STUD SERVICE CONTRACT
_Terence R Farley and John P Dejo __, Owner(s) of the stud dog, kennel name _Farleys D Standard__ and,
___________________________________________, Owner(s) of the bitch, kennel name _______________________________,
Address: _____________________________________________ hereby enter into the following contract for mating of two dogs,
namely: The stud: ___________________________________________________ AKC reg. # ___________________________, and
The bitch: _________________________________________________________ _AKC reg. # ____________________________, at
bitch’s next heat, approximately between these dates ____________________________, at kennel of stud owner(s) unless otherwise
indicated herein. The owners of the stud dog and bitch described above agree to be bound by the following terms and conditions.
The stud fee is $ 1,600.00 US dollars and is to be paid when the bitch is delivered by its owner(s). The breeding provided is to be
performed by a natural breeding. Two breedings will be attempted. In some special situations an artificial insemination will be provided.
The stud fee is in no way refundable. If the bitch fails to conceive, a return service at no charge will be given to this bitch provided the
owner(s) of the bitch notifies us within fourteen days after the projected whelping date that no puppies were whelped, or just two live
puppy, then a free stud service to the original bitch, or a mutually agreeable bitch, at a mutually agreeable time will be arranged. Two
live puppies constitute a litter. The bitch owner(s) are responsible for all costs that pertain to breeding under this contract, which
includes, but is not limited to veterinarian, shipping, and transportation expenses. There is no charge for boarding the bitch for the first
seven days, then the charge will be $12.00 per day. This fee includes food, water, and exercise.
The following are requirements that the bitch’s owner(s) must provide and conditions the bitch must meet prior to being bred:
The bitch must be at least two years of age or has had at least one heat prior to breeding.
A progesterone test performed to obtain optimal breeding dates prior to delivery of the bitch for breeding.
Brucellosis test results dated no more than seven (7) days before breeding.
Any history of health problems must be disclosed by bitch owner(s) to the stud dog owner(s) prior to the breeding being performed.
These being, but not limited to, any prior season abnormalities, mating difficulties, pregnancy or birthing problems.
Bitch’s owner(s) will provide the stud dog owner(s) with the bitch’s AKC registration papers, pedigree, a copy of most recent CERF
certificate, and other certificates previously agreed upon.
Bitch’s owner(s) must consult with their veterinarian and make sure that the vet considers the bitch good criteria for mating.
The bitch must be of sound, stable temperament.
Any medical information available in case an emergency arises.
The bitch should be groomed, bathed, and dipped before she is shipped to us to be bred.
The bitch owner(s) certifies that the bitch being bred is actually the dog noted above and the bitch owner(s) will provide necessary proof
by DNA if there is any question of parentage of the litter.
The owner(s) of the bitch warrant that the bitch has not been exposed to any stud dog prior to her arrival and that they will protect her
from exposure upon her return home.

In order to assure of pregnancy condition of the bitch, the right to see and examine her is granted to stud owner(s).
At no time can the bitch owner(s) give away or sell any show or breeding prospect, all or in part, without discussing with stud owner(s)
(All or part includes co-ownership with another party.) The bitch owner(s) will disclose any puppy back agreements resulting from the
potential litter prior to breeding. The stud dog owner(s) will not agree to any puppy backs unless the express written consent is provided
as an addendum to stud dog contract.
The bitch owner(s) agrees that stud dog owner(s) retain first right of refusal to purchase outright any show or breeding prospect
offspring from this breeding at a reasonable price of a show or breeding prospect Havanese that the bitch owner(s) do not keep. This
amount is not to exceed $1,600.00 US dollars. The bitch owner(s) agree the owner(s) of stud reserve the right to name any puppy(ies)
bought under first right of refusal.
In the event any pet/non-breeding quality puppies result from this breeding, the bitch owner(s) agree to sell all pets on a written
non-breeding contract. Pet quality puppies that are sold or placed must be sold or placed on an AKC limited registration, and the
breeder must withhold registration papers (copies could be given to the buyer to abbey by AKC regulation) until proof of spay/neutering
is provided from the buyer, unless the dog is sold already spayed or neutered. The bitch owner(s) agree not to breed any pet quality dog
from the results of this breeding.
The bitch owner(s) agree not to transfer ownership of the bitch or lease the bitch until after any litter is born. In the event of death of the
bitch owner(s) this agreement shall be binding on the heirs, successors, and assigns of each party.
If stud dies, is sold, or otherwise not available, owner(s) of stud has the right to mate the bitch with one of their other studs, their choice,
unless both parties agree mutually on another choice.
If bitch changes ownership, right of full return service is at stud owner’s option.

It is specifically agreed that the owner(s) of the stud is not obligated to sign application for registration of this litter until and unless the
stud fee has been paid in full (or, in case of puppy fee, the stud owner(s) have gotten possession of puppy or puppies as agreed),
unless stud owner(s) wish to waive this right without release of any other right or privilege.
It is agreed further that any puppies acquired from this breeding shall not be sold, traded or given to any pet shop, puppy farm or dog
dealer (buyer of puppies in litter lots).

If any provision of the agreement is or becomes void or unenforceable by force or operation of law, the other provisions shall remain
valid and enforceable. This agreement is to be construed under the laws of the state of Pennsylvania or the state the stud owner(s) are
currently a resident in. Any action or proceeding brought by any party concerning a dispute arising hereunder shall be brought to court
of competent jurisdiction located in Pennsylvania or the state the stud owner(s) are currently a resident in.

Each party hereby acknowledge that she/he had an opportunity to review this agreement, including the opportunity to consult with an
attorney if she/he so chooses and that this agreement is entered into knowingly, voluntarily, and an understanding of the terms hereof.
No party has relied on any representation other than the terms of this agreement.
Any and all changes or amendments to this agreement must be in writing and signed by both parties in order to be enforceable.
