Summary
This report recommends that high level design principles be adopted by NuGen for the
Moorside project because good design will be a key criterion of the Secretary of State in
deciding the application for a Development Consent Order. The responsible Workstream is
WS/05 DCO & TCPA Applications (‘Planning Workstream’), working closely with environment
and engineering. Since the principles need to have demonstrably shaped the evolution of the
design of the project they need to be agreed and incorporated as soon as possible into briefs
currently being drafted for instructions to engineers, architects and other professionals and
designers.

Introduction
The Secretary of State’s decision on NuGen’s application for the Moorside Development
Consent Order must be in accordance with the relevant designated National Policy
Statements (NPSs - these are principally the Overarching Energy NPS EN-1 and the Nuclear NPS
EN-6).
NPS EN-1 in particular makes strong reference to the need for good design. It also states:
“4.5.5 Applicants should consider professional, independent advice … the Design Council
can provide support for and encourage design review for nationally important schemes.”

In terms of what is meant by good design the NPS also states:
“4.5.1 The visual appearance of a building is sometimes considered to be the most
important factor in good design. But high quality and inclusive design goes far beyond
aesthetic considerations. The functionality of an object-be it a building or other type of
infrastructure-including
fitness
for
purpose
and
sustainability
is
equally
important…sustainable infrastructure sensitive to place, efficient in the use of natural
resources and energy…matched by an appearance that demonstrates good aesthetic as far
as possible.”
(Further relevant excerpts from the NPSs are attached as Annex I).
The Secretary of State’s own statements on planning and design matters can also become
“important and relevant” to the decision on the DCO. It is also notable, therefore, that the
new Secretary of State for Energy and Climate Change, Amber Rudd MP, stated in the
Independent on 5th June 2015 that:
“People in general want public structures to look good, as well as being functional. It’s not
a trivial thing, when you have a big infrastructure project that you put time, effort and
money into. We’re hoping to build new nuclear plants in the UK over the next few years
and I think it is a reasonable ambition to make sure that these big projects have aesthetic
appeal as well to help win the public over.”
In practice therefore promoters of Nationally Significant Infrastructure Projects such as
Hinkley Point C and Moorside are expected to submit evidence as to how these policies on
design have been addressed, usually in a design statement (which NuGen’s planning team are
currently considering how best to structure). Central to this will need to be NuGen’s
overriding design principles for the project. Inspectors appointed by the Secretary of State to
examine, report and make a recommendation to her on the decision will invariably ask what
the principles were, how they were arrived at and whether independent and professional
design review of the proposed design was carried out and how the review influenced the
evolution of the design.
This report explains the process so far adopted to develop high level design principles which
are recommended to the Board for adoption by NuGen to be incorporated into all briefs for
engineering, design and construction of the Moorside project. It needs to be remembered that
the DCO application will include not just the power station but also the landscaping scheme
around it (the landscape design will be highly important due to its proximity to the Lake
District National Park) and all the associated development residential, transport related and
otherwise.
By way of example Hinkley C Design Principles were established late in the day, after the
application had been made and caused some issues with timescales. They were as follows:
“Safety as the overriding principle
Development should be appropriate in size / configuration
Integration of development within existing rural environment
Development should be located close to the existing use
Durability
Order and quality – (including “… safe durable modern planning and architecture”)
Expressing embodied sustainability

NuGen Corporate Objectives
Consideration of the appropriate high level design principles begins with NuGen’s corporate
objectives as a leading nuclear energy company. These are:
“In progressing the Moorside project, our commitment is that we will:
• Put safety first in everything that we do
• Work in partnership with the local community
• Promote UK employment and skills
• Support supply chain excellence
• Align with Government policy and contribute to the national debate”

Other NuGen Objectives
A number of other commitments and objectives in relation to the Moorside project have been
published by NuGen and were heavily drawn upon in order to develop draft high-level design
principles. Specifically the commitments and objectives drawn upon were set out in the Stage
1 Consultation Document (key commitments are contained in Annex II) and the relatively
recently published NuGen Sustainability Strategy (Annex III).

Initial Conclusions
It is clear from the foregoing that NuGen needs to have established design principles which
can be seen to have guided (or at least been taken into account in) all its design work.
NuGen’s planning team includes professionally qualified and chartered architects, planners
and landscape designers who therefore developed draft design principles, drawing on NuGen’s
policies and other objectives as above. Design principles once adopted should form part of the
brief for any design work and commissions.
The first draft suggested that design principles on at least the following topics/along the
following lines were needed:
“Environment:
6.1 Protect and enhance the local habitats we are working in, avoiding adverse impacts
on the existing ecology, biodiversity and air, water and land quality
6.2
Promote sustainable use of natural resources, minimising emissions where practicable

6.3 Protect and enhance the local landscape and in particular the historic environment,
avoiding impacts on existing features, with landscape and overall design which responds to
the site’s coastal and Lake District setting
[NB. 6.1 to 6.3 are identical to those published in NuGen’s sustainability strategy].
Project Design:
6.4 Safety (as relates to the GDA) e.g. “Putting safety first in everything we do in design
and development”
- The use of passive cooling systems in the AP1000 Reactor design should probably feature
explicitly as part of this design principle.
6.5
Efficiency of accessibility, especially by rail
6.6 Building and site layout design which balances economic requirements with buildings
which are well designed in their landscape and seascape, and which are:
- ?? Expressive and positive OR landscaped and screened???
- ?? Architecturally functional AND/OR …???
- Durable and robust in providing for the life of the project on the main site and for legacy
uses where appropriate
- Good neighbours with a legible appearance to public view”

Development and Refinement of Design Principles
The above draft principles were approved in draft form by NuGen Head of Planning and
considered at the DCO Progress Meeting on 16th July 2015 (which included NuGen Head of
Environment and representatives from NuGen engineers working closely with Tractebel,
NuGen Site Manager, NuGen planning team members and NuGen’s DCO legal advisors Pinsent
Masons). The meeting resolved (as recorded in the minutes):
“PD and PaM believed the draft principles were appropriate and supported them being
used as presently drafted. The draft principles were AGREED but would be subject to
refinement.”
Feedback on the draft principles has also been requested from Westinghouse and other
colleagues within NuGen. Pinsent Masons, NuGen’s legal advisors on the DCO, have
recommended that the principles should not be definitive commitments but rather
commitments to “seek” to achieve certain outcomes where possible. NuGen is alive to the
risks here and some principles/objectives will be more definitive than others.
Subsequently NuGen engineering / Tractebel have been developing the Royal Institute of
British Architects (RIBA) Stage 0 “Ancillary Buildings Strategic Brief”. (The purpose of
contract Stage 0 is to “Identify client’s Business Case and Strategic Brief and other core
project requirements”). This document will include a short section on design philosophy
(Annex IV). The draft brief to date touches upon nuclear and non-nuclear buildings.
Taking into account feedback received from colleagues and to align as closely as possible with
the emerging design philosophy of the Tractebel Ancillary Buildings Strategic Brief, the design
principles have been refined and are now recommended as follows:

“Design principles for the Moorside Project on the Moorside Site, Associated Development
sites and in the wider environment:
7.1 Putting safety first in everything we do in design and development - each
building shall be designed to meet:
- UK statutory and regulatory requirements
- Current SHE standards
- Industry practice standards
- Site environmental requirements
Any activity related to nuclear buildings will be designed and conducted in
accordance with the safety case and all applicable regulations;
7.2 Seek to protect and enhance the local habitats we are working in, wherever
possible avoiding adverse impacts on the existing ecology, biodiversity and air,
water and land quality;
7.3 Promote sustainable use of natural resources, minimising emissions where
practicable, providing efficient access to/from the site particularly by
encouraging greater use of the railway with connectivity with coaches, buses,
cycling and walking, to encourage a modal shift from road to rail usage;*
7.4 Protect and where possible enhance the local landscape and in particular the
historic environment, avoiding impacts on existing features with landscape and
overall design which responds to the site’s coastal and Lake District setting;
7.5 Deliver permanent development which:
- physically appears attractive to the extent appropriate and possible in view of
safety, functional and economic considerations;**
- is designed to be seen and clearly expressed in its landscape and seascape, with
screening development from view the exception rather than the rule;
- is a good neighbour, wherever possible recognisably responding to its setting;**
- is durable with lifespans designed with legacy in mind where appropriate and to
meet CEEQUAL, BREEAM or LEED* sustainability** standards as appropriate, and
- considers the potential for future re-use of sites and buildings, including rail and
transport infrastructure, as a legacy of the project*.”
Phrases asterisked (*) have been published previously by NuGen as commitments in the
Moorside Stage 1 Consultation Document and are spelt out in the emerging design
philosophy in the draft Ancillary Buildings Strategic Brief.

Principles 6.2, 6.3 and 6.4, with the exception of words in italics, have been copied
from NuGen’s published Sustainability Strategy. It must be noted here that “to
enhance the local landscape and in particular the historic environment, avoiding
impacts on existing features” would be likely to be impossible in certain locations. The
best that may be able to be said is that some aspects of the local landscape and
historic environment would be enhanced and that impacts on some features could be
avoided. Provided this is achieved NuGen would have a strong case that it had both set
challenging design principles and sought to deliver upon them. Qualifying words to this
and similar paragraphs were therefore added (in italics); although these were
proposed by NuGen’s legal advisors, it is nonetheless considered that the Principles
remain stretching for NuGen and for its professionals and design teams.

Recommendation
The Board is recommended:
8.1 to adopt the design principles 6.1 to 6.5 for inclusion into all NuGen briefs for
instructions to engineers, architects and other professionals and designers (but noting
they may be subject to further refinement if necessary);
8.2 to include consultation upon the Design Principles in the Moorside Stage 2
Consultation in 2016, and
8.3 to determine whether it wishes to receive a further report following Stage 2
consultation addressing the need or otherwise to review or refine the Design
Principles.
8.1
ANNEX I - NPS DESIGN CRITERIA
Overarching Energy National Policy Statement EN-1 policies on good design:
“4.5.1 The visual appearance of a building is sometimes considered to be the
most important factor in good design. But high quality and inclusive design
goes far beyond aesthetic considerations. The functionality of an object-be it a
building or other type of infrastructure-including fitness for purpose and
sustainability is equally important…sustainable infrastructure sensitive to
place, efficient in the use of natural resources and energy…matched by an
appearance that demonstrates good aesthetic as far as possible.
….
4.5.3 In the light of the above, and given the importance which the Planning
Act 2008 places on good design and sustainability, the [SoS] needs to be
satisfied that energy infrastructure developments are sustainable and, having
regard to regulatory and other constraints, are as attractive, durable and
adaptable … as they can be …. In so doing, the IPC should satisfy itself that the
applicant has taken into account both functionality (including fitness for
purpose and sustainability)

and aesthetics (including its contribution to the quality of the area in which it
would be located) as far as possible. Whilst the applicant may not have any or
very limited choice in the physical appearance of some energy infrastructure
there may be opportunities for the applicant to demonstrate good design in
terms of siting relative to existing landscape character, landform and
vegetation…..
….
4.5.5 Applicants should consider professional, independent advice … the Design
Council can provide support for and encourage design review for nationally
important schemes.”
8.2
ANNEX II – NUGEN CONSULTATION COMMITMENTS
Nugen has also published a number of other project related objectives in a number of
consultation documents as follows:
“A key part of the strategy for delivering the Moorside Project is the use of sea
(for logistics) and rail transport (for logistics and workers), to minimise the use
of roads. The transport proposals and Associated Development Search Areas
referred to in this consultation reflect this approach.” P6
“The principal criteria for determining Search Areas [for AD sites] have been:
• for larger accommodation sites (up to 4,000 workers) - proximity to an
existing rail station or a railway line with the potential for a new rail
station;
• for smaller accommodation sites (up to 1,000 workers) - proximity to the
main road routes for coach transfers to the site;
• in, or adjacent to, a town or service centre to provide access to facilities
and support the local economy;
• proximity to the Moorside Search Area, to minimise travel times, and risks
of delays for the workforce during construction operations;
• Avoid significant environmental constraints and minimise impacts on local
communities.” P6
A key objective for NuGen is to deliver legacy benefits for Cumbria, to provide
lasting benefits for the local community during the construction and the
operational phases of the Moorside Project. Our approach reflects a desire to
utilise local resources wherever practicable, and where possible provide
benefits to local businesses and the local communities.

• Employment: Maximise the opportunities for local jobs, resulting directly and
indirectly from the Moorside Project during construction and operation, and
act as a catalyst for investment as part of the wider programme of nuclear
related projects. This is also an opportunity resulting from the Moorside
Project, for others to align their future investment decisions and business
planning.
• Skills & Training: Support local initiatives including the Centre of Nuclear
Excellence (“CoNE”) Skills Plan, Cumbria Local Enterprise Partnership (“LEP”),
and work with Universities, Colleges and Schools to provide appropriate
training and skills courses to equip the local workforce with the necessary
skills for both construction and operation.
• Supply Chain: Maximise opportunities for the local supply chain to be
involved during the construction and operation of the Moorside Project.
• Local Economy: Seek to locate NuGen’s construction worker accommodation
in or adjacent to nearby towns and local service centres, to integrate with
communities and to increase spending in local facilities, and create a platform
for future growth.
• Transport: Maximise the legacy of new rail facilities and services used by
NuGen during construction, to encourage greater use of the railway with
connectivity with coaches, buses, cycling and walking, to encourage a modal
shift from road to rail usage. Provide highway improvements to address local
capacity, road safety or traffic management issues arising from changes in
demand from the Moorside Project.
• Healthcare: Maximise support for local health care provision to meet the
requirements of the NuGen workforce during construction and operation, and
provide a legacy of increased capacity.
• Regeneration: Where possible maximise the potential for future re-use of
sites and buildings used by NuGen as Associated Development during the
construction period.
• Environment and Sustainability: Take a positive approach to sustainability
and creating habitats and environments, and opportunities to improve flood
defences and resilience.”
