Confidentiality is a right covered legally under the Data Protection Act 2003 to protect personal details of a client. 4.3 – Describe the potential tension between maintaining an individual’s confidentiality and disclosing concerns The conflict between maintaining an individual’s confidentiality and disclosing concerns can cause a dilemma in the workplace. Client confidentiality must be respected and private matters should never be discussed with collegues or managers without client permission, unless you have concerns about client safety and welfare. We have a duty of care to the client so in certain circumstances we must balance the risk between this duty and breaking confidentiality. Examples of this might be if we are concerned about client causing significant harm to themselves or others, if client gives you information that they are at risk of abuse, or if you are at risk yourself because of violant or aggressive behaviour. Breaking confidentiality is a very difficult decision to make but the well being and safety of the client should always be uppermost in deciding what to do.
