PARTNER USER AGREEMENT TERMS AND CONDITIONS
Please read the following carefully.
By visiting and using power2give.org (known throughout this document from here on out as
power2give), you agree to and accept all of the terms and conditions in this agreement, as they may
be changed from time to time. Any modifications or enhancements to the site, content, or software
will also be covered by these terms and conditions.
Eligibility
By using this site, you acknowledge that:





All information you submit is truthful
You are 18 years old or older
You do not use the site to violate any laws or regulations
You represent a 501(c)3 nonprofit organization that has been approved to post projects on
power2give.org by Cultural Council of Palm Beach County, Inc. (CCPBC)
You are authorized to post projects on behalf of the 501(c)3 that you represent
Project Requirements
By posting projects to the site, you acknowledge that:





Project funding will be used only for the intended purpose you state on the site
Projects posted to the site will only be related to categories approved by CCPBC
Project request amounts will fall within the project budget range as determined by CCPBC
with a current maximum of $ 10,000.
Projects will take place within the service region as defined by CCPBC
Project funding will be used directly to cover the expenses of the project itself and will not
be used for profit for the organization
Rules


You may use the site, content, and software solely for the purposes stated on the site.
All of the information, graphics, format, and software may not be copied or imitated without
the expressed written consent of the power2give team
Disclaimers


power2give reserves the right to restrict your use of the site as we see fit.
CCPBC reserves the right to deny any organization posting privileges.
Liability

Neither Arts & Science Council of Mecklenburg County, NC, Fractured Atlas or CCPBC,
any of their employees or any companies who have helped create the site or provide funding
through the site are liable for any damages related to any of the projects on the site, any of
the organizations represented by those projects, or any other user's content, actions or
inactions.

You will indemnify and hold us and any of our employees or any companies who have
helped create the site or provide funding through the site harmless from any claim or
demand, including attorneys’ fees, made by any third party related to your breach of this
Agreement, or your violation of any law or the rights of a third party.
Third Party Links


power2give may provide links to outside websites that are not monitored by power2give and
are thereby not responsible for activities or information on the linked sites.
Similarly, by publishing a hyperlink on your own website, you acknowledge that your website
is appropriate. power2give reserves the right to ask for immediate removal of the link if it
chooses.

By clicking the "Submit" button upon posting, you are agreeing to all of the terms and
conditions in this document and specifically that: The project you are submitting is legal and does not violate any municipal, state or federal
laws or the rights of any third party All of the information you provide on the site is truthful and accurate to the best of your
knowledge Any project you submit will be used for its specified purpose and nothing else - You are
responsible for any information you submit and have full rights to that information You are responsible for keeping your user ID and password confidential and notify
power2give if it is compromised. You allow the owners of power2give to use the information your provide in its marketing
and promotional materials in any manner we deem appropriate to promote the cause You agree to use the funding for the expressed purpose you stated in your project narrative You will obtain the permission of any person in photos or videos you choose to post on
power2give prior to posting them You will properly steward all donors that give to your projects including thanking them
timely and sharing the results of projects once they are completed You will never sell or rent donor personal information to other individuals or companies
Should your project not receive full funding, you agree to contact all of the donors who gave
to that project to share your plans for using the gift You will respond to inquiries by CCPBC staff regarding information on how funds were
used and provide all supporting documentation if requested, in a timely manner. This
information could include but is not limited to a written financial statement disclosing the
purpose for which funds are raised, the total amount of all contributions raised, the total
costs and expenses incurred in raising contributions, the total amount of contributions
dedicated to the stated purpose or disbursed for the stated purpose, and whether the services
of another person or organization have been contracted to conduct solicitation activities.
You recognize that failure to honor any of the agreements can result in CCPBC denying you
access to the system and refusing to post any future projects from your organization at its
discretion
Other Legal Considerations

This Agreement and all claims between you and ASC or CCPBC are governed by North
Carolina law, and all litigation shall be heard exclusively in the courts of North Carolina.
