This document is for inviting interested, experienced, competent and registered Companies/NGO’s/associations/Organizations/Institutes to submit their offers for operating static soil testing labs of Agriculture department on PPP mode or for conducting soil sample collection and analysis on PPP mode. 2. The information submitted in this offer in the enclosed formats shall form the basis of preparation, finalizing of techo-commercial details and the pre-qualification criteria for implementation of ISTP on lump sum rate and /or own cost of organization for operating soil testing labs (analysis of soil samples for fertility evaluation and preparation of soil health cards) for empanelment of Companies/NGO’s/Associations/Organizations/ Institutes. The organizations can operate any of the existing Department soil testing laboratories in the state.(List enclosed) 3. The Companies/NGO’s/Associations/Organizations/Institutes have to operate soil testing labs. The established soil testing laboratories will be operated on PPP module, in which complete laboratory set up will be handed over to the organization or equipment will be provided for establishment of soil testing laboratories for analyzing the soil samples provided by Dept of Agriculture or the private labs can analyze the soil samples of the department of Agriculture based on guidelines issued. The total analysis work should be completed within the time frame given by the department. Model-A: - A well developed soil testing laboratory with complete set up and building will be provided to companies / NGO’s / Groups / Societies/ Organizations/Institutes etc for operation and maintenance under a MOU. All operation and maintenance cost will be borne by the organization itself and the government would pay the analysis cost on competitive basis. Model-B: - The companies / NGO’s / Groups / Societies/ Organizations/Institutes etc will be provided soil testing equipment, they have to set up a lab and bear the operation and maintenance cost and the Government would pay the soil and water analysis cost on competitive basis. Model-C: - Samples have to be collected from field by the companies / NGO’s / Groups / Societies/ Organizations/Institutes etc and have to analyze the samples in their own labs. General information about the Project“With the intensive agriculture and high productivity due to the technological interventions deficiencies of nutrients are likely to increase and aggravate the situation. In order to keep close watch and vigilance it is essential that soil health cards are prepared for each farm house hold”. PUBLIC-PRIVATE-PARTERNERSHP Food security, Nutritional security, sustainability and profitability are the main focus of present and future agriculture development. The agriculture production for the one decade has either declined or static. Reason for these trends are attributed to continuous decline in organic matter content of soils, use of imbalanced fertilizer and not practicing the conjoint use of organic, bio-fertilizer, natural minerals with inorganic materials. Soil is the most basic and valuable resource vital for agriculture production. According to the available data on soil fertility, soils of the state have low microbial activities and poor soil organic carbon, deficiencies of Nitrogen, Sulphur, and Zinc is quite common on account of imbalance fertilization. At the present level of crop production and fertilizer use there is a huge gap between the quantity of nutrient removed by the crop and the quantity of nutrients added through fertilizers and manures in the state. Since the nutrient addition have never paced with nutrient removal by crops and cropping systems the fertility status of soils is fast declining in the state and we are facing problems of Multi-nutrient deficiencies. In long prospective this will seriously affect agricultural productivity and its sustainability. Maintenance of optimum soil environment requires a major attention so that chemical, biological, and physical aspects of soil environment respond optimally. No doubt the use of chemical fertilizers would remain the mainstay of agriculture production in future as well given the increasing food demand of growing population but at the same time balance proportion is required for use in an integrated manner. To obtain optimum production, it is essential to know beforehand the quality of the soil in which a crop is grown. The development and expansion of soil testing infrastructure in the state, in this context become absolutely essential and the department of Agriculture is given priority to it. The present scenario regarding the availability of soil health cards with the farmers is not satisfactory. The state has now one Regional soil testing laboratory, 16 District Soil testing laboratories, four Mobile soil testing laboratories and 15 Agricultural Market Committee STLs in government sector having capacity to analyze 2.0 to 3.0 lakh soil samples annually. 4 As per the Soil Health Card Scheme guidelines of Govt of India in AP 15.88 lakh samples need to be analysed over a period of three years and 77.00 lakh soil health cards are to be issued to farmers in order to cover all the land holdings in the state. For site specific farming under a micro farming situation it is difficult to handle such a vast area by a laboratory, whereas regular monitoring and testing is must in intensive agriculture system. The situation becomes more prone in intensively cultivated areas, where the required number of testing is much more. Supplemental efforts with plurality of institutions like NGO’s, Agri. business companies, corporations, corporate houses, groups etc can play a vital role in augmenting soil testing services to the farmers of the State. Soil testing is one of the most important tools to determine the status of plant nutrients in a field and quantity of fertilizers to be applied to obtain profitable crop yields. Sound soil testing programme is helpful in accessing nutrient supplying power of soil, crop response to added plant nutrients and amendment needs. Assessment and monitoring is an integral activity of any sustainable agricultural development programme, in turn it will necessitate the increased demand for real time information on resource. Promotion of balanced fertilization is important component of environment management in agriculture. It further reinforce the need for frequent soil testing. Monitoring for soil fertility, against depletion and accumulation of certain elements is possible through appropriate soil test. Soil testing has great significance to propagate the habit of precision farming in our farmers, such as application at point level based on results of soil testing. The Department of Agriculture is carrying out soil testing activities with following objectives1. To issue soil health cards to all farmers of AP in a span of three years, so as to provide a basis to include nutrient deficiencies in fertilizer application practices. 2. To diagnose soil fertility related constraints with standardized procedures for sampling and analysis and design village/mandal level fertilizer recommendations in all districts. 3. To develop crop specific nutrient management in the districts for enhancing nutrient use efficiency. 4. To promote soil test based balancing of nutrient application to manage fertility related risks for higher production. 5. To conduct demonstrations with diversified crops to quantify benefits of improved nutrient management practices in terms of increased crop yields and economic viability of farmers. 6. Development of linkages with extension agencies and STL’s for effective transfer of technology to farmers. 5 7. Data entry of village wise / mandal wise fertility status for preparation of GIS maps and for on line recommendations. Components: The main components of ISTP are as follows a. Creating awareness: Creating awareness among the farmers regarding importance of soil health and balanced fertilizer application. b. Collection of soil samples- Collection of soil samples and geo referencing through GPS (Global Positioning System) instruments. c. Transportation: Transporting soil samples to soil testing labs. d. Registration – The collected soil samples are registered in separate register. e. Sample coding: Laboratory serial number/ code number should be allotted to each and every soil sample received during the year. This number is unique for the year. f. Analysis of soil samples: The soil samples are analysed for below mentioned parameters. I. Qualitative parameters like: pH, EC, OC. II. Major Nutrients: Nitrogen, Phosphorous, Potassium III. Secondary Nutrients: Sulphur IV. Micronutrients : Zinc, Copper, Manganese, Iron and Boron g. Providing soil health information: After analyzing of soil samples in Soil testing Labs it is proposed to link the fertility status and crop specific nutrient recommendation of farmer to AGRISNET software in the form of Soil Health Card to all the farmers of AP. h. Village wise categorization of soil test data into soil fertility classes. i. Preparation of soil fertility maps of state, district, mandals, revenue villages in GIS environment. j. Record keeping : Record keeping of the analytical work, submission of progress report and soft copy of the categorization progress to the department. Partnership Defined The term Public Private Partnership in the present context in necessarily a collaborative effort between public & private Sector contributing for one or more function as required accomplishing a shared goal set out by the partners. In PPP module there is generally two parties’ i.e. first party, here is State Government and the second party that is Executing agency, which work together for shared goal set out by the partners based on the third factor that is “Coordination”. In the module there are certain objectives and activities born by the first party and certain expectations/activities would be carried out by second party. The important coordination factor comprises of normal set of rules, monitoring and supervision, conflict resolution, arbitration etc. Based on these factors, guidelines are framed and described in subsequent sections. 6 4. Task to be carried out by the organization Important: The Expression of Interest (EOI) is invited for operating Soil Testing labs on PPP mode or for conducting soil analysis on PPP mode. The Companies/NGO’s/Associations/Organizations/Institutes are supposed to operate soil testing labs. The established soil testing laboratories will be operated on PPP module, in which complete laboratory set up will be handed over to the organization or equipment will be provided for establishment of soil testing laboratories for analyzing the soil samples provided by Dept of Agriculture or the private labs can collect & analyze the soil samples of the department of Agriculture based on guidelines issued. The interested agencies/institutions can offer their EOI for any of the under mentioned three works or any one of them, but separate offer shall be quoted. Model-A: - A well developed soil testing laboratory with complete set up and building will be provided to companies / NGO’s / Groups / Societies/ Organizations/Institutes etc for operation and maintenance under a MOU. All operation and maintenance cost will be borne by the organization itself and the government would pay the analysis cost on competitive basis. Model-B: - The companies / NGO’s / Groups / Societies/ Organizations/Institutes etc will be provided soil testing equipment, they have to set up a lab and bear the operation and maintenance cost and the government would pay the analysis cost on competitive basis. Model-C: - Samples will be collected from field by the companies / NGO’s / Groups / Societies/ Organizations/Institutes etc and have to analyze the samples in their own labs. The Government would pay sample collection & analysis cost on competitive basis. Proposed Activity For increasing reach out of soil testing services to farmers the Government is aiming to establish a competitive participatory approach in the field of soil testing. The established soil testing laboratories will be operated on PPP module, in which complete laboratory set up will be handed over to the service providing organization for operating and Government would support the operating cost on competitive basis. The selection of the proposals received under EOI would be on competitive basis. The Commissioner & Director of Agriculture will have right to select the proposals and will provide funds for operation and necessary orders from time to time. The district Joint Director of Agriculture being district head , Assistant Director of Agriculture (STL), being Nodal Officer at district level will help in smooth operation and help to get associate with extension workers and farmers. The referring level lab and state level officers would review the operation system time to 7 time, where the organization head would present the progress and output of work on monthly basis. Scope of Work (Task to be carried out) This task refers to providing facility of soil test to the farmers of the State in participatory mode wherein the department of agriculture would provide STL to other partner for operation and maintenance of the unit or equipment for soil analysis or soil samples and other partner will provide soil and water test reports/ Soil Health Cards to the farmers and carry out village wise data classification as per the targets and methods/operation modalities/ roles and responsibilities mutually agreed. Objective – The main objective of the task is to operate soil testing labs of Agriculture Department on competitive participatory basis or to conduct soil analysis on competitive participatory basis. The established labs of the Department will be operated on PPP module, in which complete lab setup (Building and Equipment) will be handed over to the organization and Government would support part of the operating cost. In the Models given the organizations are expected to do the following activities 1. Operation and maintenance of the soil testing laboratory. 2. Collection of soil samples. 3. Analysis of soil and water samples of the area. 4. Preparation of results. 5. Providing soil health cards to farmers. 6. Village wise categorization of soil test data into fertility classes. 7. Record keeping of the analytical work, submission of progress report and soft copy of the categorization progress to the department. Systematic soil sample collection has to be followed and the geo reference of soil sample site to be made by using GPS instrument. The entire quality of soil testing results and fertilizer recommendations depend upon soil sampling. For this following scientific norms are prescribed; In irrigated areas, samples should be drawn in a grid of 2.5ha. In rainfed areas sampling should be done in 10ha grid. In irrigated areas, large, medium and semi-medium holdings should be sampled and tested holding wise. In case of marginal and small holdings sampling should be done in 2.5ha grid. In rainfed areas all the large holdings should be sampled and tested holding wise and in case of medium, semimedium, small & marginal holdings sampling should be done in 10ha grid. The ideal time for collection of soil samples is between harvest of one crop and sowing/planting of other crop, when fields are vacant. Soil Samples are to be collected before applying manures and fertilizers. The sampling depth for field crops should kept 15 cm. Sample has to be collected preferably with the help of stainless steel tube augur, or alternatively with a khurpi /spade or kassi. 8 GPS co-ordinates have to be essentially recorded at the time of soil sampling which will be downloaded in the SHC computer. The analysis of soil and water samples has to be done especially with reference to agriculture. Soil is analyzed in two ways i.e. Normal and Detailed analysis. In normal analysis of soils, estimation of pH, EC, organic carbon, Available Phosphorous and Available potash are detected whereas in detailed analysis micronutrients like Zinc, Iron, Copper, Manganese and Boron are also detected additionally. Water samples are to be analyzed for pH, EC, Carbonate, Bicarbonate, Chloride (anions) Calcium, Magnesium, Sodium, Potassium (Cations),SAR, RSC etc. In general each soil testing lab established and functioning under Department of Agriculture has capacity to analyze 10,000 to 15,000 samples per annum, however targets for analysis of soil and water samples are changeable year to year and fixed as per infrastructure and need of the district. The list of Laboratories which are to be operated on PPP module with respective referring lab is enclosed at annexure I. Roles and responsibilities Following committee will monitor and coordinate the programme from state levelCommissioner and Director of Agriculture, AP - Chairman Joint Director of Agriculture (Soil Correlator), AP - Secretary Professor, Soil Science and Chemistry, ANGRAU - Expert member Assistant Director of Agriculture (Soil Correlator), AP – Member I. The Joint Director of Agriculture (Soil Correlator) would be the nodal officer at the state level for the project. He is having over all responsibility for execution and smooth operation of laboratories. He will prepare guidelines and monitor the programme. He also issue instructions from time to time for better management. II- Deputy Director of Agriculture (RSTL)- Overall responsibility for execution and smooth operation of all labs in AP. III District Joint Director of Agriculture 1. The Joint Director of Agriculture will be Local head at district level and local controlling officer. 2. He will help in smooth operation and help to get associate with extension workers and farmers. 3. Act as coordinator between Department and organization. 4. All the functions operational work of the lab, results and soil health card distribution work will be regularly monitored and verified by the District Joint Director of Agriculture. IV Assistant Director Ag.(Regular) 1. The Assistant Director Ag.(Regular), Nodal Officer will be responsible for providing soil and water samples to the lab on regular basis area wise. 9 2. The Nodal Officer will also monitored the sample intake, result flow and soil health card distribution to farmers. 3. Nodal Officer will also be responsible for verification of soil health card distribution work. V Referring soil testing laboratory1. Corresponding referring laboratories will be mentioned at annexure I. 2. The referring lab will act as a guide in technical work, Analytical processes, Calculation and result works and in generating the recommendations. 3. These labs will also provide the technical matters as discussed in ZREAC, Regional Workshops, and Cluster Meetings to the agency that is operating the lab. 4. These labs will help in solving local technical issues. 5. Copy of literature, Formats, Procedures, Recommendation charts and other technical support will be provided by these laboratories. 6. Quality control of analytical works will be carried out by these labs and technical work will be checked by these labs from time to time. VI Implementing Agency1. Organization/ Implementing agency has to carry out all the operations right from sample receipt to analysis, results generation and sending of soil health cards to farmers and progress report to Department Authorities. 2. The agency is also responsible to maintain the lab Equipments and accessories in good condition. 3. For operating soil testing laboratories following major activities are to be carried out by the implementing agencies. 1. Receipt of samples- Implementing agency will be responsible for collection of samples, creating awareness among the farmers. Besides this, Soil and water samples would also be received directly from farmers, organizations, NGO’s, individuals, extension agencies etc. The organization would also act as a agency to popularize the soil testing in the area and always trying to create faith of soil testing in farmers and a testing demand pull. 2. Registration and fee receipts- The organization has to carry out the registration of received samples and maintain a separate register. A receipt of fee received so far has to be provided to sender and the amount thus collected (1)is to be kept with the organization and further be deducted from the support claim or (2) is to be deposited in government account by challans every fortnightly. One of the choices should be opted by the agency while filling the technical and financial proposals. 3. Laboratory serial number/ code number should be allotted to each and every soil and water sample received during the year. This number is unique for the year. 10 4. Fee structure-The organization is liable to take fee as per the norms prescribed by the department. No excess fee than the prescribed fee will be permitted. Any such case and act found will be treated as bleaching of the contract conditions. The prescribed fee structure for soil and water testing is as follows(1) Soil Analysisa) For Detail Analysis ( major and micro nutrients) pH, EC. OC, P2O5, K2O, Zn, Fe, Cu, Mn Rs 25/- per sample b) For Normal Analysis ( major nutrients) pH, EC. OC, P2O5, K2O, Rs 10/- per sample (2) Water samples pH, EC. CO3,HCO3,Cl, Ca, Mg, Na,K, RSC, SAR Rs 20/- per sample (3) Problematic soils pH, EC, Gypsum Requirement, Rs 10/- Per sample 5. The organization is liable to carry out soil and water analysis as per procedures laid out in IARI soil testing manuals, Hand book 60 of USDA or otherwise a copy of prescribed soil testing procedure / methods will be provided by the Department to the organization and it will test the soil and water analysis accordingly. Any deviation or shortcut will not be permitted. 6. Organization shall maintain all the relevant record in registers and files. (1) List of the samples received with names and address of the farmers. (2) Allotment of lab serial number/ code number, related record. (3) Sample testing record in the form of lab diary which should contain date wise observations/ readings from equipments/ volumetric analysis, calculations etc sample wise for each constituent tested. (4) Record related to calibrations (standards preparation and standard curves) of equipments. (5) Operating manual will be provided and the technical officer of organization will prepare Standard operating procedure (SOP) accordingly for operating equipments, the record of which will be maintained by the organization. (6) Record related to consumption of chemicals, glass wares, plastic wares etc. (7) Record of results in the form of Result sheets, samples wise has to be maintained. Format of result sheet will be provided by the department. (8) Expenditure towards stationary required for maintaining records, Soil health cards, correspondence etc will be borne by the organization. 7. The results of the samples will be communicated through soil health cards to the farmers. For preparation of the soil health cards following activities are to be carried out- 11 A. The specimen format of soil health card will be provided by the department and the organization will use SHC stationary of standard quality at their own cost. B. Computerized soil health cards are to be provided to the farmers. C. Cost of data entry i.e. result entry, making of soil health cards will be borne by the organization. D. Postage charges for sending SHC to farmers will be borne by the organization. E. Software for generating soil health cards will be provided by the department. 8. On the basis of result data, categorization of fertility status Village wise will be done as per standard procedures. Department will provide the standard layout/ procedure for carrying these activities 9. The organization will submit following progress reports in prescribed formats to the Joint Director of Agriculture (Soil Correlator) and District JDAs. a) Monthly progress- number of samples received and analyzed and fee collected. b) Quarterly progress- number of samples received& analyzed, fee collected and expenditure reports. c) Seasonal progress - number of samples received & analyzed seasonwise, brief description on categorization of data for fertility status Nutrient wise, fee collected and expenditure reports. d) Annual progress- comprehensive and consolidated progress report, fee collected, expenditure, Utilization certificate audit report etc. 10. On the basis of activities mentioned above the organization will submit the detailed methodology/ activity schedule, that how they would perform the task of operating soil testing laboratory or analyzing soil samples of department in their own labs or how they will set up a lab, place of establishment of new lab, time frame required to start a lab should be submitted in a separate envelop named as “Technical Proposals” with detailed budgetary requirement in another separate envelop named as “Financial Proposals” for entire operations of work. For calculating the operating cost following minimal requirement of staff with their qualification should be considered by the implementing agency. The analysis work would only be carried out in the allotted laboratory. In any case permission will not be granted to take any of the material/ equipments/ glasswares/ plastic wares/ accessories and any of the lab material outside the lab or premises. 12. At present equipments viz pH meter/ EC Bridge/Spectrophotometer/Calorimeter/ Flame photometer/ Atomic Absorption Spectrophotometer/ Distilled water –plant are arranged and placed / fixed in such a manner that a analyst can do his job perfectly & efficiently. Therefore it is expected that present set up of the lab / equipments will not be changed by the organization in any case. However if any change in present set up is required some slight system arrangement within the lab, then it may only be done under the supervision of personals authorized by the department for this purpose or under the supervision of referring controlling lab. 13. DOA will hand over the lab premises for soil testing purpose only and no other activity shall be permissible to undertake by the organization in the whole premises, however the DOA can use this premises for departmental activities. 14. In case of establishment of new lab the following equipment will be provided to the organization - pH meter, EC Bridge, Calorimeter, Glassware, Single and double distillation units, Mechanical shaker, Flame photometer, Desktop computer & Printer. Any other equipment required has to be purchased by the organization. 15. The private labs with their own soil analysis set up can provide the details. The samples will be sent to concerned labs based on their analysis capacity. 16. Analysis of a soil and water sample generally takes 4-5 days. It is expected that the organization will analyze and report the results within a weeks time after receipt of the sample. In case when the numbers of samples are large during peak season it should not take more than 10 days. For remaining labs presently where no 13 power back up facility (Electric generator), except a 5 KVA UPS having capacity for one hour back up for AAS equipment. Generally for soil testing purpose power backup is not highly required, but for places / situations in peak season small periodic requirement of power back up may arise. If the organization actually needs such facility, the organization can hire at their own cost. Fixed Operating costsCreated facilities in the labs are sufficient to handle at least 10,000 to 15,000 samples in a year. The same is termed as “Capacity” of a laboratory. The given task of testing soil samples is for 12,000 samples per annum, provided the same or higher number of samples would be available for analysis. The sample intake in labs may vary according to situation and season, but for operating cost calculation point of view, lower limit for operating cost support will be 10,000 samples as a fixed rate may be suggested and/or quoted as fixed operating cost, above which the organization may opt variable charges methodology i.e. different charges for additional 2000 samples 10,001 to 12,000, further additional 2000 samples i.e., 12,001 to 14,000 etc. 17 Working HoursSoil testing labs are working according to the scheduled office time declared by the GOAP. In case of sample load or/ in peak season working in two/ three shifts are allowed. 18- Telephone/Internet Facilities: Telephone/ Internet facilities are available in the labs separately; the expenditure has to be borne by the organization. 19 Schedule for completion of task:This assignment will be exclusively for Three year on pilot basis and after completion of Third year this shall be treated as terminated. However the department of agriculture resigns the MOU with the organization if extension of the assignment will be required. 20 Inputs provided by the Department:The department will provide the following materials/ services to the institute 1. Copies of guidelines, physical targets, prescribed formats. 2. Directions issued from time to time. 3. Laboratory premises, buildings, equipment, accessories. 4. Details on the tasks required to be carried out by organization. 5. Funds agreed with organization. 21 Final outputs expected from the organization:The soil and water samples are submitted by the farmers, extension workers and collected by the organization itself. The organization will analyze the samples and results with recommendations in prescribed format are to be provided to farmers, copy of result sheet to be kept in laboratory record and result with interpretation to be kept in computers. Essentially the organization will submit the monthly/ quarterly/Half yearly progress report in prescribed format and draft of annual progress report will be submitted to the committee and after approval from the committee the final report will be submitted The organization will hand over back all the equipment, building, 14 accessories to the department in the same manner as they were taken from the department. 22. List of key positions The Organization should have a participatory approach in operationalization of lab with involvement of District JDA, DDA (Extension), Assistant Director of Agriculture (Regular) for planning and formulation of soil testing programme for the area for the benefit of local farmer. He should have qualified and dedicated specialist as per the task required and the specialists to be engaged on contract basis should have at least required degree in the subject for running the laboratory. The project doesn't support engagement of persons on permanent basis but should be on contract basis for the duration of need base work. The Company/NGO/Group/Association/Agency should be registered in Andhra Pradesh or under the registration of societies Act, having valid registration shall only be considered for prequalification. The organization should have the experience of working in soil testing related projects or on similar works. Priority will be given to the agency, having for minimum 03 years experience after its registration in Soil testing and /or laboratory analytical works/projects. The organization should have a sound and sustainable financial position. The organization should have utilized funds/implemented programmes continuously for two years and to a minimum of Rs 20 lacs in any of last 05 years. Adequate organizational setup /manpower /financial capability/ infrastructure. 18 Soil testing related projects completed and similar projects in hand. The organization should have a separate and functional office. The organization should have good reputation among the government/ PRIs /Community/donors. Certificate from the concern to this effect is desirable. The organization should have proper system of accounting and manpower management. The organization must have a regular system of auditing of accounts. AFFIDAVITS: The NGO should meet the following criteria and an affidavit should be submitted to this effect: 1. The organization, CEO or any member of management committee should not be convicted in any criminal cases. 2. The organization should not have more than two close relative in board of management. 3. The organization should not political and secular in nature. It does not work for a particular caste/creed/religion. 4. The organization should have ability to plan, implement and monitoring specific projects and programmes in a participatory framework. 5. The organization is integrating the gender component in their work and address the issue of social equity in their programmes. 6. The organization should not be in the list of organizations Black Listed by CAPART/CSWB/Government or any donor agency during last three years. Controlling Officer- The controlling officer for all the aspects of the work and disbursement etc shall be the Joint Director of Agriculture (Soil Correlator), O/o C&DA, AP.. 2. Monitoring and Control- Monitoring and control of the work will be done by the committee constituted for the purpose. The organization will report to District Deputy Director of Agriculture (Extension), Assistant Director of Agriculture (Regular), Deputy Director of Agriculture (RSTL) and Joint Director of Agriculture (Soil Correlator), O/o C&DA, AP directly and get the work checked and verified by them. Wherever necessary, verification /checking from the District Deputy Director of Agriculture (Extension) along with Deputy Director of Agriculture (RSTL) shall also be got done. 3. The guidelines issued by the department from time to time shall also be the part of agreement and shall be final and binding to carry out the work. 4. The organization shall specially mention as to in which or how many labs are to be interested in working in. The labs allotted however shall be awarded according to the capacity of the organization assessed while prequalifying. The committee processing these tenders on behalf of the Agriculture department shall be authorized to decide the labs to be awarded to the successful bidder on the basis of the capacity of the organization. The decision of the committee shall be final and binding. 20 5. Award of work- The financial offer shall be submitted in the respective schedule as lump sum rate (Fixed cost and/or variable cost). The organizations are expected to quote reasonable and workable rates for operating soil testing lab in the financial offer part of this document. The committee reserves the rights to offer the lowest/ reasonable rates to the pre qualified organization including the quantum of work (number of labs). On the basis of above the work shall be awarded to the prequalified organization. 6. The organization shall ensure that the record of day to day work and attendance of the staff developed by him is maintained and got verified. 7. The inventory of the material procured/issued/consumed shall be kept and maintained and the same shall be got verified at the time of verification. 8. Taxes, Duties and levies- All taxes, duties and levies, fees and other impositions if any be exerted under the applicable law shall be paid by the organization. The rates offered shall be inclusive of all such expenses. 9. Deductions- statutory deductions as per law in force during the project period shall be made from monthly/running payments. Security deposit shall be taken @ 5% of the total cost of lab equipments. It shall be refunded after satisfactory completion of the awarded work at expiry of MOU. 10. The organization shall not be permitted to under take any other activity in the lab. 11. Schedule for completion of task:This assignment will be exclusively for three years from the date of execution of MOU and after completion of third year this shall be treated as terminated. However the department of agriculture resigns the MOU with the organization if extension of the assignment will be required. 12. The second party shall inform to the first party about the persons engaged in soil testing activities. The second party shall be fully responsible for adhering to the provisions of various laws applicable to them including Labour Laws. In case of fails to comply with the provisions of applicable laws and thereby any financial or other liability arises on the first party by the Court orders or otherwise the second party shall be fully responsible to compensate/indemnify to the first party for such liability. For realization of such damages the first party may even resort to the provisions of Public Demand Recovery Act 1952 or other prevailing laws as applicable on the occurrence of such situations. 13. All the operational costs including comprehensive insurance, levies, operation, fuel, taxes etc. and expenses for operating the lab shall be borne by the second party in all respect ensuring the guidelines lay down by the first party. 14. The second party shall bound to follow the conditions mentioned in the agreement. In case of failure, the first party shall have right to issue show cause notice to the second party about failure and withdraw the work order from the second party if no satisfactory reply is received and the security deposit will be forfeited. 15. The Agreement may be terminated by the first Party,If the second party,21 i. ii. is blacklisted by any Government or any other agency; fails to show adequate causes on the two consecutive occasions for not complying with the Standard Operating Guidelines or non- compliance with statutory requirements; iii. becomes insolvent; iv. himself or his office bearer involved in any criminal offence; v. himself or his employee found to be recurrent misconduct/dereliction of duty; vi. charge any extra amount more than decided user charges; vii. further lease out or sub-lease the Mobile Soil Testing Van ; or viii. fails to engage prescribed and qualified technical staff. 16. In case, the agreement is terminated by the first party on grounds of violation of agreed terms and conditions by the second party, the security deposit shall be forfeited and the second party shall be debarred by the first party from receiving any funds/ grant from any scheme or programme run by the Government of Andhra Pradesh or any institution funded by the Government of Andhra Pradesh for a period of three years from the date of termination of agreement. 17. The second party shall not assign, sublet or subcontract its rights or obligations under the agreement or any part thereof without the prior written consent of the first party. 18. Any dispute or differences which may arise between the parties or their representatives, with regard to the construction, meaning and effect of this agreement or part thereof, or the rights and liabilities of the parties under this agreement shall be referred to arbitration in accordance with the provisions of Arbitration and Conciliation Act, 1996. The venue of adjudication shall be at High Court of AP. 19. Agreement: The agreement shall be executed by the successful bidder organization with the department. This agreement document, prepared broadly on the lines of the EOI terms and condition, shall cover detailed technical, financial and legal clauses/provisions. 20. Penalty/Compensation: If during the progress of the work, it is found by the field monitoring staff and verified by the Deputy Director Agriculture (Extension)/ Deputy Director Agriculture (RSTL) that any of activities provided in the scope of work, are not being done or not being properly done, then a token compensation & 2.5% to 5% of respective activity to be paid for the month shall be levied. Non compliance of the terms and conditions of the work, public complaints duly verified etc may result in termination of the contract, forfeiture of the security and blacklisting of the organization. 21. Document created: All the documents created and record pertaining to soil sample analysis and preparation of soil health cards for which he has received payments from the department, shall become the property of the department, once the work is completed. The organization shall deposited /submits the same to the district departmental lab along with the list of same. 22 22. Terms and conditions for operationalization of laboratory i. All correspondence in connection with the execution of this scheme should carry out with the Commissioner Agriculture. ii. After the sanction by the Committee, the Department of Agriculture will issue work order and a separate order to release the first installment of the funds. The department will give hand holding for at least 01 month from the time of MOU. The starting date for the scheme shall be taken as the date on which the first activity is initiated on the scheme which however shall not be later than three months form the receipt of Bank Draft by the Organization. This date shall be intimated by the Head of the organization to Commissioner Agriculture. Sanctioned duration shall be counted form this date. iii. The organization shall pay to the department a refundable interest free security deposit (SD) @ 5% of the agreed amount within 10 days of signing of MOU, which will be refundable after the expire of MOU. The department will have right to recover dues, if any from the security money. iv. The Head of the organization shall be responsible for speedy execution of the work of the lab, for utilization of the funds in accordance with conditions of grants and for submitting various returns listed in these guidelines to Nodal Officer headed by Joint Director Agriculture (Soil Correlator), Department of Agriculture, AP. v. A separate account should be maintained in respect of the utilization of funds from this grant. The grant shall be spent only for the purpose for which it is sanctioned. The grant should not be diverted for other purposes nor the execution of the schemes entrusted to another Organization without getting specific approval of Department of Agriculture. vi. The portion of the amount which is not ultimately required for the purpose for which it is sanctioned should immediately be reported to the Department of Agriculture and the balance surrendered. vii. The Organization has to furnish a certificate from the Auditor to the effect that the Grant-in-aid has been utilized for the purpose for which it was sanctioned. viii. The equipments supplied will remain the property of the Government of AP who will have the right to transfer such equipment from the organization where it is no longer required for the purpose allotted to it, to another Lab where it might be required. A separate register, in Form GFR 19 of all permanent and semi permanent assets provided should, therefore, be maintained. The Organization will have to furnish an extract from the register maintained for the purpose of listing out permanent and semi permanent assets acquired. ix.
