Extension of Time (EOT)
 SPV vide letter dated 27th February 2014 requested IE to review its earlier
recommendation for EOT for PCOD upto 17th January 2014 & COD upto 10th June
2014 on account of non-compliance of the obligations of NHAI, as mentioned in its
earlier recommendation and further requested EOT upto 7th September 2015 i.e.
for 986 days beyond the Scheduled 4-laining date (24th September 2012) i.e. an
additional EOT of 363 days beyond 10th June 2014 (excluding monsoon period of 90
days) already recommended by IE vide their letter dated 5th August 2013. SPV also
requested an independent EOT for 350 days for completion of works of ROB at Km
3+886 from the date of issue of COS notice and release of 20% advance payment as
per the CA provisions.
 IE vide letter dated 25th June 2014 had recommended EOT upto 23rd October 2014
including all COS items. IE further recommended for signing supplementary
agreement and if accepted Provisional certificate can be issued as and when test
under Schedule-I are completed for the remaining stretch of the project Highway.
 Concessionaire vide letter dated 4th July 2014 intimated to IE that its assessment
towards Extension of Time is contradictory. Concessionaire stated that IE’s
recommendation for signing a Supplementary agreement with NHAI for completion
of balance works is not mandated by the Concession Agreement and shall damage
the rights of the Concessionaire.
 IE vide letter no 5091 dated 2nd August 2014 had revised the EOT recommendation
upto 4th September 2014 excluding the hindrance stretches and COS. IE further
stated that LD will be applicable if concessionaire fails to complete the available
stretches before 3rd December 2014.Concessionaire submitted its comments on
IE’s EOT determination stating IE’s assessment to be improper as it has not
considered land Acquisition data.
