In accordance with the Law of the Republic of Kazakhstan of 26.01.96 "On special economic zones in the Republic of Kazakhstan", I issue this Decree. See Z1100000469

1. To establish the special economic zone "Astana - new city" until 2027.

2. To approve the following:
1) Regulation on the special economic zone "Astana - new city";
2) target performance indicators of the special economic zone "Astana - new city", critical nonachievement level of target indicators.

3. The present Decree shall come into force from January 1,2002.

REGULATION on the special economic zone "Astana - new city"

The present Regulation on the special economic zone "Astana - new city" (hereinafter -
Regulation) is developed in accordance with the Law of the Republic of Kazakhstan dated July 21,
2011 "On special economic zones in the Republic of Kazakhstan" and it shall define the fundamental legal principles, economic conditions and principles to perform activity on the territory of the special economic zone "Astana - new city".
1. General provisions

1. The special economic zone "Astana - new city" (hereinafter - SEZ) is located within the territorial boundaries of Astana, at the boundaries according to the attached plan.
The territory of SEZ "Astana - new city" is an integral part of the territory of the Republic of
Kazakhstan and is 7634.71 hectares. The territory of FEZ includes an industrial park No. 1 with an area of 598.1 hectares, industrial park No. 2 with an area of 433.1 hectares and urban light rail line with an area of 72.41 hectares.

2. SEZ is created for:
1) rapid development of Astana by attracting investments and using advanced technologies in construction, and construction of modern infrastructure;
2) establishment of high, including high-tech and competitive industries, assimilation of new types of production.
3. Priority activities on the territory of SEZ are:
1) production of other non-metallic mineral products;
2) production of machinery and equipment;
3) production of household electrical devices;
4) production of rubber and plastic products;
5) production of chemical products;
6) metal industry;
7) production of electrical equipment, including electric light equipment;
8) production of glass components for illuminating devices;
9) food production;
10) production of wood pulp and cellulose, paper and cardboard;
11) furniture production;
12) production of motor vehicles, traillers and semitrailers;
13) production of railway locomotives and rolling stock;
14) production of aircrafts and spacecrafts;
15) production of basic drug products and pharmaceuticals;
16) production of electronic components;
17) construction and commissioning of infrastructure facilities, administrative and residential complexes in accordance with the design and estimate documentation;
18) construction and commissioning of hospitals, clinics, schools, kindergartens, museums, theatres, universities and colleges, libraries, schoolchildren's palaces, sports centers in accordance with the design and estimate documentation.

4. Activities specified in the Item 3 of this Regulation shall be carried out only within the industrial park No. 1 and the industrial park No. 2, excluding the activities specified in Sub-items
14), 16), 17) of Item 3 of this Regulation, which can be conducted on the whole territory of SEZ.
5. SEZ activities are regulated by the Constitution of the Republic of Kazakhstan, the Law of the
Republic of Kazakhstan dated July 21, 2011 "On special economic zones in the Republic of
Kazakhstan" and other legislation of the Republic of Kazakhstan.
If the international treaty ratified by the Republic of Kazakhstan establishes rules which differ

from those which are contained in the legislation on special economic zones, the rules of the international treaty shall be applied.
6. On the territory of SEZ a special legal regime shall be installed.
2. SEZ management
7. SEZ management shall be conducted in accordance with the Law of the Republic of
Kazakhstan of July 21, 2011 "On special economic zones in the Republic of Kazakhstan".
8. The public institution of the local executive body of the capital is financed from the local budget in accordance with the legal acts of the Republic of Kazakhstan.
3. Taxation on the territory of SEZ
9. Taxation on the territory of SEZ is regulated by the tax legislation of the Republic of
Kazakhstan.
4. Customs regulation
10. Customs regulation on the territory of SEZ is provided in accordance with the provisions of the customs legislation of the Customs Union and the Republic of Kazakhstan
11. The customs procedure of customs-free zone is applied on some territories of SEZ, where priority activities will be carried out.
The customs procedure of customs-free zone includes goods intended for distribution and (or) use on the territory of SEZ by persons carrying out priority activities on the territory of SEZ in accordance with the agreement on activities performed as a member of SEZ.

12. The territory of SEZ is a customs control zone. The boundaries are built up along the perimeter of the territory of SEZ where the customs procedure of customs-free zone is applied in accordance with the customs legislation of the Republic of Kazakhstan to perform the customs control.

13. Places for temporary storage of goods can be created on the territory of SEZ in accordance with the procedure as provided for by the customs legislation of the Customs Union and the Republic of Kazakhstan.
14. Goods included into the customs procedure of customs-free zone, and goods of the Customs
Union, not included into the customs procedure of customs-free zone, and foreign goods included into other customs procedures can be distributed and used on the territory of SEZ.
15. Goods imported into the territory of SEZ and included into the customs procedure of customs-free zone shall be considered as goods which are outside the customs territory of the
Customs Union to use customs duties and taxes, and non-tariff regulation measures.
16. Customs operations related to temporary storage, customs declaration, customs clearance and release of goods, and customs control on the territory of SEZ shall be carried out in accordance with

the procedure as provided for by the customs legislation of the Customs Union and the Republic of
Kazakhstan.
5. Procedure on terms of stay of foreign citizens on the territory of SEZ
17. There is a procedure on terms of entry, exit, transit and stay of foreign citizens and stateless persons, and their vehicles on the territory of SEZ, established by the legislation of the Republic of
Kazakhstan and international treaties ratified by the Republic of Kazakhstan.
6. Final Provisions
18. The conditions provided by this Regulation may be changed by the Decree of the President of the Republic of Kazakhstan.
19. SEZ shall be abolished for reasons provided by the Law of the Republic of Kazakhstan of
July 21, 2011 "On special economic zones in the Republic of Kazakhstan".
20. The procedure on SEZ abolition is carried out by the Akimat of Astana.
21. When SEZ is abolished due to expiry of the term it was created, the Akimat of Astana shall:
1) make an announcement through the media about the upcoming abolition of SEZ, procedure and deadlines for applications and claims related to its abolition no later than three months before the expiry of the deadline;
2) provide an explanation for legal entities and individuals operating on the territory of SEZ about reissue of goods under another customs procedure on its territory;
3) submit to the President and the Government of the Republic of Kazakhstan a report on SEZ performance results within one month after the abolition of SEZ.
22. In case of early abolition of SEZ, according to the Decree of the President of the Republic of
Kazakhstan, the procedure shall be completed no later than six months due to procedures as provided for by the Item 21 of this Regulation.
23. SEZ activities not regulated by this Regulation shall be conducted in accordance with the current Law of the Republic of Kazakhstan.

* - Indicators performance is shown on a cumulative total; during calculation the following exchange rate is used: 1 USD - 147 tenge.
** - The amount of production of goods and services (works) on the territory of SEZ is less than the amount of total investment, due to the fact that the amount of external investments is specified on a cumulative total since the date when SEZ was created (2002), and production of goods and services
(works) is specified according to the running industries since 2010. Today, there are 7 enterprises,
16 facilities under construction and 27 projects at the design stage.
According to the industrial park No. 1 of Astana the total investment is 135,774 million tenge, and production will be 175,720 million tenge per year after enterprises perform the designed capacity.
