TERMS OF REFERENCE: RESEARCH CONSULTANT
DEVELOPMENT OF MONITORING FRAMEWORK ON THE TOOLKIT FOR THE PRIVATE SECTOR –
RIGHTS OF PERSONS WITH DISABILITIES
EXTENDED DEADLINE: 17 APRIL 2015 AT 10:00
1. Background
The South African Human Rights Commission (SAHRC) is a Constitutional body established in terms
of the Constitution Act 108 of 1996 as well as the South African Human Rights Commission Act 40 of
2014. The SAHRC is under the strategic leadership of Commissioners. Operations are led by a Chief
Executive Officer (CEO).
Each Commissioner is assigned a specific focus area. The specific focus area that requires a Research
Consultant is ‘The Rights of People with Disabilities’. This focus area is led by Commissioner B.
Malatji.
The SAHRC’s Annual Performance Plan 2014/ 2015 identified the ‘Development of Promotional
material: Toolkit on Disability for the Private Sector’ (hereafter referred to as Toolkit). The Toolkit is
in line with the SAHRC’s obligation, as a national human rights institution; in terms of the Convention
on the Rights of Persons with Disabilities (CRPD). Article 33 (2) of CRPD requires “national
institutions for the protection and promotion of human rights” to “promote, protect and monitor
the implementation of the CRPD.”
In March 2015, the SAHRC finalized the Toolkit and presented it to various stakeholders at a Round
Table themed ‘Business and Human Rights: Ensuring an inclusive work environment for persons with
disabilities’. The Toolkit is intended to raise awareness about implementation of international and
national legislative frameworks on promoting the rights of persons with disabilities within the
private sector.
The toolkit makes a case for why the private sector should promote the rights of persons with
disabilities and further provides best practises for companies to follow.
Following the finalization of the Toolkit, a request was made for a Monitoring Framework to be
developed that will assist the SAHRC to continue to monitor implementation of the Toolkit.
2. Specific Service required
Given limited capacity within the SAHRC, a request is made for potential Research consultants to
submit proposals on the development a monitoring framework on the Toolkit.

Specifically, the Research consultant should;





Provide an analysis of the international, regional and national analysis of exisiting monitoring
frameworks on the CRPD
Critique of existing monitoring frameworks
Identification of gaps within existing frameworks
Development of monitoring indicators for the Toolkit
Facilitate various methodologies to validate the monitoring tools
o Methodologies should include workshops with private sector organizations and civil
society organizations working with people with disabilities
3. Qualifications Required of Research Consultant
Potential Research Consultants require the following;

A Masters Degree in Law/ Social Science/ Human Rights
Post Graduate course in Human Rights especially in the field of Disability Rights
Proven Research experience – including recent published work
Proven Project management experience – between three to six years
Previous experience in managing similar projects
Ability to convene validations workshops
4. Project Cost
The successful consultant will be paid a total of sixty thousand rand (R60 000) inclusive of VAT. This
amount excludes the production (Layout, Design and Printing) costs of the Toolkit.
5. Project Duration
The project duration is two (2) months.
6. Project Support from the SAHRC to the potential service provider
The SAHRC will provide assistance to the potential service provider in the form of;
a) An intern who will be available to provide administrative support
b) Hosting of workshops for validation of the Monitoring Framework
c) Provision of commentaries of draft versions of the Monitoring Framework
