Competition terms and conditions
The inaugural WA Day Long Lunches will be held at one of six iconic restaurant locations across Western
Australia. Enjoy a sumptuous menu designed using seasonally grown, fresh local ingredients, matched with
exquisite Western Australian wine and beer.
Venues currently hosting Long Lunches include Frasers Restaurant (Kings Park), The Old Brewery, BWG
Steakhouse, Indiana (Cottesloe Beach), Modo Mio and The Esplanade Hotel (Port Hedland).
Best of all, by purchasing a ticket you are able to enter the draw to win two business class return flights, from
Perth to London, flying with Etihad Airways valued at A$20,000 and A$3,000 spending money.
Terms and Conditions
1)
Information on how to enter forms part of the terms and conditions of entry. Entry into the ‘Long Lunch
Giveaway’ (Promotion) is deemed acceptance of these Terms and Conditions. Headings in this
document are included for ease of reference, and do not affect interpretation in any way.

The promoter of the Promotion is Celebrate Western Australia (Inc) (ABN 17 998 993 055) of Level 4,
182 St Georges Terrace, Perth, Western Australia 6000, trading as Celebrate WA (Promoter). WA
Restaurants Pty Ltd (ABN 36 074 560 875) (Fraser’s Restaurant), The Old Brewery Bar Grill and
Function Pty Ltd (ABN 99 126 194 581) (The Old Brewery), Bluewater (WA) Pty Ltd (ABN 87 102 210
319) (BWG Steakhouse), ITH (WA) Pty Ltd (ABN 90 121 423 176) (Indiana), Burswood Nominees Ltd
(ABN 24 078 250 307) (Modo Mio Cucina Italiana) and The Trustee for Pub Land Trust (ABN 46 481
054 771) (The Esplanade Hotel Port Headland) (Restaurants), along with Clarity Communications
Australia Pty Limited (ABN 60 095 936 020) (Clarity Communications), Bain Media Pty Ltd (ABN 19
146 016 051) (Bain Media) and Etihad Airways PJSC (ABN 40 123 078 688) (Etihad Airways) will
assist the Promoter to promote the competition (Promotion Partners).
Promotion Period
3)
All references to time in these Terms and Conditions are a reference to the local time in Perth, Western
Australia, Australia. The Promotion commences at 7:00am on Thursday 7 May 2015 and closes at
5:00pm on Sunday 31 May 2015 (Promotion Period).
Eligibility to enter the Promotion
4)
Subject to clauses 5 and 6, entry is open only to Australian residents who:
a.
are 18 years or over;
b.
have purchased a valid ticket to a Long Lunch 2015 event hosted by a Restaurant (Long
Lunch); and
c.
hold a current passport.
(Eligible Entrants).
5)
Directors, management, employees, agents, and their immediate families of the Promoter or Promotion
Partners and any of their related bodies corporate are ineligible to enter the Promotion.
6)
People whose tickets are purchased by a business or who will have all or part of the cost of their tickets
reimbursed by a business are ineligible to enter the Promotion.

Entry into the Promotion
7)
To enter the Promotion, Eligible Entrants must, during the Promotion Period, purchase a ticket to the
Long
Lunch
following
the
respective
Restaurant
booking
process
(accessed
via
http://www.celebratewa.com.au, which will redirect to the relevant restaurant’s website), and:
a.
when booking tickets to the Long Lunch at Fraser’s Restaurant, The Old Brewery, BWG
Steakhouse and Indiana, not tick the box on the booking page to opt out of the Promotion for
yourself; or
b.
fill in an entry form available at the Long Lunch at each Restaurant and submit it by placing it in
the nominated collection box at the respective Restaurant.
All Eligible Entrants must ensure that their email address and phone number provided at the time of
entry are complete, accurate and up to date.
8)
The time of entry is deemed to be the time an entry is received by the respective Restaurant. Each
Restaurant is required to provide the details for all Eligible Entrants to the Promoter before 5:00pm on
Monday 8 June 2015.
Invalid entries into the Promotion
9)
The Promoter is not responsible for any incomplete, incorrectly submitted, lost, late or misdirected
entries.
Maximum number of entries into the Promotion
10) Eligible Entrants are permitted to submit one entry only. The Promoter has the right to remove any
entries that appear to be duplicates or multiple entries from the same Eligible Entrant.
11) The Promoter reserves the right, at any time, to verify the validity of entries and whether any entrant is
an Eligible Entrant (including any entrant's identity, age and place of residence) and to disqualify any
entrant who tampers with the entry process.
Drawing of winner
12) The Promoter will randomly draw the winner at 5:00pm on Monday 8 June 2015 at the Promoter’s
offices. The draw is based entirely on chance.
13) The Promoter’s draw is final and no correspondence will be entered into.
The prize
14) There will be one Promotion winner.
15) The Promotion winner will be awarded:
a.
two return business airfares from the winner’s nearest Etihad Airways serviced airport to
London with Etihad Airways; and
b.
a MasterCard Cash Passport with a balance of A$3000 (inclusive of GST).
16) The prize is valued at A$23,000 (inclusive of GST). Unless otherwise stated, the prize does not include
travel insurance, passports, visas, meals, taxes not included in the price of the ticket, flights,
accommodation, airport transfers or any other costs of a personal nature. Compliance with any health or
other government requirements is the responsibility of each passenger. The Promoter makes no
representations as to the safety, conditions or other matters relevant to the destination.
17) The Promoter will book the airfares with Etihad Airways in consultation with the Promotion winner. The
airfares will be valid for 12 months from the date of booking. The Promotion winner and their nominated
travel companion(s) will not accrue Etihad Guest Frequent Flyer points on the prize travel and cannot
use Etihad Guest Frequent Flyer points or cash to upgrade any prize travel. No changes to travel
arrangements can be made once seats have been confirmed. All prize travel on Etihad will be subject to
fare rules and Etihad’s General Conditions of Carriage.

18) The prize must be taken as stated, is not transferable to another person (unless agreed by the Promoter
in its absolute discretion), cannot be exchanged for other goods or services, and cannot be taken as
cash. It is a condition of accepting the prize that the winner accepts the conditions of use of that prize.
19) If the prize (or part of the prize) is unavailable, the Promoter, in its absolute discretion, reserves the right
to substitute the prize (or that part of the prize) with a prize up to the equal value or specification, subject
to any written directions from a regulatory authority.
Notification of the winner
20) The Promotion winner will be:
a.
notified by phone or email within 2 business days of the draw; and
b.
announced on the Promoter’s website and Facebook page by 5:00pm on Wednesday 10 June
2015.
Replacement winner
21) The Promoter will randomly complete a re-draw in case the first selected winner has not complied with
these terms and conditions, forfeits the prize or fails to claim the prize by 5:00pm on Wednesday 5
August 2015. If the prize remains available at 9:00am on Thursday 6 August 2015, the Promoter will
conduct a re-draw and award the prize to first randomly drawn winner, subject to any written direction
given under applicable law. Any person who wins the Promotion in accordance with this clause 21 will
be:
a.
notified by phone and email on Thursday 6 August 2015; and
b.
announced on the Promoter’s website and Facebook page by Monday 10 August 2015
(including the Winner’s name, suburb and state).
Additional documentation
22) As a condition of accepting the prize, the Promotion winner must sign any legal documentation as and in
the form required by the Promoter in its absolute discretion, including but not limited to a legal release
and indemnity form.
Reservation of rights
23) If any act, omission, event or circumstance occurs which is beyond the reasonable control of the
Promoter and which prevents the Promoter from complying with these Terms and Conditions, the
Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter
reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend this Promotion
at any time.
No waiver
24) Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those
rights.
Limitation of liability
25) The Promoter and others associated with this Promotion and their respective related bodies corporate,
officers, employees, contractors, and agents will not be held liable for any loss, damage, injury or death
whatsoever which is suffered or sustained (including but not limited to direct, indirect and consequential
loss and including but not limited to any loss, damage, injury or death arising from any person’s
negligence) in connection with this Promotion, the promotion of this Promotion, the installation or any
use of any prize, except for any liability which cannot be excluded by law (in which case the liability is
limited to the minimum allowable by law).
Use of Personal information
26) All entries become the property of the Promoter.

27) This clause 27 sets out the basis on which the Promoter may use an Eligible Entrant’s personal
information, such as their name, age and town of residence (Personal Information):
a.
Eligible Entrants warrant that any Personal Information that they provide to the Promoter is
accurate;
b.
Eligible Entrants irrevocably consent to the Promoter using any Personal Information which
they submit in connection with this Promotion on an on-going basis for any purposes
connected with the Promoter’s business, including the conduct of the Promotion and
publication of prize winners;
c.
the Promoter’s use of an Eligible Entrant’s Personal Information in accordance with this clause
27 may involve:
(i)
publication in any media (including the Promoter’s websites, Facebook page, in
print and on television); and
(ii)
disclosure to third parties (including State and Territory lottery departments and
the Promoter’s contractors) in connection with the Promoter’s business;
d.
Eligible Entrants will not be entitled to receive any remuneration or notice in relation to the
Promoter’s use of their Personal Information in accordance with this clause 27; and
e.
the Promoter complies with the Australian Privacy Principles in the Privacy Act 1988 (Cth)
(Privacy Act). The Promoter also has a Privacy Policy, which is available on the Promoter’s
website at http://www.celebratewa.com.au/privacy-policy.aspx (Privacy Policy). The Promoter
will use any Eligible Entrant’s Personal Information in accordance with the Privacy Act and the
Promoter’s Privacy Policy.
Consent
28) Eligible Entrants, in the event they are the Promotion winner, consent to the Promoter using their name,
likeness, image and voice (including photographs, film and recording of the same) in any media for an
unlimited period without remuneration and without notice for the purpose of promoting this Promotion
(including any outcome), promoting the Promoter or Promotion Partners and promoting any products
manufactured, distributed or supplied by the Promoter or the Promotion Partners.
Tax implications
29) The Promoter accepts no responsibility for any tax implications that may arise from accepting the prize.
Eligible Entrants should seek independent financial advice.
Force majeure
30) If any act, omission, event or circumstance occurs which is beyond the reasonable control of the
Promoter or which prevents the Promoter from complying with these Terms and Conditions, the
Promoter will not be liable for any failure to perform or delay in performing its obligations.
Governing law
31) These Terms and Conditions are governed by the laws of Western Australia.
