Councilmember _________________, the following resolution was offered.
RESOLUTION NO. __________
A resolution ratifying Amendment No. 1 to The Non-Exclusive
Time Contract For Residential and Small Business Solid Waste
and Recyclable Materials Collection, with Progressive Waste
Solutions of LA, Inc. (PWSLA), to adjust the insurance
deductibles limits; to adjust the annual credit to Jefferson Parish
in the event of cancellation of the special collection of Christmas
trees; and to change the date for parish-wide conversion to semiautomated curbside garbage collection. (Parishwide)
WHEREAS, pursuant to Resolution No. 122091, adopted on December
11, 2013, the Parish and PWSLA entered into that certain Agreement (the
“Agreement”), with an effective date of January 1, 2014, for the collection of Solid
Waste and Recyclable Materials from Residential and Small Business Units, to
provide semi-automated curbside and drop-off site collection, transportation,
storage, processing and disposal of Solid Waste and to provide manual and
drop-off site collection, transportation, storage, processing and marketing of
Recyclable Materials from Residential and Small Business Units in Consolidated
Garbage District No.1 for a total cost of two hundred thirteen million, two hundred
sixty-two, and six hundred dollars ($213,262,600.00); and
WHEREAS, Parish and PWSLA wish to amend the Agreement to adjust
the insurance deductibles limits, to adjust the annual credit to Jefferson Parish in
the event of cancellation of the special collection of Christmas trees, and to
change the date for parish-wide conversion to semi-automated curbside garbage
collection.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council,
the governing authority of said Parish:
SECTION 1. That the Council does hereby ratify Amendment No. 1, which
amends the Agreement with Progressive Waste Solutions of LA, Inc. (PWSLA)
for collection of Solid Waste and Recyclable Materials from Residential and
Small Business Units, to adjust the insurance deductibles limits to limits above
ten thousand dollars ($10,000.00); to adjust the annual credit to Jefferson Parish
in the event of cancellation of the special collection of Christmas trees from
twenty thousand dollars ($20,000.00) to ten thousand dollars ($10,000.00); and
to change the date for parish-wide conversion to semi-automated curbside
garbage collection, from July 1, 2014 to September 15, 2014.
SECTION 2. That all expenditures associated with this resolution shall be
charged to the Consolidated Garbage District No. 1 Account No. 22390-33407342.1, Combined Curbside Collection.
SECTION 3. That the Chairman of the Jefferson Parish Council, or in his
absence the Vice-Chairman, be and is hereby authorized to execute any and all
documents necessary to give full force and effect to this resolution.
