INVITATION OF BIDS: 1.1 Sports Authority of India, NSSC, Bangalore invites sealed Tenders from reputed and registered Security Agencies / Firms having minimum annual turn over of Rs.50.00 Lakhs per annum (Rupees fifty lakhs only) during the last 3 financial years and with three years experience (recent) with Government Organizations/PUSs and other reputed organizations in providing complete & comprehensive security including monitoring of in- coming and out-going movements of material, staff, and safety of land, property, buildings (including furniture, fixture, equipments etc) in SAI NSSC Campus, Bangalore. Format for submission of documents are at Annexure I, II & III 1.2 The bidders are required to accept all terms & conditions mentioned in Tender Documents. SAI reserve the right to reject or accept the tender without assigning any reason. 1.3 It is the responsibility of the bidders to read all terms and conditions of the documents or bids and sign on all pages before entering into an agreement for security services. EARNEST MONEY DEPOSIT(EMD) Interest free Earnest Money Deposit of Rs.80,000/-(Rupees eighty thousand only) by demand draft, Bankers’ cheque drawn in favour of “ Sports Authority of India, Netaji Subhas Southern Centre, Bangalore” from any nationalized bank should accompany the Technical Bid Form. This amount will be refunded to the unsuccessful bidders within three months of the date of approval of the successful bid, without interest. The Earnest Money will be forfeited if the bidder is not fulfilling the following terms and conditions : i) In case the bid is found faulty with regard to minimum wages act applicable as per Central Government Rules. ii) In the event the successful bidder fails to take up the security job within fifteen days from the date of receipt of letter conveying the acceptance of bid. 2.1 The successful bidder shall furnish the Performance Guarantee of Rs. 2,00,000/- (Rupees two lakhs only) within seven days from the date of receipt of the awarding letter the contract in the form of A/c Payee DD/Bankers’ cheque, Bank Guarantee or FD Certificate from any Nationalised Bank.. The performance security deposit shall not carry any interest. 2.2 The successful bidder will execute an agreement on stamp paper worth Rs. 100/- (rupees one hundred only). 2.3 The earnest money deposit of the successful tenderer will be after completion of the above mentioned conditions. refundable 3. SCHEDULES OF TENDER i. The Tender Document will be available between 1000 hours & 1600 hours on all working days up to 14.11.2014. The intended bidders may purchase the same from the office of Sports Authority of India by making payment of Rs 1000/- (Rs. One thousand only) in cash or by Demand Draft drawn in favour SAI Netaji Subhas Southern Centre payable at Bangalore. Bidders who download the tender documents from the website, are required to pay Rs. 1000/- by DD separately. In case the bid is received without the cost of tender documents, the same would not be considered. ii. Technical & Financial bids shall be received upto 17.11.2014 by 1430 hrs. The technical bids will be opened on 17.11.2014 at 1530 hrs. iii. Technical Bid will be opened, if the EMD along with tender cost (in case of downloading from website) is found in order. The Financial Bid of only those bidders will be opened whose Technical bid(s) the Competent Authority accepts. The successful bidder has to give an undertaking in writing that staff deployed at the Centre in terms of the contract will remain as the employees of the Agency exclusively and they shall not be entitled to claim employment in SAI or any compensation in the case of any casualty occur during the contract period or thereafter. vii. Rate quoted should not be less than that of the minimum wages Act notified by the Central Government which shall stand revised upward to the extent notified by Ministry of Labour, Govt. of India from time to time. viii. The competent authority reserves the right to reject any or all tender without assigning any reason. 4. PROCEDURE FOR SUBMISSION OF BIDS. The Bids shall be submitted in TWO separate sealed envelopes as under:Envelope A – should contain the Bank Drafts for the EMD & Receipt/Bank Draft of Tender Cost along with details in (Annexure-I) AND should contain the Technical Bid Document, (Annexure-II). BIDDER QUALIFICATION The bidder should have minimum three years experience of providing complete & comprehensive security services to reputed Govt. Organizations/PSUs and other reputed organizations for awarding contract. The bidder should enclose list of clients to whom services have been provided during the last 3 years in support of the experience. with copies of offer letters. The minimum annual turnover of the agency should be Rs.50.00 lakhs per annum for the past three years. 6.SCOPE OF WORK 6.1 The security agency should have qualified and experienced Security Guards, Gunmen & Supervisory Staff having experience in Security works preferably from Ex-servicemen /Ex-police service category. 6.2 The agency has to deploy both ex-servicemen/Ex-policemen and civilians who should be below 50 years of age and medically fit as prerequisite, except supervisory staff (Ex-Servicemen /Retd. Police/Paramilitary Dept.) subject to medical fitness, up to 65 years. 6.3 After award of security contract, agency shall provide a list of particulars along with police verification of all such security staff personnel deputed by the agency at the complex on duty to the Director, SAI NSSC, Bangalore in the following format for record. 1. Expanded Names 2. Father’s Name (expanded) 3. Educational Qualification 4. Ex-serviceman /Civilian 5. Age with date of birth 6. Permanent Address 7. Local Address 8. Phone No. (if any) The security agency will issue its own photo identity cards to its employees deployed for the purpose of Security in the Campus. 6.4 The security agency will provide complete & comprehensive security cover in the Campus round the clock as per the requirement of the Centre. The Bidder should deploy 31 Security Guards, 2 Gunmen and 2 Supervisors for the purpose. 6.5 The number of security personnel mentioned above is approximate which may increase or decrease according to the requirement of SAI. (SIGNATURE OF THE BIDDER) with address and seal Page 6 of 17 6.6 The Sensitive Points where guards are to be deployed are as under : a) Administrative Block & Generator Room. b)Main Entrance (Gate No.1), Gym. Complex Indoor Halls, Synthetic Athletics Track & HockeyField. c)Temple Gate (Gate No. 2) d)Quarters Gate (GateNo.3) e)Entrance at Circle to Guest House & Guest Flats. f)Girls Hostel. g)Techno Gym & Cinder Athletics field, Golf Course. h)Shooting Range Complex, Basketball Court, Kabaddi arena & Football field. i) Trap & Skeet range (outside). 6.7 The security staff shall check the Identity Cards of all the campers, STC, Diploma Trainees, Staff, Coaches, sports persons, University Students passing through campus gate, issued by the Competent Authorities and will not allow any unauthorized persons to enter the campus premises or any restricted areas. A visitors’ register will be maintained near the reception / main gates for this purpose and the register to be shown to I/C security for check. 6.8 The security agency will provide specially trained staff preferably exserviceman for protecting the Senior Executive / functionaries of the SAI from any unauthorized / objectionable activity from others or any untoward incident either from any SAI employee or outsider or university students. 6.9 The security agency will co-operate with the watchmen/chowkidars on the regular rolls of SAI for ensuring the complete safety of the SAI property equipment & belongings including the property, equipment and belongings brought inside the campus by the inhabitants. 6.10 The Security agency will check and verify any isolated or any accompanied bag on package or article lying at any place in or immediately near/around the campus, for ensuring that there is no damage or loss to person or property by any terrorist or disruptive elements. 6.11 For the purposes No. 6.9 and 6.10 above, the security agency will ensure that all the gates, all doors and windows Administrative block, Gymnasium block, Techno Gym, Shooting Range complex are properly closed after office hours and on all holidays so that no such unwanted activity can be carried out by anyone resulting in any loss to property or persons by any lapse of security. 6.12 In case of incoming /outgoing stores at the Gate, the same will be checked for quantity in corroboration with challan /valid gate pass issued by the Competent Authority. A store register for both incoming/outgoing will be maintained at the gate and submitted to Incharge at such intervals as may be desired by the competent authority. (SIGNATURE OF THE BIDDER) with address and seal Page 7 of 17 6.13 To bring to the notice of Director NSSC/Dy. Director/ I/c Security or any other authorized person any suspicious activity of any person(s) noticed during or after office hours on working and non-working days. 6.14 To report unusual happening, if any, to the Competent Authority or any other authorized persons. 6.15 Beside Security duties, the agency has to deploy security personnel in all the shifts who should have basic knowledge of fire prevention and handling fire fighting appliances to man the Fire Control Room as per requirement of local fire services. 6.16 The security staff deployed by the agency shall be on duty round the clock to provide comprehensive security to the complex. For this purpose, the security agency before bidding may visit the SAI Bangalore for familiarization / inspection/ assessment. 6.17 In case of theft, pilferage and otherwise loss or damage to stores and property in the premises, the security agency will be fully responsible and they shall undertake to make good the losses / damages in financial terms as may be decided by the Competent Authority. The decision of Director in this regard shall be final. 6.18 The security staff deployed by the security agency shall ensure that the vehicles of the Scientist, Staff, Coaches, National Campers, Diploma students, STC/COE Trainees etc. enter the campus and are parked in the area marked for parking and ensure their safety and there should be no blockage. For this purpose reserved parking area for vehicles of SAI employee shall be marked & stickers may be issued for such vehicles. During summer coaching camp (March, April, May, June) the vehicles of all parents, campers, schools, Travel agents, shall be parked in marked place outside the gate. 6.19 The security agency will familiarize itself with all the rules and regulations regarding the permission for use of sports facilities and sports grounds at different time of the day and eligibility of sports persons/ outsiders to use the same and will ensure the same are carried out in an orderly manner. 6.20 The security agency will be responsible for preserving good order, discipline and decorum in and around the campus premises on day to day basis and also at the time of any special functions/ events. 6.21 The contract shall be for a period of one year. The contract shall be terminated by either side on TWO month’s notice or payment in lieu thereof without assigning any reasons. 6.22 The contract can be extended for one more year on satisfactory performance and willingness of the successful bidder on the same terms and conditions. 6.23 The successful tenderer through its security staff shall ensure that all the offices, stores, toilets, entries, windows and doors are properly closed and (SIGNATURE OF THE BIDDER) with address and seal Page 8 of 17 locked after office hours and on holidays. The lights etc. of the toilets and other places where it is not required are to be switched off by the security staff before, they lock it. They will also see that no taps are left open leading to water wastage. 6.24 In case of any injury/ mishappening of any employee of the agency or any third party, the tenderer shall be responsible to compensation and /or damages as per law. In case of any court case or challan by the police or any local authority or any other party competent to take such action, the tenderer shall be solely responsible for defending the cases in a court of law and/or to ensure compliance with the summons or challan so served in this behalf. 6.25 The successful bidder should maintain all the records and documents under various labour laws applicable to contract labour/personnel. Indicative list of such record is given for example: a) Register for Workmen, Employment card (to be issued to workers), (c) Muster Roll, (d) Register for wages etc. 6.26 The tenderer may visit the campus if needed to have an overall view of the sensitive points patrolling and security arrangement before submitting the tender. 6.27 The requirement of guards will be increased or decreased by 10% to of the total requirement on need basis. TERMS AND CONDITIONS PERTAINING TO SECURITY PERSONNEL 6.28 The security personnel should be turned up in proper uniform during duty hours. The security staff deployed by the agency shall be provided with proper uniform and kit by the security agency in addition torches with cells gum boots, rain coats, over coats etc. on requirement basis. 6.29 On special functions the agency will provide additional security services as per the requirement at the agency notice and ensure that the additional manpower thus deployed is properly briefed and turned out as requirement by SAI. The terms and conditions for provision of additional security may be stated with reference to the proposed deployment as reflected in security plan submitted by the tenderers. The payment of the additional deployment will be paid on pro-rate basis. For special functions security personal will turnout in ceremonial uniform at no additional cost to SAI. 6.30. The Contractor will comply with all the provisions regarding licensing welfare and health, procedures, maintenance of various records and registers etc. as provided under the Contract Labour (Regulation & Abolition) Act 1970 and also under the order issued by the Govt. of India /State Govt. from time to time and for its non-compliance the contractor shall be responsible for penalties levied by the appropriate authority under the Act. The Contractor shall also be (SIGNATURE OF THE BIDDER) with address and seal Page 9 of 17 liable to comply with all other Labour and Industrial Laws and such other Acts and Statutes (including Factories Act, Payment of Bonus Act etc.). Depositing of PF Contribution as may be applicable is the responsibility of the Contractor at his own expenses and shall not be reimbursed by the Institute. For any default in compliance, the Contractor shall be held responsible. One day compulsory weekly off should be given to the security guards. 6.31 The Institute shall not be liable to pay any allowance, salary or any other amount under any law in force for the staff engaged by the Contractor. The Institute shall also be not liable for breach of any Labour Laws or any other Laws for the time being in force. The Contractor shall not be entitled to any other allowances or benefits which are not included in the contract. Payment of monthly wages to the Security Guards should be made in the presence of the responsible Officer of the Institute deputed for the purpose. Contract labour are eligible to benefits of Provident Fund, ESI etc. and the contractor has to ensure the same. 6.32 The Contractor is required to comply with all the legal liabilities and if the contractor is found failing to comply with the provisions of various Acts applicable to the contractor and the contract labourers, the Institute can ask for the records for inspection and the contractor is required to comply with all the liabilities to be discharged and in case of any failure on the part of the contractor, the Institute shall with-hold payment of its bill. 6.33 The Institute will not, in any manner, be responsible for any act, omission or commission of the workers engaged by contractor and no claim in this respect will be made against the institute. If such claim is made against the Institute by any worker or his heirs engaged/employed by the contractor, which the institute is obliged to discharge by virtue of any statute or any provision of law and rules due to mere fact of the workers of the contractor working at the institute premises or otherwise, the contractor will be liable to indemnify/reimburse the Institute all the money paid in addition to the expenses incurred by it. 6.34 Before filling the tender form, the contractor should visit the complex premises and familiarized himself with the work of Incoming and outgoing movements of staff, outsiders and supplies of goods, parking of vehicles, safety of SAI equipments and belongings and monitoring of play grounds, sports facilities, preserving good order and decorum on day to day basis and at functions etc. including the earmarked sensitive points and all other places in the campus and whatever else that may be involved in the comprehensive security arrangement, including fire fighting. 6.35 In case any security point is found to be not properly covered or any staff or personnel of security agency is found to be neglecting duty or showing improper demeanor and/or bearing, or found including in misbehavior or (SIGNATURE OF THE BIDDER) with address and seal Page 10 of 17 unruly improper conduct or is found to be not dressed in uniform or of poor quality, or shabby performance of duty, then for each incident, there will be a deduction of 5% on the first occasion, 10% on second occasion and 15% on the third occasion out of the monthly payment which will be without prejudice to the right of the SAI. Thereafter SAI reserves the right to terminate the contract or imposition of penalty as deemed fit for unsatisfactory services. 6.36 The security personnel to be deployed should be in proper uniform with Black leather shoes. If it is found that they are not in proper uniform, penalty of Rs. 1000/- in each case will be imposed. 6.37 The successful bidder shall enter into a contract with the Sports Authority of India. The above terms and conditions are illustrative in nature and not exhaustive. In other words, SAI reserves the right to make further additional, alternations or modifications in the TERMS & CONDITIONS. 6.38 These are only proposed draft terms & conditions and can be modified, changed or added to at the time of finally concluding and signing the agreements. 6.39 The bidder has to give certificate along with bill that the payment of security guards deployed at SAI NSSC Bangalore has been made as per minimum wage act and ESI/EPF contribution for the month are deposited with ESI/PF authorities statement of the security guard to be enclosed. The agency agrees to indemnify and reimburse any amount which the SAI compelled to pay in case of default by the agency in payments as aforesaid. 6.40 The security agency shall 24 hrs. round the clock/365 days in a year/cover security for all the personnel and property of the SAI in the campus including sensitive point’s as decided by the competent authority of SAI. The SAI reserve the right to direct security agency to remove any security staff on their unsatisfactory performance. If at any time of checking , any sensitive point is not found properly covered/provided with security or neglect penalty will be levied and deducted from the bill of the agency. Any change in the security personnel , deployed should be informed by the agency to concerned Incharge at least one day in advance along with reasons. Deployment of new guard should be done with the approval of SAI. 6.41 Attendance register of Supervisor and security guards should be submitted to office of In-charge-Security, SAI, NSSC Bangalore on daily basis. 6.42 The agency should plan deployment of female security guard in the girls hostel in the day time and male security guard in the night time. 6.43 The Institute shall not be responsible for providing residential accommodation to any of the employee of the Contractor. (SIGNATURE OF THE BIDDER) with address and seal Page 11 of 17 NOTE : a) The Contractor shall provide uniformed and trained personnel and use its best endeavor to provide security services to the Institute for providing safety, monitoring and surveillance. Rates quoted will include all statutory obligations of the contractor under Minimum Wages Act, Contract Labour (R&A) Act, Weekly-off replacement charges, cost of uniform of personnel deployed by the Contractor, all kinds of taxes, service charges etc. of the agency. The rate quoted will be for per shift of eight hours per day per person for one month. If the minimum wages is revised by Govt. Of India the increased wages, if applicable, will be provided. No other charges would be payable by SAI. b) The offers/bids which are not in compliance with Minimum Wages Act and any other Labour laws, will be treated as invalid. 8. PAYMENT PROCEDURE 8.1 The agency will submit the bill for Security arrangement by the first week of every month for the preceding month’s payment. The payment of the bills will be made with in 10 days from the date of submission the bill through Electronic Payment System, if services are found satisfactory and all required documents are enclosed. 8.2 The agency will responsible to deposit EPF, ESI subscription & Service tax as per rule under labour law and copy of challan should be submitted along with the bill for settlement of payment. A certificate is also to be furnished along with the bill by the contractor to the effect that the contribution (EPF/ESI as the case may be) deposited through the enclosed challan is consolidated challan in respect of all employees of the contractor which included deposit of contribution in respect of the persons posted/deployed at SAI Centre, Bangalore. The agency will be wholly and solely responsible for making payment of monthly wages to the persons deployed at the centre which should be minimum wages as prescribed from time to time by Government of India (Central Government) and shall also be responsible for depositing employee’s and employer’s share of contribution under EPF & ESI Acts. 9. ARBITRATION 9.1 In the event of any dispute or differences arising between the parties with regard to the terms and conditions of the agreement/contract and or with regard to the breach or interpretation thereof including all rights and liabilities there under on any matter what so ever touching upon the terms and conditions of the agreement/contract whether in course or on/after its termination the parties to settle the same at the first instance by mutual discussions/conciliation which would be conducted by the Director, SAI at Bangalore. (SIGNATURE OF THE BIDDER) with address and seal Page 12 of 17 9.2 In the event the said mutual discussions/conciliation fail, the aggrieved party shall initiate arbitration proceedings for resolution of differences/disputes etc., mentioned above by appointing a sole arbitrator, who shall be the Director General of SAI in which event the said proceeding shall be conducted in accordance with the provisions of the arbitration and conciliation act 1996. 9.3 The venue of such arbitration proceeding shall be at Bangalore and the court in Bangalore alone will have jurisdiction in all respect of all proceedings connected there with.
