2. In case the bounden fails to execute the agreement as aforesaid incorporating the
terms and conditions governing the contract the Bank shall have power and authority
to recover from the bounden any loss or damages caused to the bank by such breach
as may be determined by the Bank appropriating the moneys inclusive of earnest
money deposit or/and any kind of security furnished by the burden and if the money
or security is found to be inadequate, the deficit amount may be recovered from the
bounden and his properties movable and immovable and also in the manner
hereinafter contained. The bounden will have no claim or right over the moneys
and / or securities and earnest money appropriated by the Bank and those moneys
or/and securities shall belong to the Bank.
3. All sums found due to the Bank under or by virtue of this agreement shall be
recoverable from the bounden and his properties, movable under the provisions of the
Revenue Recovery Act for the time being in force as through such sums are arrears of
land revenue and also in such other manner as the Bank may deem fit.

The work should be carried out as directed by the Bank officers at site.
The tenderer shall study the site condition thoroughly before the submitting
tender.
The work shall be commenced immediately on receipt of work order and after
executing an agreement with the Bank in the proper form and completed in all
respects with in a period of 30 days from the date of award of work.
The contractor shall be responsible for the safety of the labours engaged by him
for the work.
As per the contract labour (Regulation and Abolition) act 1970, all contractors are
bound to carry out any excess quantity as may be found necessary during actual
execution of work at the same quoted rate.
As per the contract (Regulation and Abolition) Act 1970, all contractors are bound
to maintain muster rolls, wage register, attendance register and contractors are
bound to produce the said registers for verification of the Bank authorities in
charge.
Any failure to comply with the above instructions will result in the cancellation of
contract and the work shall be arranged at the risk and cost of the contractor.
The contractors shall be governed by the laws of India and Kerala for the time
being in force and be subjected to the jurisdiction of the court at Idukki.
All the items of work shall be executed strictly in accordance with the
specifications as per ‘Schedule A’ of the tender and as directed by Bank Officers in
charge of the work.
The contractor has to pay income tax as per the finance bill for the current
financial year on which the payment is made.
Work including concrete, steel, truss work are should be in accordance with IS
code specification.
Proper mandatory test result of following items from competent authority should
be submitted before site execution.
(a) Mix design (b) Cement (c) Steel (d) Bricks (e) Aggregate (Sand and Metal)
Any amount equivalent to 1% of the contract amount will be recovered from the
bill towards contribution to the Kerala Construction Workers Welfare Fund as per
the Kerala Construction Workers Welfare Fund Act, 1989.
All other conditions are as current in Kerala PWD.

SPECIFICATIONS
PART I – GENERAL
(1)
The rates tendered by a contractor for the works shall include the cost of:
(a)
All labour and supervision thereof, all materials, tools, implement and
plant of every description, ladders, cordage, tackle etc. as well as the
provisions of safe and substantial scaffolding required for the proper
execution of the work in conformity with the specifications for the various
items of work.
(b)
Supplying the requisite agency with necessary equipments to set out the
works as well as to afford facilities for such examinations of the work as
the departmental officers may at any time, consider desirable as also to
count, weight and assist in the measurement, or check measurement of
the work or the materials.
(c)
Providing and maintaining all temporary fences, shelters, lights,
watchmen and danger signals and such other precautions as are necessary
for the protection of the work or materials as well as to protect the public
and those connected with the work from accident at the site of or, on
account of the work.
(d)
All Shed’s mortar mills and mixing platform of every kind required for the
proper execution of the work according to the specifications.
(e)
All fees and royalties of materials and labour chargers etc.
(f)
Finally clearing away of all rubbish, surplus, materal’s plant etc. on
completion of the work of an dressing and leveling off and restoring the
site to a tidy condition prior to handling over the work to the General
Manager or his authorized assistant and also its maintenance until so
taken over.

(2)
In these case of supplies of materials such as rubble, broken stones
gravels, sand etc. which may have to be measured prior to being used on
the work the contractor must always stack, or arrange them neatly on
level ground or on ground cleared and leveled by him for the purposes in
such manner as may be ordered by the Officer-in-charges so that they may
be easily susceptible or inspection and measurement the cost of such
clearing leveling and stacking or arranging being included the rates for
work each stack much be straight and of uniform section throughout and
of the dimensions specified by the officer-in-charge. Materials not
stacked or arranged in accordance with instruction issued will not be
measured and paid for.
(3)
Contractor shall be bound to bear the expense of defence or any action or
law preceding that may be brought by any person for any injury sustained
owing to neglect of the above precaution in connection with the execution
of the work, and to pay any damages and cost which may be awarded in
consequence.
(4)
The contractor shall also help himself out of any difficulties or penalties
arising from interference with private property in the execution of the
contract.
(5)
The tenderer should state whether he has the plant necessary for the
execution of the work in the opinion of the General Manager.
Contractor’s own plant is neither sufficient nor suitable for the proper
execution of the work; the Bank may supply other available plant and
recover reasonable hire chargers. The General Manager’s decision in this
matter shall be final and binding on the contractor.
(6)
The contractor shall bear the running expenses inclusive of Bank staff
attached to such plant and cost of all repairs of all departmental plant
while in his possession on hire as also the cost of restoring the same in
good condition at the time of return due to allowance is made for wear
and tear.

(7)
All materials and plant that are to be made over to the contractor by the
Bank shall be handed over to him at the store yards of Bank Head quarters
and the charges for their handling, loading and unloading and conveyance
to and from the respective work as also for stacking the materials neatly
and in regular heaps on the ground or sheds to which they are brought
shall be deemed to be included in rates for the work.
(8)
Unless otherwise specifically provided for in the contract, the contractor
shall be at his own cost keep all portions of the work free from water,
whether due to spring soakage or inclement weather and in a neat and in
a sanitary condition and shall also see that drainage and sewage are
prevented from entering the site of the work or accumulating therein.
(9)
The contractor shall be responsible for the proper use and bear the cost
of protection of materials made over to him by the Bank of the use on the
work and bear any loss from deterioration or from faulty workmanship or
any other causes. The cost of materials thus allowed to deteriorate
amounting as it does to an excess issue over sanctioned quantities, will be
recovered at rates 20 percent over the actual cost. The orders of the
General Manager in the matter shall be final and binding on the
contractor.
(10) The contractor shall be responsible to see that level or other pages,
profiles bench marks, masonry pillars or other marks set up by the Bank
guidance in the execution of the work are not disturbed, removed or
destroyed if any such marks are, in the opinion of the Bank found
disturbed, removed, or destroyed they will be replaced by the Bank, at the
cost of the contractor.
(11) Any materials brought to the site of work, any work done by the
contractor but rejected by the Officer-in-charge as being not up to the
specifications shall in the case of materials supplied be then and there
removed from or rectified, at the expense of the contractor, as may be
ordered by the Officer-in-charge.

(12) In all cases whether so specified in the contract or not the work shall be
executed in strict accordance with the contractors accepted tender and
specification and with such further drawing and specifications and orders
as may from time to time be issued by the General Manager.
(13) Whenever the contractor is ordered by the General Manager or his
authorized assistant or subordinate to executive any items of work which
is not in the tender, it shall be the contractor’s duty to get a special price
arranged for the item and to see that is written in the work spot order
book (which shall be provided by the General Manager and kept on the
work by the subordinate in charge) and that this order is initialed and
dated by the contractor and the officer ordering that particular item of
work for any extra item executed by the contractor and not so entered in
the work spot order book and initialed both by the contractor and the
Bank Officer ordering such extra item the contractor shall have no claim
for extra payment.
(14) Payment for contractor should be as per the detailed Measurement Book
approved by a authorised Engineer.
(15) Any dispute or difference that may arise between the General Manager
and the contractor on account of contractor shall at the instance of either
party be referred to the General Manager whose decision given in writing
shall be final, conclusive and binding the General Manager may at his
discretion delegate in writing to any of this subordinate any of his powers
regarding these specifications.

1. SUBMISSION OF TENDER
Each tender should be accompanied by required earnest money deposit in
the form of Cash/DD of any of the Nationalized/Scheduled Bank and should
be in the name of General Manager, Idukki District Co-operative Bank Ltd.,
Idukki. Tenders without EMD will not be considered EMD/Security in the
form of Indira Vikas Pathra and bank guarantee will not be accepted.
2. Each tender should be accompanied by an agreement that in Kerala Stamp
paper worth `200/- duly filled and signed (Specimen copy of the agreement
is attached in the booklet). Tender not having duly filled and signed stamp
paper will be likely to be rejected.
3. WELFARE FUND
Welfare fund at the prevailing rate of contract amount less cost of Bank
materials will be recovered from the bill towards contribution to the Kerala
Construction Workers Welfare Fund Act 1989.
4. INSURANCE
Contractors are requested to insure their man, materials, machinery,
equipment and all other valuable materials at work site at his own cost, so
that any loss or damages due to act of God etc. can be taken up by the
contractor with the insurance company for setting their claims. The Board
will not certain any claims for compensation of this account and the
contractor quoted rate is deemed to be inclusive of these contingencies.
Clause E1.069 liability for damages to work or plant in printed General
Conditions will also hold good.

(5) SALES TAX
Recovery of sales tax and additional sales tax as applicable will be made
from contractors work will be as per current rules.
(6) EXECUTION OF AGREEMENT
Within 7 days of receipt of the letter awarding the work, the contractors
shall execute the agreement as stipulated in clause E1.008 of printed
conditions of contract, which stands modified to this extent.
(7) LIQUIDATED DAMAGES
The maximum recovery on account of liquidated damages will be limited
to 10% of the contract value including cost of Bank Superintendent
materials plus security deposit. This is in modification to the Clause E1.058
of the printed General Condition of Contract.
(8) If there is any delay on the part of the Bank supply the materials for the
work, no claim for extra payment of such delay will be entertained.
(9) The quantities provided in the schedule only approximate and the
contractor is bound to execute any quantity that may be required for the
satisfactory completion of the work at his quoted rate.
(10) TIME OF COMPLETION
The time of completion of the entire work is fixed as 180 days from the
date of award of work. The work of any urgent nature and shall be
executed strictly adhering to programme approved by the General
Manager.
(11) CONSTRUCTION MATERIALS
Materials required for the work such as rubber, comenrafters and runners
will be issued by bank at free cost and other materials for contract work
have to be furnished by the contractor at his cost.

(12) POWER SUPPLY
Power supply will be given to contractor at work site at one point upon
written request by the contractors at tariff rate prevailing at the time of
consumption of energy.
(13) The percentage rate quoted by the tenderer shall hold good irrespective
of the source of sand used for the work as per the specifications and shall
be inclusive of all charges for collection, processing, storing without
segregation etc.
(14) WATER
Water for mixing with cement mortar or concrete shall be cleaned
reasonably clear from all impurity water shall be obtained from the
sources approved by the General Manager, water required for the work
will have to be provided by the contractor at his cost.
(15) EXTRA ITEMS
The rates of extra items if any will be worked out based on 2013 schedule
of rates issued by the Public Works Department/Govt. of Kerala.
(16) RETENTION MONEY
The first sentence of E1.011 “Retention” of “General Conditions of
Contract” and instruction to tenderer is substituted the following
sentence.
“From each bill of the contractor @ 10% deduction will be made towards
additional security to cover the liability as far as the work in concerned.

(17) FINAL CLEANING OF THE SITE
On completion of the work, the entire area should be cleared and the site
handed over to the satisfaction of the General Manager.
