TERMS OF FOSTER AGREEMENT / CO-OWNERSHIP
This is a legal / binding agreement between _________________ (see details below) and Denise Babcock,
Rob Babcock, and/or Dallas Babcock (breeders and representatives of The Captain’s Labradors / Dal-Rhe
Golden Retrievers, hereafter also referred to as the breeder. It outlines the terms of the co-ownership of one
Labrador or Golden Retriever, as described below.
This agreement allows for the transfer of said dog to the care and co-ownership of co-owner/foster family at
no charge in exchange for retained breeding rights for the breeder, The Captain’s Labradors & Dal-Rhe
Goldens, as outlined below.

The dog will reside with co-owner/foster family and his/her family with the following considerations:
The dog will be kept as a family companion and treated with love and care. He/she will live in the home and
be treated as a part of the family. All expenses in maintaining the dog in good health will be the responsibility
of co-owner/foster family, including but not limited to daily care, housing, veterinary care, training expenses,
etc. The breeder(s) assume no financial liability for such expenses. The co-owner/foster family agrees to
keep the dog in a healthy condition and weight, providing adequate exercise and nutrition. The coowner/foster family agrees to feed the dog a high quality dog food. Some brands we recommend include:
Diamond NATURAL, ProPlan Select, Nutro Ultra, and/or Canidae. Note: the first ingredient should be a meat,
and the food should not contain ground corn. The co-owner/foster family agrees to keep all vaccinations
current, as well maintaining medications to prevent heartworm and flea & tick infestation (i.e. Heartguard and
Frontline Plus).
The co-owner/foster family agrees to keep the dog in a safe place and under his/her/their watch & control, or
in the care of another responsible adult in the case of the co-owner/foster family’s absence. The coowner/foster family will not let the dog run free and unattended, except in a fenced yard or enclosure while
exercising his/her. He/she will not tie or tether the dog, except when on lead for walks and training and while
under his/her care of supervision (or the care of a responsible adult).

As a part of this agreement and as a condition of transfer, the breeders retain breeding rights for the dog as
described below:
SPECIFIC CONDITIONS FOR CO-OWNED FEMALES:
1)the dog will be bred and produce 2 litters for The Captain’s Labradors & Dal-Rhe Goldens, provided he/she
is in good health and capable of breeding as assessed by the breeders at The Captain’s Labradors & Dal-Rhe
Goldens. The Captain’s Labradors & Dal-Rhe Goldens will pay for the cost(s) of veterinary tests they deem
necessary priory to breeding (OFA / CERF / Cardiac) and reserve the right to have these tests performed at
their choice of veterinarians.
2) The 1st litter will be the sole property of The Captain’s Labradors / Dal-Rhe Goldens (Denise, Rob, or
Dallas Babcock and/ or their heirs).
3) The 2nd litter will also be the property of The Captain’s Labradors / Dal-Rhe Goldens (Denise or Rob
Babcock and/ or their heirs), with the exception that co-owner/foster family would be allowed to select a pet
quality dog {after show / performance prospects have been selected by the breeder(s)}, to retain as a family
companion (not for breeding). This dog would be placed in co-owner/foster family’s care with the agreement
that the pup would be spayed or neutered and that s/he would not be sold or transferred to 3 rd party. There
would be no cost / financial compensation paid to the breeder(s) for this puppy.
4) After the dog has had her 2nd litter, co-owner/foster family agrees to have her spayed, at his/her expense.
After proof of spay is provided, Denise, Rob, &/or Dallas Babcock would sign over ownership of the dog to
the sole ownership of co-owner/foster family.
5) For the purposes of this contract, a litter will consist of 4 or more puppies living beyond 6 weeks of age.
Should less than 4 puppies be produced / survive from a breeding/whelping from the dog, the breeder(s)
reserve the right to breeding a subsequent litter to satisfy the 2 litters as agreed upon in this contract. Any
and all pups from these whelpings would be the property of the breeder(s) {The Captain’s Labradors / DalRhe Goldens, or heirs of such}.
6) It is understood that the breeder(s) {The Captain’s Labradors / Dal-Rhe Goldens} will house and care for
the dog during whelp and during the raising of his/her puppies up to age 8 weeks. The co-owner/foster
family agrees to return the dog into the care of The Captain’s Labradors / Dal-Rhe Goldens during these
times, as well as returning his/her to their care at the time of the matings to facilitate breeding. If the coowner/foster family resides outside of a 200 mile radius (or relocates as such), they agree to provide for
transport and associated costs in order to return the dog to The Captain’s Kennels for breeding.
7) Should the co-owner/foster family wish to assist in the whelping and raising the dog’s litter(s) by rearing a
litter in his/her home, The Captain’s Labradors / Dal-Rhe Goldens agree to consult with him/his/her and if it is
mutually agreeable, allow him/his/her this opportunity if they feel confident that he/he/she has the time and
knowledge needed to take on this very big responsibility. In this circumstance, any and all veterinary care of
the dog and his/her puppies related to the breeding would be the responsibility of co-owner/foster family, as
he/she would be in his/her care. The pups would remain the property of The Captain’s Labradors / Dal-Rhe
Goldens, except as outlined in item #3 above, and co-owner/foster family would agree to allow
representatives of The Captain’s Labradors / Dal-Rhe Goldens visitation rights. Pups would be transferred to
the care of The Captain’s Labradors / Dal-Rhe Goldens between 6 and 7 weeks of age. There will be no
financial compensation given to co-owner/foster family, his/her family, or his/her heirs, for the pups
produced as a result of said breeding(s).

1)The dog will be kept intact and made available for the breeder(s) to use at stud.
2) The Captain’s Labradors & Dal-Rhe Goldens will pay for the cost(s) of veterinary tests they deem
necessary priory to breeding (OFA / CERF / Cardiac) and reserve the right to have these tests performed at
their choice of veterinarians.
3) For breedings that are a part of The Captain’s Labradors / Dal-Rhe Goldens breeding program, no stud fee
will be charged / applicable. There will be no financial or other compensation paid to the co-owners for the
use of this dog at stud for such breedings. Further, any and all resulting puppies produced from these
breeding(s) will be the sole property of the breeder(s).
4) If a third party (‘outside stud client’) wishes to use the dog at stud, and the female intended for the
breeding meets the approval of The Captain’s Labradors / Dal-Rhe Goldens, the co-owner / foster family
agrees to again have the dog available to provide this service. In this case, ¼ of the stud fee would be paid to
the co-owner/foster family. The balance of the stud fee ( ¾ ) would be payable to The Captain’s Labradors /
Dal-Rhe Goldens (Denise, Rob, or Dallas Babcock and/ or their heirs).
5) Any and all semen collected, stored and frozen from this dog will be the sole property of the breeder(s)
(Denise, Rob, or Dallas Babcock and/ or their heirs).
6) Stud fee amounts and requirements for the bitches to be bred shall be determined soley by The Captain’s
Labradors / Dal-Rhe Goldens.
7) The Captain’s Labradors / Dal-Rhe Goldens reserves the right to advertise and promote this dog at stud.
8) It is understood that the breeder(s) {The Captain’s Labradors / Dal-Rhe Goldens} may ask to house and
care for the dog during breeding engagements, and the co-owner / foster family will make every effort to
allow the breeder(s) access to him and enable them to take him into their care during these times. If the coowner/foster family resides outside of a 200 mile radius (or relocates as such), they agree to provide for
transport and associated costs in order to return the dog to The Captain’s Kennels for breeding.
9) Should the stud client and / or The Captain’s Labrador’s / Dal-Rhe Goldens require the dog be brought to a
veterinarian for semen collection or evaluation in order to provide semen for an artificial insemination
breeding, the co-owner / foster family agrees to transport the dog to a local veterinarian for these services,
as needed. These vet fees would be the responsibility of the stud client and / or The Captain’s Labradors /
Dal-Rhe Goldens (the potential litter owner).

SHOWING and TRAINING:
If the breeder(s) assess the dog and feel that he/she has traits to be a show prospect or performance
prospect, co-owner/foster family agrees to allow them access to the dog so that they can attend shows and
show the dog in these events.
In the same spirit, the breeder(s) agree to allow the co-owner/foster family and his/her family the opportunity
and right to show the dog in events as well, should they express interest in doing so. The breeder(s) realize
that showing and training can be a wonderful experience and enhance the dog-owner relationship, and
encourage the co-owner/foster families to consider taking classes with the dog and enjoying this wonderful
facet of dog ownership.
*The costs of entries and travel for shows and/or hunt tests would be the responsibility of the initiating party.
OTHER CONSIDERATIONS:
If for any reason co-owner/foster family finds that he/she is unable to keep / house the dog, it is agreed that
the dog would be returned to the ownership and care of the breeder(s) and/or their heirs with no financial
compensation to either party.
This agreement is entered into with mutual trust of the parties involved. All parties agree to exercise
common sense and care in keeping the dog safe and healthy while he/she is in their care. With this basic
premise understood, these parties further agree to hold one another harmless in the event that an
unforeseen accident or event would occur resulting in the loss of the dog.
