Queen Palm Bengal Cattery
This agreement is for the Bengal cat/kitten described below between the
seller: Queen Palm and the purchaser: _____________ for the agreed
sales price of _________
A balance of $______ has been received from the above purchaser as a
final payment for the purchase of the cat/kitten described below
received on this day____ of_____, 2015.

This kitten is purchased for: Breeding____ Showing____ Pet_____
Deposit: On this day ____ of _____, 2015, a balance of _____ has been
received from the above purchaser as a final non-refundable payment to hold
the cat/kitten described above. This deposit is applied towards the final
purchase price, which is due on or before the day the kitten/cat is collected.
In event the purchaser is unable to purchase the above kitten, the seller will
make no refund but will credit the purchaser with the deposit towards the
purchase of a future kitten. This credit must be used within 12 months or it
will be invalidated.
72-hour health guarantee:
This cat/ kitten will come with a Florida State Health Certificate stating it is
in sound health upon arrival. It is the buyer’s responsibility to have this
cat/kitten examined by a licensed veterinarian within 72 hours of purchase
for a routine health exam at the buyer’s expense. If this cat/kitten has an
existing condition that is untreatable or a life-threating problem it must be
reported to the seller immediately along with a veterinarians written
explanation of the problem. Upon its return, it will be replaced with another
cat/kitten of equal or greater value as soon as one is available. No cash
refunds. This cat/kitten cannot be returned after the 72-hour health guarantee
has expired and/or has been exposed to another cat/kitten. The Seller is not
responsible for expenses or obligated to take the cat/kitten back or replace it
after the 72-hour health guarantee has expired. It is the responsibility of the
buyer to provide immediate veterinary care to any cat/kitten showing signs
of illness or distress.
One-year guarantee:
This cat/kitten is guaranteed against life threatening congenital defects for
one year. Should the cat/kitten die or be diagnosed with a congenital defect,
Buyer must submit medical documentation of all findings to the breeder.
The cat/kitten will only be replaced if an appropriate necropsy is performed,
by a licensed veterinarian and a vets certificate is provided as proof. A
replacement will be made of a cat of similar quality and value, as available,
at the discretion of the breeder. Under no circumstances is the cat/kitten to
be destroyed prior to notification by the Buyer to the Seller. All expenses
incurred are the sole responsibility of the buyer. Breeder has the right to ask
for the cat/kitten to be returned before the Buyer receives a replacement. If
the buyer refuses offered replacement the Breeder will have no further
obligation to the Buyer.
Terms and Conditions:
1. All sales are final. No refunds, no returns, and no exchanges unless
outlined by the terms of this agreement.
2. This cat/kitten will be kept indoors only. The Buyer agrees to keep
the cat/kitten in a clean, pleasant environment. The cat/kitten will have
proper nutrition, health care, and companionship. If this cat/kitten is
found to be neglected, abused, or malnourished in any way, Buyer will
surrender said cat/kitten to Seller, unconditionally.
3. Cat/kitten cannot be resold, put in an animal shelter, given away,
leased, loaned, rented, or abandoned. If Buyer cannot take care of this
cat/kitten the Buyer must first offer the cat/kitten to Queen Palm
cattery and Queen Palm cattery regains full rights to ownership and the
cat/kitten is returned without protest. Before the cat/kitten is returned
the Buyer must have the cat/kitten Fiv/Felv testing at Buyers expense.
4. This cat/kitten will never be de-clawed or de-meowed.
5. Buyer agrees if any legal action needs to be taken that all legal fees
will be Purchaser’s responsibility for both parties and it will be held in
the Seller’s current state/county of residence.
6. Buyer agrees to never vaccinate this cat/kitten for FIP or FIV.
Failure to comply will void all health guarantees.
7. This cat/kitten will always be identified by its full registered names on
any website and/or advertisement.
8. If this cat/kitten is purchased as a pet the Buyer agrees to
castrate/spay this kitten by the day the kitten turns 6 months old. If
found to have not complied, the cat will be surrendered, and a fine of
$1,500 will be imposed.
9. Buyer agrees to INSIST that their vet not use Ketamine as an
anesthetic for any procedure. If the vet is unwilling to do so, Buyer must
find another vet to perform procedure. Failure to do so will void all
health guarantees.
10. Buyer agrees to keep the cat/kitten separated from other household
pets for a minimum of one week.
Breeder Addendum:
1. Buyer agrees to spay female breeder cat no later than age six years.
At this time the cat is to be petted out.
2. Fertility is guaranteed, but if the cat/kitten is reported to be sterile
by a medical examination from a licensed veterinarian it must be
castrated/spayed. With a receipt of the medical report attesting the
infertility and with the certificate of spay/neuter the Seller will
replace the cat with another kitten of greater/equal value within a
reasonable amount of time.
3. (Males) Fertility is guaranteed, provided female kittens are on-site. If
two years have passed and the male has had three proven breeding
queens during estrus, seller will have the opportunity to breed him to
one of her breeding queens. If the cat is found to be infertile the male
must be neutered and the Buyer will receive a replacement cat/kitten
of greater/equal value within a reasonable amount of time.
4. No refunds will be given for infertility.
This contract is legally binding on the buyer(s) and seller in this transaction and is nontransferable to other parties. This contract shall remain in force throughout the life of the
kitten. Signing indicates agreement to this contract. Breach of contract will result in
cancellation and repossession of the cat/kitten by the Seller without compensation.
Jurisdiction of this contact. Jurisdiction of this contract will ne he municipality of the
Sellers residence at the time of dispute. Buyer shall be liable to Breeder for any and all
legal fees incurred in the enforcement of this contract.
