Horse Play at Mesquite Ranch (HPMR) has agreed to provide equine assisted therapy and/or
learning activities and/or riding lessons for the students, clients, volunteers, and staff of
__________________________________________________________ (name of organization)
These services will be provided on the premises of HPMR or other locations deemed appropriate
by the parties. The activities involve interaction with horses and may include both mounted and
ground work by the participants. The activities are designed to be within the capabilities of
anyone who is in reasonably good health. There is an inherent risk to physical or emotional
health in the activities even though safety will be monitored by the equine professional.
Participation in the activities is an express acceptance by the undersigned of those risks. This
acceptance is confirmed by acknowledging the release of liability agreement below by the
participant and the participant’s parent/guardian if the participant is under eighteen (18) years of
age.
Participant Release of Liability Agreement
I, _________________________________________________ (participant) for and in
consideration of the agreement of HPMR and their affiliates, do hereby forever release,
acquit, discharge and hold harmless HPMR owners, affiliates, volunteers, trustees,
successors and assigns from all claims, demands, and damages of every kind and nature
whatsoever, which the undersigned and/or minor may now, or in the future, have against
them on account of any personal injuries, physical or mental condition, known or
unknown, to the undersigned and the treatment therefore as a result of, or in any way
growing out of or resulting from the acts of HPMR owners, or their affiliates, volunteers,
trustees, successors and assigns, including, but not limited to their negligence or gross
negligence, in rendering the services described above or in any way incidental thereto.
Incorporated herein by reference is Texas Law set forth in Chapter 87, Texas Civil Practice and
Remedies Code, which describes limits of liability of equine professionals from the inherent risks
of clients involved with and being around horses.
