Yankee Newfoundlands C/O Joy & Kevin Lyons Black River, NY 13612 www.yankeenewfoundlands.com EMAIL: kevin@yankeednewfoundlands.com Puppy Purchase Agreement/Guarantee and Contract of sale for a Newfoundland Puppy This sales contract entered into this day of between Joy & Kevin Lyons (of Yankee Newfoundlands, hereinafter referred to as BREEDER), and (hereinafter referred to as BUYER) is done so freely by BUYER and BREEDER. In consideration of the purchase price (plus shipping when applicable) and all of the mutual promises contained herein, BREEDER promises to and hereby does deliver and agree to transfer ownership to BUYER of the following Newfoundland: Puppy Name Pet * Date of Birth Color Colors AKC# Sire Name Duncan Murphy AKC Registration # Dam Name Bevin AKC Registration # Gender Male Price of Puppy Prices ~PUPPY GUARANTEE Health: Breeder guarantees that, to the best of their knowledge, the puppy is in good health at the time of sale. BREEDER will provide first vaccinations and worming as well as an over-all health exam of said puppy between 6-7 weeks of age. All vaccinations/vet-care and exams past the age of 8-weeks along with current health records will be provided to the BUYER as well. BREEDER is not responsible for what happens to the puppy once the BUYER has possession of said puppy. The BUYER agrees to take the puppy to a licensed Veterinarian within three working days of purchase for evaluation. Should it be determined that the puppy is suffering from a serious hereditary condition clearly attributable to the BREEDER, the puppy must be returned within 48hours with a written veterinary statement of said hereditary condition at BREEDER's expense for a full refund (of said puppy only, less shipping related expenses) or a replacement puppy. The BREEDER reserves the right to confirming the diagnosis by a veterinarian of their choice prior to the return of the puppy. ~DYSPLASIA: The BREEDER guarantees the puppy against crippling hip dysplasia until 12months of age. As dysplasia is caused by a combination of genetic, nutritional, and environmental factors, it is not possible to guarantee against any dysplasia. If the dog develops crippling dysplasia within the first 12-months, the BUYER must notify the BREEDER in writing and provide a statement of diagnosis from two (2) veterinarians (at buyers expense), one of whom may be chosen by the BREEDER. A replacement puppy Yankee Newfoundlands will be provided according to the "Conditions of Replacement" listed below. The guarantee against dysplasia is null and void if the dog has not been maintained at a proper weight (defined as easily palpable ribs). ~CONGENITAL DEFECTS: The BREEDER guarantees the puppy against terminal congenital defects until the age of 12-months. In the event the dog is diagnosed with a terminal congenital defect, the BUYER must notify the BREEDER in writing and provide a statement of diagnosis from two (2) veterinarians (one of whom may be chosen by the BREEDER) at buyer’s expense. Statement must describe the defect of genetic origin and condition. A replacement puppy only will be provided according to the "Conditions of Replacement" listed below. ~CONDITIONS OF REPLACEMENT: In addition to the veterinarian's statements listed above, replacement conditions are as follows: 1.) The dog must not have whelped or sired a litter after placement with the BUYER. 2.) The original buyer must own the dog. 3.) The replacement puppy will be of approximately equal quality in terms of conformation (not limited to color.) 4.) All shipping costs on the replacement puppy are borne by the BUYER. Shipping costs may include, but are not limited to, Veterinary Health Certificates and vaccinations required for interstate travel, crate rental, or purchase, and actual shipping costs. 5.) The final decision to replace a puppy and the timing of such a replacement is at the discretion of the BREEDER. ~CONDITIONS OF SALE: * Our puppies are checked by our professional Veterinarian and have been deemed healthy at the time of sale. All puppies are sold on a trial basis of three working days, during which time the BUYER's veterinarian should check the puppy. No refund will be given for a returned dog that has suffered abuse or neglect. The BREEDER is committed to raising sound, healthy, loving Newfoundland’s. Our puppies are guaranteed against crippling due to hip-dysplasia (not due to injury, infection, or trauma), until 12-months of age. * BUYER shall assume full responsibility for the health of the dog. BUYER agrees to maintain the dog in good health at all times. The buyer agrees to provide the purchased/adopted puppy with exercise, food & water, current vaccinations and worming, shelter, and all other needs the dog may require for a healthy environment. Buyer is responsible for any expenses incurred with the purchase of the said Newfoundland. This includes but is not limited to shipping costs, veterinary fees, food, and supplies. Health Guarantee is not transferrable, and to apply, the original buyer listed in this contract must own said Newfoundland. Health Guarantee applies to purchase Yankee Newfoundlands Newfoundland pup only. * Replacement pups will be given as soon as possible, if Yankee Newfoundlands does not have puppies at this time, buyer will agree to wait until the next available litter for their replacement puppy. Once a replacement is selected, buyer will be responsible for transportation of the replacement pup. Health guarantee is not transferrable, and to apply, the buyer listed in this contract must own said Newfoundland. * If the BREEDER is selling this puppy on an AKC Limited Registration, AKC Limited Registration may participate in obedience trials, tracking tests, agility competitions, and water trials and drafting tests but may not be shown in Breed competition. BUYER agrees if receiving this Newfoundland puppy as a pet, the fee (includes limited AKC Registration), will be in the amount of is $1450. If The BUYER agrees that any willful failure to adhere to this contract will result in the release of the BREEDER from any and all guarantees and any further obligation under this agreement.
