Count 1: Negligence
1. Whereas on October 18th 2012 Plaintiff was injured by falling concrete causing severe
laceration and metal fragments within his arm and defendant acted as medical
professional to treat injuries. Whereas Mr. Doctor failed to treat Mr. Swanson in a
timely manner, and failed to treat the injury to prevent infection and remove metal
fragments. Mr. Doctor closed Mr. Swanson’s wound without thorough cleaning and left
metal fragments over the objection of other medical professionals present. Mr.
Swanson, as a result, suffered from weeks of treatment for severe infection including
extreme pain and suffering and decreased utility of his arm due to continued infection
and correction of initial failure to treat with due care.
