Title: Location: Organization: Senior Licensing Officer – Compliance Victoria Consumer Protection BC PROGRAM The Business Practices & Consumer Protection Authority (BPCPA), dba Consumer Protection BC, is responsible for delivering consumer protection services throughout British Columbia to promote fairness and understanding in the marketplace, and administers any Act delegated to the Authority to protect the public interest. PURPOSE OF POSITION The Senior Licensing Officer (Compliance) conducts paper-based reviews of businesses to ensure compliance with legislation, policies and procedures. Compliance reviews are initiated as the result of license applications and renewals, complaints and other avenues, and the position is required to apply principles of administrative fairness in the examination and approval of documentation. The position is also responsible for monitoring the day-to-day activities and providing business expertise to Licensing Officers, and acts as a focal point for complex and unusual issues related to licencing of all regulated business sectors. NATURE OF WORK AND POSITION LINKS The Operations unit is responsible for the registration and regulation of a range of consumer industries, including the licensing, inspection and investigation of a broad spectrum of businesses to ensure compliance with legislation, and investigation of complaints and alleged civil violations of the Business Practices & Consumer Protection Act, the Cremation, Interment and Funeral Services Act, and the Motion Picture Act. Licence applications can often be complex and range from multi-national companies to single owner proprietorships. The incumbent must have a clear understanding of various business organizational structures, including the ability to assess corporate documents including contracts, agreements, ownership and voting structures. The position reviews and assesses a variety of documents related to real property including leases, options or offers to lease, certificates of land titles, management contracts and trust agreements and also reviews court orders related to bankruptcy, receivership, legal disputes and the death of a licensee. The Senior Licensing Officer (Compliance) is expected to be a subject expert and maintain a strong working knowledge of a variety of different acts and regulations, including (but not limited to) the Business Practices and Consumer Protection Act, Travel Industry Regulations, Debt Collection Industry Regulations, Telemarketing Licensing Regulations, Cremation, Interment and Funeral Services Act and Regulations, Motion Picture Act and Regulations, and any other statutes delegated to the Authority. The position is also required to know applicable parts of other legislation such as the Business Corporations Act, Land Titles Act and the Vital Statistics Act. Position links include: Manager of Licensing: keeps manager informed and escalates the most complex/unusual case files and/or requests advice and direction. Compliance and Enforcement: keeps Managers and Director informed and escalates compliance reviews that require more in-depth and/or on-site inspections. Licensing Officers: provides guidance and support pertaining to daily licensing activities and protocols along with interpretation of the various acts. Applicants: requests clarifying/missing information; explains licensing procedures and legislative requirements; explains the reasons for refusal to register or renew and advises them on their alternatives. Corporate Registry, Land Title, Vital Statistics Agency, Historical and Archaeological Branches, Equifax, and other government agencies with whom the Authority has established information exchange protocols with respect to regulatory issues: exchanges information. General public: responds to more technical inquiries requiring interpretation and direction relating to applicable legislation, policies and procedures escalated from Licensing Officers. SPECIFIC ACCOUNTABILITIES / DELIVERABLES Compliance Reviews Receives from business, information regarding possible unlicensed activity. Investigates the complaints, allegations and alleged violations pertaining to the unlicensed activity and recommends more in-depth action through the compliance team. Reviews and assesses documents and information to determine compliance issues including reviews of business records, contracts, bylaws, legal filings, other documents, and recommends appropriate course(s) of action. Works collaboratively with the compliance and enforcement teams in the identification of trends, risks and issues management and recommends solutions for resolution. Prepares written summaries and recommendations justifying licensing compliance review decisions/recommendations. On behalf of the Manager, issues opportunities to be heard to businesses that may be in contravention of the Act or Regulations. Supports the Manager in the adjudication of issues that could result in imposition of conditions on a licence, or licence suspension\cancellation. Prepares licensing action documents in regards to late responses to renewals, financial statements and other licensing requirements. Monitors responses to requests, issues warning letters and assesses regulatory penalties. Prepares issue reports for Manager for statutory licensing decisions; preparing related correspondence. Investigates “expired” lists (businesses that have not renewed their licence) to determine reason for nonrenewal. Initiates and conducts investigation if business is still active. Determines penalties or other course(s) of action. Evaluates special requests and grants extensions with regard to expiry dates and compliance deadlines. Reviews corporate and legal changes for licensing compliance. Engages with stakeholders, lawyers, applicants and other related agencies to gather information. Licensing Team Lead In conjunction with the Manager, develops, modifies, documents, communicates and implements administrative policy and procedures to assess and administer licensing applications and renewals. Provides interpretation on legislation, policies and procedures and ensures Licensing Officers are applying licensing criteria consistently. Communicates current program issues to Licensing Officers to ensure they are able to provide accurate information in response to inquiries. Reviews, analyzes and evaluates complex case files referred by Licensing Officers. Develops and delivers training to licensing staff and others. Coordinates production and distribution of related materials. FINANCIAL RESPONSIBILITY Assists Licensing Officers with financial procedures, receipting, and processing amending transactions such as refunds, overpayments, underpayments and adjustments. On behalf of the Manager, exercises authority to approve licence applications. Recommends suspension/cancellation of a licence or the imposition of conditions on a licence. Exercises discretion on applying fees and waivers. SPECIAL REQUIREMENTS Required to pass a criminal record check SELECTION CRITERIA Education/Experience University graduation in a related field (e.g. Business Administration, Public Administration, Criminology) and several years related experience in a complex licensing environment or equivalent combination of education and experience. Experience reviewing financial and legal information pertaining to businesses. Team lead or supervisory experience. Knowledge Knowledge of on-line data systems, word-processing, spreadsheet and database applications, e-mail and the Internet. Knowledge of the spirit and letter of consumer legislation. Working knowledge of the principles of administrative law.
