Any student may request a Judicial Advocate at any point. Judicial Advocates are responsible for
assisting those who ask for counsel for their hearings in front of the Judicial Court. Judicial
Advocates serve at the discretion of their assigned party. They may provide advice and support
throughout the appeals process as well as present arguments before the Court if needed.

To get a better idea of the case at hand, please answer the following inquiries to the best of your

determine whether or not to accept the case.
Facts
State the facts that are pertinent to your appeal. What occurred that prompted you to seek redress from
the Court? Specificity is key. Give details on who, what, when, where, why, and how.
The election results were announced on February 20th, 2015 and the results were posted online in the
time following. The winners for Senior Yell Leader were as follows: (1) Steven Lanz (2) Kyle Cook (3)
Zachary Lawrence followed by (4) Ben Ritchie and (5) Shelby Fincher. The winners for Junior Yell Leader
were as follows: (1) Will Alders (2) Chris Wilder followed by (3) Forrest Williams.
Each student is entitled to three votes for Senior Yell Leader and two votes for Junior Yell Leader. This
reflects the fact that there are three seats for Senior Yell and two seats for Junior Yell.
The focus of this J Court appeal is on the Senior Yell Leader race, as that one has the biggest potential for
results that potentially need to be rectified.
In Round 1 of voting, (IE, before the instant run off voting kicks in), the results appear this way:
1) Steven Lanz w/ 3860 votes
2) Kyle Cook w/ 2,747 votes
3) Zachary Lawrence w/ 1,898 votes
4) Ben Ritchie w/ 1,368 votes
5) Shelby Fincher w/ 734 votes
6) Seth Bryant w/ 424 votes
7) Adam La Masters w/ 112 votes
8) Everyone else (write-ins, etc) w/ 74 votes
The total of these vote counts is 11,217. The results also indicate that 11,369 votes were cast. The
variance can be accounted for by people who are not on the election results because they received two
or less votes and (if counted correctly) by voters who voted for less than 3 candidates. However, ballots
cast refers to people who voted in the election. So if there were 11,217 ballots cast, there was the
opportunity for 33,651 actual votes to be cast (11,217x3). Now logically, not everyone will use all three
of their votes, however, the final vote tally should still be significantly higher than the 11,217 on the
results.
Because of the simple math involved, it is my belief that only people who ranked a candidate in the
number 1 spot had their ballots counted. Their votes placed at #2 and #3 were irrelevant. This is
contradictory to what should have happened - each voter's "Top 3" should count equally the same.
Constitutional/Statutory Citations
Please tell the Court specifically what passages, if any, in the Student Government Constitution, by-laws,
or Senate legislation, have been violated. In addition, if any of the aforementioned documents bolster
your case in any way, please list those passages as well.
VI. i. iv. (pages 22-23) of the 2015 election results state:

Procedure- Multi-Seat Races
1.
The procedures for multi-seat races shall be the same as for single-seat races except:
While ranking shall proceed numerically, with no duplications, votes for as many candidates as there are
winners shall be weighted equally.

Example: For Senior Yell Leader (three [3] seats available), the candidates receiving ranks one
(1), two (2), and three (3) would be weighted equally.
After a candidate (ranked in the equally-weighted positions) has been eliminated, that candidate’s vote
shall be redistributed to the candidate on a ballot with the next-highest ranking.
Rounds shall proceed in this way until winners equal to the number of seats available for a particular
race reach a majority.
Special Circumstances (If Applicable)
Are there any special considerations that the Court should take into account? Does this case need to be
heard in a specific time frame? Should the Court act by writing an injunction? Please explain.
Because of the nature of the mishap on the entire student body and the winners and losers of the
election, this must be resolved as soon as possible.
Relief That You Are Seeking
What would you like the Court to do to rectify the harm that you have faced in your appeal?
A simple recalculation that follows the rules outlined above is necessary and justified to ensure that the
voice of the student body is heard.
