Local Wildlife Site Record Information Request and Terms & Conditions Agreement Cheshire Wildlife Trust requests that you complete the following form before we can release the relevant data that we hold. Cheshire Wildlife Trust is committed to the conservation of the natural heritage. To this end, users of the Local Wildlife Site (LWS) Record are required to inform the Trust, in writing, of the purpose and location of their enquiry and the use to which the information will be put. This information is provided pursuant to section 141 of the Local Government Act 1972. Permission to use the LWS Record may be refused on the grounds of confidentiality or sensitivity, or if it were believed that access to the information would be detrimental to the natural heritage. A charge is normally made for commercial enquiries to the LWS Record, according to the quantity and detail of information required. This has been levied in order to cover the administration costs of performing a data search, as well as the maintenance and development of the LWS database. Charges may be waived for enquiries for personal research where the data will be used for non-commercial purposes. Cheshire Wildlife Trust reserves the right to vary these charges without prior notice and in response to any further increasing costs. The rates are: LWS basic search £50 + VAT minimum search fee per enquiry (or £70 + VAT per hour for complex search requests) Enquiry results map (pdf) showing names and locations of all LWS within the search area LWS detailed search £80 + VAT minimum fee per enquiry (or £100 + VAT per hour for complex search requests) Enquiry results map (pdf) showing names and locations of LWS, designated sites and priority habitats within your search area. A table listing LWS site name, location and reason for designation. By returning a signed copy of these conditions, users agree to pay the minimum search fee for a Basic Search. In the event of a search enquiry being cancelled, Cheshire Wildlife Trust reserves the right to charge for any work already undertaken. 2. Unless otherwise stated, the LWS Record is the copyright of the Cheshire Wildlife Trust and the Local Planning Authority. Data may only be used for the specific purpose for which it was originally requested and must not be disseminated to third parties, except within reports which constitute a part of the agreed reason for the original enquiry. Data must not be used for a different purpose without the written permission of these organisations. 3. While every effort has been made to verify information contained in the LWS Record, Cheshire Wildlife Trust cannot accept responsibility for the accuracy of any particular piece of information. Boundaries of sites should be considered as indicative and not definitive. 4. Users of the LWS Record will be expected to inform the Cheshire Wildlife Trust of new sites or information which may come to light as a result of their research. Copies of, or access to, the research is also to be made available. 5. Due acknowledgement of the LWS Record provided by Cheshire Wildlife Trust will be given in any publication or report which has made use of its data. 6. The request for LWS Record data cannot be stated to be a consultation with Cheshire Wildlife Trust on a particular development. 7. Cheshire Wildlife Trust does not hold comprehensive information on species records, protected or otherwise, as this is held by the local biological records centre. As such, Cheshire Wildlife Trust will only provide details of Local Wildlife Sites. This cannot be considered to be a full biological record search, nor does it exclude the presence of other biological records in the search area. 8. Cheshire Wildlife Trust accepts that there may be a requirement to treat certain enquiries with confidence. Equally, it is expected that users will not pass on information in an irresponsible or unethical manner. Signed: Name: Position: Date: Invoices to be paid within 30 days of receipt / issue. We aim to complete and send the results of an average enquiry within 10 working days from receipt of this signed agreement. If results are required urgently a surcharge may be levied. Non-adherence to these terms and conditions will be viewed as a breach of contract which may result in legal redress being sought. All data passed to a client by Cheshire Wildlife Trust is subject to these terms and conditions.
