DESCRIPTION OF DOG The dog sold pursuant to this agreement as follows: Whelped:_______________________ AKC/DN#:______________________ Sex: __________________________ Breed: German Shepherd Dog Microchip#:______________________ Color:___________________________ 2. INTENT It is my firm intent to produce only quality dogs free of genetic defects. My primary goal is to produce dogs which are a credit to the breed and to place them in homes where they will receive excellent physical and mental care. This contract outlines the rights and responsibilities of the Breeder and the Buyer. The Breeder/Seller will refer to Kimberly Baker-Ewald of Ewald’s Wolf Den German Shepherds, and the Buyer will refer to the owner/purchaser of the puppy whose name appears on this contract and on the AKC registration papers. 3. SELLER’S REPRESENTATION – STIPULATIONS – CONSIDERATIONS a.) The following representation and conditions apply to the aforementioned puppy/dog: Seller guarantees that puppy/dog is free of life threatening diseases or illnesses at time of transfer to Buyer and date of this contract. b.) The Buyer has 72 hours after date of contract to have the puppy/dog examined by a licensed Veterinarian. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health and has a life threatening disease or illness, then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the seller for a replacement puppy of equal quality, if available, at the discretion of the Seller; or for a refund of the cost of the puppy if no puppy of equal quality is available from the Seller. If the Buyer elects to return the puppy/dog, Buyer shall within 7 days after the date of the signing of this contract, send to the seller by certified mail, a written Veterinarians certificate stating that the puppy/dog was ill when examined and a detailed explanation of the nature of the disease or illness, along with a second written certificate by a different Veterinarian in a different office, stating the same. Upon the receipt by Seller of said certificates, Buyer shall be obligated to return the puppy/dog and will be given a total of two weeks to do so, from the date Seller receives the vet certificates. The Seller shall then be obligated to replace the puppy with a puppy of equal quality, if available, at the Seller’s discretion, or refund the purchase price of the puppy, if a puppy of equal quality is not available, and further performance under this contract will be null and void. Furthermore, if the Buyer shall refuse to accept a replacement puppy of equal quality when offered and available by Seller, or to comply with all of the requirements set forth in this contract to receive a replacement or refund, the Buyer forfeits all claims and the Seller shall in no way be legally obligated to provide a replacement or refund. All action taken to return puppy/dog shall be done with the best interest of the puppy/dog in mind. Buyer shall be solely responsible for all costs and related expenses of returning the puppy/dog to Seller and receiving a replacement, if available. Shall the Buyer decide to keep the puppy/dog he/she forfeits any and all claims for monies or replacements to be issued or refunded. c.) Ownership of the puppy/dog will be transferred to Buyer for the sale price of ($850) LIMITED AKC Registration. It is to be paid as follows: a non-refundable deposit in the amount of ($250) within 2 weeks from the date of whelp of the puppy, and the remaining balance to be paid on or before the puppy/dog leaves Seller’s premises. The deposit is ONLY refundable if the puppy dies or becomes sick with a life threatening disease or illness, or becomes injured in such a way that the puppy is no longer of the health and quality at the time of deposit AND if there is no other puppy of equal quality available in place of the original puppy chosen by the Buyer. If the balance is not paid within 30 days of the pick-up date of (_________) for the puppy, this Contract shall be cancelled and the Buyer forfeits the deposit given hereunder. The Buyer shall transfer the non-refundable deposit to a different litter in certain circumstances, i.e. death or injury of the puppy, within a 12 month period; after the 12 month period and if the Buyer has not agreed to another puppy, the deposit becomes non-transferable and non-refundable. d.) Breeder prefers for all puppies/dogs to be taken possession of by Buyers in person. If Buyer and Seller agree to transport a puppy/dog, it will be done at the sole expense of the Buyer and by Ground Transport ONLY. Any other arrangements must only be made with prior written consent of the Seller and mutual agreement between Buyer and Seller. e.) Buyer agrees that the Seller will register the puppy (in the Buyers name) with AKC the day the puppy is picked up and paid for in full, and Seller will be responsible for the fee associated with such registration. IF the Buyer has chosen a name that he/she would like for the puppy/dog, he/she MUST inform the Seller of the name PRIOR to the Seller registering the puppy. ALL puppies in the litter will carry the prefix “Von Ewald Wolfsbau”; no exceptions. Seller will provide Buyer with a receipt/proof that registration is complete. The Registration Certificate will be sent directly to the Buyer via AKC. Extra options via AKC such as AKC Pedigrees, AKC newsletters or magazines, etc are the responsibility of the Buyer to purchase if the Buyer chooses to do so. f.) Buyer agrees to be responsible for the fee associated with transferring the puppy into his/her name thru the AKC (American Kennel Club). g.) Seller is NOT responsible for puppies/dogs that contract viruses or get injured or expire through no fault of the Seller. If it is determined that the Buyer or someone whom the Buyer exposed the puppy/dog to is at fault for the puppy’s injurious condition, illness, or fatality, even WITHIN the 72 hour grace period after purchase, this contract is null and void. h.) This contract applies to the original puppy only and is nontransferable to a second party. MAINTENANCE a.) Buyer agrees to maintain this puppy/dog in good health and provide routine preventative health care including but not limited to, vaccinations, internal and external parasite control, and routine checkups/exams. b.) Buyer further agrees to provide proper exercise to maintain this puppy/dog in proper weight and physical shape, a Veterinarian recommended diet and supplements, as needed. c.) Buyer agrees that he/she is solely responsible for any and all Veterinary bills incurred for this puppy/dog at the date of signing this contract. d.) Buyer agrees to maintain preventative care of the puppy/dog in regards to possible injury and disease/illness to the puppy/dog including but not limited to, allowing the puppy/dog to jump from heights taller than itself, no forced exercise such as running until at least 18 months old, no over exercising, no riding in the back of an open bed pick-up or allowing puppy/dog to hang its head out of the window while vehicle is moving, no contact on common ground such as dog parks or any other area frequented by dogs until at least the third Parvo vaccination is completed, and no running loose unsupervised. e.) Buyer agrees to have puppy/dog spayed/neutered by no later than 16 months of age with Limited AKC Registration. f.) Buyer agrees to never chain the puppy/dog outside or keep the puppy/dog outside in a kennel. The Buyer agrees to make this puppy/dog a member of his/her family INSIDE the home. g.) Buyer agrees to provide all necessary training, grooming, and socialization for puppy/dog. TEMPERAMENT a.) Seller strongly recommends that Buyer attend obedience classes with puppy/dog and provide socialization opportunities for puppy/dog with as many different people, animals, and places as possible. b.) Seller shall not be held responsible for acts of puppy/dog which are due to Buyers negligence. This includes but is not limited to, property damage, or personal injury. c.) Seller shall be available via contact information above to answer questions or provide tips and advice on behavior issues or training to the best of her knowledge, as needed. GENERAL a.) Buyer agrees to allow Seller the right of refusal should Buyer decide to sell, relinquish, or transfer puppy/dog. Furthermore, the Buyer agrees to NEVER sell/give/trade/transfer this puppy/dog to any large commercial breeding establishment, any agent, any wholesaler, shelter, rescue, humane society, or any other person(s) without first contacting the Breeder. b.) Buyer agrees that in the event he/she is no longer able to keep puppy/dog, whether temporarily or permanently, Buyer will contact Seller to 1.) Make arrangements to have the Seller, if able, to house the puppy/dog until Buyer is able to have the puppy/dog returned to them, or find another suitable home for puppy/dog, or 2.) Make arrangements with the Seller to help the Buyer find another suitable home for the puppy/dog. c.) In the event that the puppy/dog is returned to the Seller, Buyer MUST also return all paperwork, including AKC Registation, vet records, and worming records. d.) Buyer agrees to inform Seller of any address changes or changes in contact information within 1 week of such change. e.) If the Breeder witnesses or suspects any neglect and/or abuse, the Breeder will take immediate action to take possession of the puppy/dog and the Buyer will sign off on the AKC registration papers. The Breeder will be responsible for the AKC transfer fees. f.) Buyer agrees to update Seller about puppy/dogs progress periodically and gives Seller permission to use any photos or testimonials on Sellers website for the benefit of visitors to see what is produced at Ewald’s Wolf Den German Shepherds. If any of the above conditions are not met by the Buyer, or the puppy/dog has sustained trauma, has received poor nutrition, or is bred, the Health Guarantee provided below is null and void. HIP AND HEALTH GUARANTEE a.) Seller guarantees said puppy/dog to be free of hip dysplasia for 36 months, or 3 years, from the whelp date of puppy/dog. If the puppy/dog is found to have crippling hip dysplasia by the age of 3 years thru OFA or Pennhip, the Seller will replace the puppy/dog at no charge to the Buyer. The replacement puppy/dog will come from the next AVAILABLE litter, at the Seller’s discretion and will be of comparative quality. If there is any evidence of trauma or injury to puppy/dog through fault of the Buyer, this contract is void. Seller shall demand written documentation from OFA, Pennhip, and/or Buyer’s Veterinarian, along with X-rays to request a second opinion, BEFORE a replacement puppy/dog will be considered. NO monies will be refunded. Buyer shall choose to keep the first puppy as well, or return it to the Breeder at Buyers expense. b.) Seller agrees to provide a record of puppy/dogs vaccinations, worm schedule, and Veterinarian Health Certificate. c.) Seller guarantees said puppy/dog to be free of hereditary health problems for 36 months, or 3 years, from the whelp date of puppy/dog. Documentation MUST be provided by a licensed Veterinarian that states the puppy/dog will not live a normal life due to an inherent disease or illness, before Seller will consider a replacement puppy/dog. Seller shall demand a second opinion from another licensed Veterinarian before a replacement will be given. NO monies will be refunded. d.) Seller agrees to Microchip said puppy/dog at Sellers expense and put Microchip contact information in Buyers name with Sellers contact information as secondary. e.) The puppy/dog will be immunized by the Breeder for common canine diseases as appropriate for the age of the puppy. The Buyer is responsible for subsequent vaccinations. Failure to properly vaccinate the puppy/dog will render this contract void. Proof of vaccination may be required by the Breeder. f.) Buyer is responsible for routine and necessary licensed Veterinarian care from the date of ownership. If the health of the animal is compromised due to physical neglect, lack of or withholding of Veterinary care, this contract is void. *Buyer agrees that he/she understands and fully agrees with this contract, will comply with this contract, and that this contract is under the jurisdiction of the State of Michigan, Montcalm County. *Buyer agrees that said puppy/dog appears in good health and acknowledges receipt of said animal. *ANY CHANGES MADE TO THE CONTENT OF THIS CONTRACT MUST BE MUTUALLY AGREED TO BY THE SELLER AND BUYER AND MUST BE INITIALED BY BOTH, SELLER AND BUYER ADDITIONAL COMMENTS, TERMS, COMMITMENTS, ETC.
