Kansas – Must complete application for approval Colorado - Under the Degree Kentucky – Must submit a letter Authorization Act (DAA), for consideration to determine without physical presence whether licensure is required. an institution would not need to seek authorization. However, the institution must provide some sort of notification to the department of higher education about any activity occurring in the state. Michigan - Approval or licensure by the State of Michigan is not required to provide online instruction to Michigan residents unless the school has a physical presence in the state. Physical presence does not include conducting courses such as internships, clinicals, practicum’s, etc. (*Exception: Approval is required if an institution employs faculty working from the state and the institution wishes to incorporate or file a certificate of authority to operate in Michigan.) Connecticut – Must demonstrate compliance with all applicable procedures and standards as indicated in their letter (link on USG website) Massachusetts – Must apply for licensure at this time Mississippi – No action required if no physical presence Delaware – If not incorporated in Delaware and if no physical presence, nothing required but notification to state Minnesota – Must complete application packet to register as degree-granting institution New Mexico – Pending legislation, “public out-ofstate institutions are given a one year waiver from meeting [the] New Mexico statutory requirement until June 30, 2012.” New York - No action required if no physical presence Illinois – Must apply for an exemption under the distance education - no physical presence exemption (link to form on USG site) Montana – Must be accredited by agency recognized by Montana BOR and meet the registration requirements of the Montana Secretary of State’s Office (link on USG site) Maine – Must complete survey to determine status (link to survey on USG site) Pennsylvania – Form required to be considered (available on website) North Carolina - No action necessary unless the institution has a physical presence and/or offers practicums, clinical experiences, and student teaching.. Missouri – Must submit a letter affirming compliance with both regional accrediting standards and the MDHE Principles of Good Practice for Distance Learning and Web-Based Courses (address on USG site) Texas – Institutions must “send a formal inquiry detailing their accreditation status, applicable degree programs, and a statement indicating whether or not the programs are completely online, contain some in-state instruction/practicum/internship, and whether or not the institution has a physical presence or agent located or planned for Texas.” (contact info. on website) South Carolina – No action necessary if no physical presence or solicitation instate. Nevada – Complete form (available on USG site) certifying no physical presence as defined by Nevada Utah – accredited schools must file for exemption (new legislation pending) South Dakota – No action necessary as long as accredited by a regional or national accreditation agency, in candidacy for accreditation, or part of a financial aid articulation agreement. Tennessee – No action necessary if no physical presence (as defined in letter on website). North Dakota – Institutions may be exempt if no physical presence. To claim exemption an institution must “provide to the board, in writing, sufficient information supporting the exemption.” Oklahoma – letter defining level of presence in state required (see website for required information and contact info for Vice Chancellor) Washington – Must fax questionnaire to determine next steps (questionnaire and fax number on website) West Virginia – Must complete questionnaire. However – be cognizant of some unique language in their letter: “ If an out-of-state institution does not plan to operate a facility in Virginia and/or the mechanism by which instruction is initiated (server) is not located within Virginia, the school does not meet Virginia’s criterion of physical presence. Any school not meeting this criterion is ineligible for certification to operate in Virginia. This ineligibility would not prevent or prohibit an outof-state institution from offering postsecondary instruction via distance learning to residents of the Commonwealth of Virginia.
