By purchasing your private party with Bittersweet Studios, you confirm that you agree to the following
terms:
PRINCIPAL TERMS _______ Initial
1. This agreement commences upon receipt of payment of deposit for your private party.
2. If you are planning on bringing food or beverages with you, you are allowed to use the common areas
with your group 15 minutes before OR after your scheduled party. If you run over the allotted 15
minutes you will be subject to additional charges of $25 per 15 minutes.
3. If the number of people needs to changes prior to your event, you must let us know at least 72 hours
in advance. If you have additional attendees the evening of your party, additional fees will be charged
per person for the appropriate party size purchased. No additional catering will be ordered.
4. You cannot transfer this agreement to anyone else.
FEES AND CHARGES _______ Initial
1. Food and drinks are not allowed inside the pole or aerial areas. If there is any damage caused by your
group due to food or drinks, a cleaning fee of $50 will be assessed at the end of your party.
2. Each payment made is not refundable under any circumstances.
3. If any credit card/debit payment or any check is returned unpaid, or if any other form of payment is
not honored for whatever reason, you shall pay Bittersweet Studios upon demand an administration fee
of $50 plus the fees that for the returned payment. All accounts that go unpaid for 10 days will be sent
to collections and additional legal fees will be added.
GENERAL TERMS _______ Initial
1. You agree to comply with the Studio Rules, which are located on our website and displayed in the
Studio. This relates to opening hours, use of facilities and your conduct. We may make reasonable
changes to these Rules at any time.
2. If we take no action or waive any breach of this agreement, or give you extra time to pay or additional
opportunity to comply with any Studio Rules or terms of this agreement, it will not stop us from strictly
enforcing the Studio Rules or the terms of this agreement at a future date.
3. We may assign the benefit of this agreement and our rights hereunder to a third party upon notice to
you. Your rights under this agreement will not be prejudiced.
4. This agreement is governed by the laws of the State of Florida.
5. You knowingly, voluntarily and intentionally waive any right you may have to a trial by jury with
respect to any proceeding arising out of or relating to this agreement.
6. All guests must not touch any of the aerial equipment without permission from the instructor and/or
party facilitator.
7. If anything in the studio is damaged by your party the studio will recoup the cost of replacement or
repair immediately following the party. If we do not recover those cost immediately we will then turn
your account over to collections and our legal team.
RELEASE AND INDEMNITY _______ Initial
1. I understand that use and access of the premises, facilities, services and equipment of Bittersweet
Studios involves risk of injury, whether caused by the actions or negligence of myself, someone else,
Bittersweet Studios or its employees, and I assume full responsibility for such risks.
2. I understand that I voluntarily participate in the activity at my sole risk and responsibility.
3. I acknowledge full understanding of the inherent dangers and risks associated with use of this facility
and any activity occurring therein.
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby
release, indemnify and hold harmless Bittersweet Studios, and its servants and agents, from any and all
claims, causes of action, demands or liability, known or unknown, present or future, arising my use or
occupancy of Bittersweet Studios or any activity occurring therein, including but not limited to any
injuries or damages arising from negligence or otherwise, to the broadest and fullest extent permitted
by law.
5. I execute this release for full, adequate and complete consideration, fully intending to be bound by
the same.
CANCELLATION AND NO SHOW POLICY _______ Initial
1. Parties must be cancelled 10 days before the event day to receive 50% of the deposit refunded to
your card or you can reschedule for no extra charge.
2. If cancelled within 9 days prior to the event, you will lose the full deposit and will not be able to
reschedule, unless you pay another deposit.
3. You must arrive at the facility no later than 15 minutes after your party’s start time; otherwise your
party will be cancelled and you will not receive a refund. If you arrive after the 15-minute allowance the
studio will be locked.
4. If you are late (more than 15 minutes) or a no-show, you will be charged the remaining balance of the
party on the original card used to pay the deposit. If this is not paid we will contact you and provide 3
days for payment. After the 3rd day you will be turned over to collections and our legal team.
5. Bittersweet Studios shall be entitled to all costs of collection, including attorneys’ fees, in the event of
any default by a member of any financial or monetary obligation owing hereunder.
