communication has been a problem and DCTA has hired Renee to help with communication. DCTA annual budget is about $50,000. All Board members voted against the motion. Motion failed. Discussion on South Rocky Dell Road abandonment (Wagner Driveway) Update: We can abandon this road. The process to abandon a road is fairly easy. However, the way the town accepted this road has made it harder. The problem is the minutes say what the Town of Cross Plains wanted was not what was done. There is an easement on this property. If the Town abandons the road, the County indicated we need to do a CSM. The Town of Cross Plains will need the consent on the adjacent property owners, also. The Town of Cross Plains also has the ability to use special assessment to do the improvement. Greg Hyer will draft a letter to the owners of the home and land to start the 2 process to abandon the road or to improve the bridge with owners paying for the improvement through special assessment if there is no objection. Board members did not object. Action on Appointment of parks commission member. Motion was made by Tom Anderson and seconded by Jeff Baylis to approve Paul Correll as a member of the parks commission for the next 7 years. He will replace Gerry Schultz. All Board Members approved. Motion carried. Action on authorizing funds to repair town hall. Motion was made by Jeff Baylis and seconded by Tom Anderson to approve the funds in the amount of $11,000 to repair town hall. All Board Members approved. Motion carried. Action on Intergovernmental Agreement between Dane County and Town of Cross Plains for purchase of New Election Equipment and Software. Motion was made by Jeff Baylis and seconded by Vera Riley to approve the Intergovernmental Agreement between Dane County and Town of Cross Plains for purchase of New Election Equipment and Software with 3 equal installments. All Board Members approved. Motion carried. Action on Resolution for Inclusion under the State of Wisconsin Deferred Compensation Program. Motion was made by Jeff Baylis and seconded by Vera Riley to approve the Resolution for Inclusion under the State of Wisconsin Deferred Compensation Program. All Board Members approved. Motion carried. Action for a Conditional Use Ordinance, and the removal of a moratorium on wind turbines. Motion was made by Jeff Baylis and seconded by Vera Riley to approve the Conditional Use Ordinance, and the removal of a moratorium on wind turbines. Greg Hyer provided a substitute motion to refer to legal counsel and bring it back before the Board at the September meeting. Jeff Baylis seconded. All Board Members approved the substitute motion. Motion carried. Action on Budget Timeline for 2014. Treasurer, Bonnie Krattiger, went through the time line for preparing the budget. In general Committees should submit budget items for the next year to the clerk by the end of July. Job performance reviews to be performed by the end of August. A rough draft of budget will be put together in early September and presented at the September meeting with approving an rate increases. Adjustments will be presented in October for approval of budget to be presented at the Town Public Hearing. Discussion on Town of Cross Plains loans and payoff schedules. Treasurer, Bonnie Krattiger, indicated in looking at the loan payoff schedules and using the extra debt payment to the various loans, the loans that exist to date should be paid off in 2019.
