recreation) and fire protection. These four (4) ponds will be used for augmentation (to replace
out-of-priority depletions associated with Applicants’ irrigation and stockwater use and to
maintain storage capacities in ponds used for piscatorial and other uses). Applicants request the

in priority to maintain piscatorial habitat, provide water for irrigation and year-round livestock

Pertinent Information: This Amended Application clarifies Applicants’ claims for surface and
storage rights by changing some previously-claimed storage structures as developed springs.
With this Amended Application, Applicants also request the additional use of augmentation for
some of the ponds and claim new storage rights for Meadow Pond #2; Applicants understand
these new rights will be administered as having a 2015 priority. For purposes of establishing
future findings of reasonable diligence concerning the conditional rights sought herein,

Absolute: The City uses the subject water rights in connection with the Haymaker Golf Course.
Records of the volumetric amounts pumped from Lufkin Well Nos. 2, 3, 4, and 5 are maintained
by the City. A summary of these records for 2009-2014 is attached as Exhibit B. While a
measuring device has not yet been installed on Lufkin Well No. 1, water pumped from this well
at a rate of 25 gallons per minute is used to support the golf course operations, including, but not
limited to, use at the office, maintenance shop, and in a wash bay for golf carts and maintenance
equipment. There were no calls on the Yampa River during the subject diligence period to
prevent the diversion and use of the water rights decreed to the Lufkin Well Nos. 1-5. Therefore,
the City seeks to make all or a portion of the water rights decreed to the Lufkin Well Nos. 1, 2, 3,
4, and 5 absolute as set forth below. (a) Amounts & Uses Claimed Absolute: i. Lufkin Well No.
1: 0.056 cfs (25 gpm), absolute for domestic, commercial, irrigation, and municipal uses. ii.
Lufkin Well No. 2: 0.04 cfs (18 gpm) of the 0.067 cfs (30 gpm), absolute for domestic and
municipal uses. iii. Lufkin Well No. 3: 0.067 cfs (30 gpm) of the 0.134 cfs (60 gpm), absolute for
domestic, commercial, irrigation, and municipal uses. iv. Lufkin Well No. 4: 0.178 cfs (80
gpm), absolute for domestic, commercial, irrigation, and municipal uses. v. Lufkin Well No. 5:

and municipal uses. (b) Date water first applied to beneficial use: As set forth in the application
filed by the City in Case No. 99CW58, water was first beneficially used from the Lufkin Well
Nos. 1-5 in 1999. Specifically, water was used from Lufkin Well No. 2 to support the golf course
clubhouse, while water was pumped from Lufkin Well Nos. 1, 3, 4, and 5 through the use of a
portable pump and a 150 gallon capacity spray truck to irrigate the golf course. Permanent
pumps were installed on Lufkin Wells 1, 3, 4, and 5 in May of 2000. (c) Place of Use:
Haymaker Golf Course, as shown on Exhibit A. 5. Detailed outline of work done to complete
project and apply water to beneficial use: In addition to the foregoing claims to make absolute
based on the beneficial use of the water, the City seeks a finding of reasonable diligence with
regard to the remaining conditional portions of the Lufkin Well Nos. 1-5, or any portion not
made absolute. (a) During the subject diligence period, the City has diligently worked toward
applying the Lufkin Well Nos. 1-5 water rights to their decreed uses. Specifically, the City spent
approximately $92,529 on operational expenses, including water treatment and water quality
testing as part of the drinking water supply and to ensure compliance with the wastewater
discharge permit associated with Haymaker Golf Course. The City also spent approximately
$4,116 as part of Water Court Case No. 10CW49 to change the points of diversion for Lufkin
Well Nos. 3 and 4 to match the constructed and permitted locations of the wells. Lufkin Well
Nos. 1-5 contribute to the water supply the City needs for the use, operation, and maintenance of
the Haymaker Golf Course. (b) Accordingly, and subject to confirmation of the foregoing
absolute claims, the City requests that the following remaining amounts be continued as
conditional for domestic, commercial, irrigation, and municipal uses: i. Lufkin Well No. 2:

395896.0 meters (Datum: NAD83; UTM Zone 13). The PLSS legal description of the location
of the left abutment of the dam centerline is in the northeast quarter of the northwest quarter of
Section 35, Township 6 North, Range 79 West, 6th P.M., Jackson County, Colorado,
approximately 730 feet from the north line and 2,180 feet from the west line of said section. The
source of the UTM coordinates and PLSS description is Applicant’s consultant’s ArcMap
software. An illustrative map is attached to the application. 3.C. Source: Unnamed tributaries
of Willow Creek, tributary to the Illinois River. One tributary is known as “Cemetery Draw” or
“Cemetary Draw.” The other tributary is the draw immediately south of Cemetery (or Cemetary)

Cake Lake Enlargement water right allows an additional 61.0 acre-feet of storage from an
additional source of water. The combined amount of storage under the Coffee Cake Lake and
Coffee Cake Lake Enlargement water rights is 70.0 acre-feet. 4. Provide a detailed outline of
what has been done toward completion or for completion of the appropriation and application of
water to a beneficial use as conditionally decreed, including expenditures: During the diligence
period from January 9, 2009 through January 2015, the following has been done. The subject
Coffee Cake Lake Enlargement water right is integrally connected to the Coffee Cake Lake
water right decreed by this Court in Case No. 97CW80. During the subject diligence period,
Applicant completed the work necessary to obtain a decree finding reasonable diligence toward
the completion of the appropriation associated with the Coffee Cake Lake water right. This
Court entered that diligence decree on March 13, 2014 in Case No. 13CW3008. Applicant met
with Mr. Mike Applegate on March 16, 2012 to discuss plans for construction of the reservoir
associated with the Coffee Cake Lake and Coffee Cake Lake Enlargement water rights. Around
that time, Applicant also made inquiries with the Colorado Water Conservation Board
concerning the possibility of a construction loan for the reservoir. Applegate Group updated the
construction cost estimates for the Coffee Cake Lake reservoir. As found by this Court in Case
No. 99CW71, Coffee Cake Lake (including the Coffee Cake Lake Enlargement) is expected to
capture releases or bypasses from the up-gradient Black Wolf Lake, which is equipped with an
outlet pipe and control valve to regulate the reservoir and to enable water to be passed through
the dam. Throughout the diligence period, Applicant has continued to operate and maintain
Black Wolf Lake and the associated Black Wolf Lake water right. Flows into Black Wolf Lake
have been monitored and photographed; the flume into Black Wolf Lake has been monitored and
regularly maintained; the trash rack has been routinely cleaned; the windmill aerator has been
operated and maintained; fish have been caught and released from Black Wolf Lake. Regarding
the decreed irrigation use of the Coffee Cake Lake Enlargement water right, Applicant has
continued to maintain and irrigate the lands depicted on the attached map where the Coffee Cake
Lake Enlargement water would be applied. Hay has been produced on an annual basis from
those lands. Regarding the decreed stockwatering use, cattle have grazed on the ranch.
Applicant is negotiating a lease that will result in cattle grazing on the ranch this summer. From
approximately June 2007 through September 2009, the Manager of Applicant was engaged in
civil court litigation, one of the purposes of which was to defend and protect his assets, including
the subject Coffee Cake Lake Enlargement water right. One of the effects of the lawsuit was that
Applicant’s resources were temporarily diverted away from the Coffee Cake Lake Enlargement
project. Applicant has performed work on other water rights and water facilities at Shooting Star
Ranch (besides the Coffee Cake Lake water right mentioned above). Such work includes but is
not limited to filing a May 29, 2009 application and obtaining a July 23, 2011 decree from this
Court to make absolute the water rights for Timber Pond and Labrador Lake in Case No.
09CW18. Applicant also incurred legal and engineering fees in formal protests and opposition to
the inclusion of some of its water rights on the decennial abandonment list. All of Shooting Star
Ranch’s water rights and related facilities are regularly observed, operated, and maintained. The
Coffee Cake Lake Enlargement water right is an integral part of the water rights and facilities at
Shooting Star Ranch. Therefore, the work on all of the Shooting Star Ranch water rights and
facilities reflects diligence toward the completion of the Coffee Cake Lake Enlargement water

concerning the expenditures associated with such work, is available upon request of Applicant’s

2005CW15, Routt County District Court, Water Division No. VI, the Water Court decreed
certain conditional rights had been made absolute and continued other conditional water rights

completion or for completion of the appropriation and application of water to a beneficial use as
conditionally decreed, including expenditures: During the past diligence period, T&T Land and
Cattle used its own equipment and materials to further develop the conditional water rights. It
excavated the areas of Judy’s Spring, Colby’s Spring and Amber’s Spring at an estimated value
of $250; the springs are not yet fully developed. Michelle’s Spring is developed and a pump and
pipeline system has been installed to convey water to the residential area. T&T Land and Cattle
conducted additional field investigations to increase the capacities of Rich’s Pond, Judy’s Pond,
Michelle’s Pond and Mima’s Pond.
Additionally, T&T Land and Cattle’s manager and
counsel, Mr. Tremaine (who is part owner of the company), has spent at least 25 hours defending
T&T Land and Cattle’s water rights; these in-kind services are valued in excess of $6,875. T&T
Land and Cattle continues to monitor monthly resumes to ensure its water rights are protected
and has incurred approximately $1,700 for legal fees and costs for the preparation and filing of
this Application. 5. If claim to make absolute in whole or in part: A. Surface Structures: i. Date
water applied to beneficial use, amount and use: Michelle’s Spring: 0.01 cfs (5 gpm) for
domestic (spring water stored in tank and used in house), recreation (avian and wildlife viewing,
part of dirt bike track), stock and wildlife watering, and fill and refill Michelle’s Pond and
Colby’s Pond. ii. Information regarding diversion and description of place of use where water is
applied to beneficial use: T&T Land and Cattle estimated the flow; no diversion records have
been maintained. Water is collected at the developed spring site and piped to places of use;
overflow at the spring site is used for recreation purposes, livestock and wildlife watering, and
excess can be used to fill and refill Michelle’s Pond and Colby’s Pond. B. Storage Structures: i.
Date water applied to beneficial use, amount and use: The date for all storage structures is
August 7, 2013 (effective date of Senate Bill 13-041); Rich’s Pond, 1.5 AF for domestic,
irrigation, and piscatorial; Judy’s Pond, 0.25 AF for domestic, irrigation, and piscatorial uses;
Colby’s Pond, 2.0 AF for irrigation, piscatorial, and recreation uses; and Michelle’s Pond, 0.25
AF for domestic, irrigation, and piscatorial. ii. Information regarding diversion and description
of place of use where water is applied to beneficial use: Water collected from surface flows and
spring discharge is stored in the ponds. Measuring devices have not been installed. T&T Land
and Cattle claims the absolute rights for the named uses, in the amount of the existing storage.
Stored water continues to be used in or in the vicinity of the pond’s location. 6. Name(s) and
address(es) of owner(s) or reputed owners of the land upon which any new diversion or storage
structure, or modification to any existing diversion or storage structure is or will be constructed
or upon which water is or will be stored, including any modification to the existing storage pool:
T&T Land and Cattle owns the land where the water rights are located and upon which the water
rights will be used, with the exception of Michelle’s Spring and Michelle’s Pond. Those two
structures are located on property owned by Colby and Michelle Townsend, 2680 Copper Ridge
Circle, Steamboat, 80487, and are used co-operatively on property owned by T&T Land and
Cattle as well as the Townsends. 7. Remarks or any other pertinent information: The Water
Court previously decreed that T&T Land and Cattle’s conditional water rights located within the
same drainage form an integrated system (see C.R.S. §37-92-301(4)(b)) and further that T&T
Land and Cattle is entitled to fill and refill the storage structures when in priority. T&T Land
and Cattle respectfully requests the Water Court enter a decree in this matter that (1) adjudicates
0.01 cfs (5 gpm) of Michelle’s Spring as absolute for domestic, recreation, and stock and wildlife
watering uses; (2) finds Michelle’s Spring is used to fill and refill Michelle’s Pond and Colby’s
Pond; (3) finds T&T Land and Cattle exercised reasonable diligence in the development of the
remaining conditional water rights of 0.04 cfs for Michelle’s Spring, and continues in full force
and effect the conditional status of that water right; (4) finds T&T Land and Cattle exercised
reasonable diligence in the development of the Judy’s Spring, Colby’s Spring and Amber’s
Spring, each in the amount of 0.05 cfs, and continues in full force and effect the conditional
status of those water rights; (5) adjudicates as absolute the remaining conditional uses for Rich’s
Pond (1.5 AF for domestic, irrigation, and piscatorial uses), Judy’s Pond (0.25 AF for domestic,
irrigation, and piscatorial uses), Colby’s Pond (2.0 AF for irrigation, piscatorial, and recreation
uses); and Michelle’s Pond (0.25 AF for domestic, irrigation, and piscatorial uses); and (6) finds
T&T Land and Cattle exercised reasonable diligence in the development of the remaining
conditional portions of Rich’s Pond (0.5 AF), Judy’s Pond (1.75 AF), Michelle’s Pond (1.75
AF), and Mima’s Pond (1.9 AF), and continues in full force and effect the conditional status of
those water rights.
You are hereby notified that you will have until the last day of MARCH, 2015 to file with the
Water Court a Verified Statement of Opposition, setting forth facts as to why a certain
Application should not be granted or why it should be granted only in part or on certain
conditions. A copy of such Statement of Opposition must be served on the Applicant or the
