1 Mitchell Community Schools and Mitchell High School Student Random Drug/Alcohol Testing Policy Mission It is the mission of the Mitchell Community Schools Student Random Drug/Alcohol Testing Program to work toward creating a drug free school environment. Introduction The effective date of this program is September 1, 2008. This program does not affect the current policies, practices or rights of Mitchell Community Schools with respect to drug and/or alcohol possession or use, where reasonable suspicion is obtained by means other than drug testing through this policy. Program Goals A goal of the drug testing program is to help identify any student who may have a substance or alcohol abuse problem and to encourage professional counseling/treatment. It is also a goal of the program to be an incentive or reason for a student to say no to negative peer pressure that promotes alcohol or drug use. Students are encouraged to seek professional assistance in combating a substance abuse problem. The principal/administrative designee will meet with any student confidentially to give advice and direct a student on how to receive drug or alcohol treatment. Reasonable Concern Students who come to school or participate in extra-curricular activities under the influence of alcohol or drugs are in direct violation of school policy. This type of conduct represents student misconduct and substantial disobedience and is an interference with school purposes. Substance abuse is illegal and is a danger to the physical health and mental well being of an individual. It is the obligation of school officials to ensure to the best of their ability a safe and healthy learning environment. Purpose Mitchell Community Schools, through development of this policy, has decided to be proactive in working toward curtailing the use of drugs and/or alcohol by our students. Educators know that educational programs alone are not effective in combating the use of drugs by students. It is the purpose of this policy to prevent a student from participating in extra-curricular activities and driving to school while he/she has illegal drug residues, or alcohol in his/her body. Also, it is the purpose of this program to educate, help, and direct students away from drug and alcohol abuse and toward a healthy drug free lifestyle. Scope Participation in extra-curricular activities and driving to school is a privilege. This policy applies to all students in grades 9-12 who want to participate in extra-curricular activities that are listed in the current student handbook or currently approved by Mitchell Community Schools. It also includes any student who wants to drive to school, from school or during school and students in the driver education program. 2 Consent Form It is mandatory that each student that is within the scope of the drug testing policy sign and return the “Consent Form” prior to their participation in any of the activities covered by the program. Failure to comply will result in non-participation and/or loss of driving privileges. The consent form shall be dated and signed by the participant and by the parent/guardian. In doing so, the student is agreeing to participate in the random drug testing program. Consequences of Positive Test Results The penalties outlined below are for students in grades 9-12 and remain on the student’s drug testing record throughout their high school career. 1. First offense The first offense will result in the student being suspended from participating in extra-curricular activities and student driving for a period of two weeks. 2. 3. 4. If the two week suspension cannot be fulfilled during the current extra-curricular activity due to the activity ending, the suspension will carry over into the next activity in which the student chooses to participate and complete. The penalty may also carry over to the next school year. If the activity is a single event, the student will be suspended for that event. The student will not be allowed to practice/participate until he/she has documentation of a negative drug test from a school approved lab and paid for by the parent (s). Second offense The second offense will result in the student being suspended from participating in the extracurricular activities and student driving for a period of six weeks and enrolled in a drug counseling course approved in advance by the school and paid for the by the parent (s). The student must provide the school with documentation of a negative drug screen from a school approved lab, at the student’s and/or parent/guardian’s expense before the student is allowed to return to extracurricular activities/driving. The student must also show verification that he/she has completed the drug counseling course before the student will be allowed to return to extra-curricular activities/driving. Third offense The third offense will result in the student being suspended from participating in the extracurricular activities and student driving for a period of twelve weeks and enrolled in a drug counseling course approved in advance by the school and paid for the by the parent (s). The student must provide the school with documentation of a negative drug screen from a school approved lab, at the student’s expense before the student is allowed to return to extra-curricular activities/driving. The student must also show verification that he/she has completed the drug counseling course before the student will be allowed to return to extra-curricular activities/driving. Fourth offense The fourth offense will result in permanent expulsion from all extra-curricular activities, including driving for the remainder of their high school career. *A refusal of a student to submit to a drug/alcohol random test will be considered a positive test and the appropriate consequence applied. Special Note: 1. Students Enrolling in Driver Education A positive test result will not allow the student to enroll in a driver education course. If the student tests positive while enrolled in a driver education course, they will be removed from the course. 3 Testing Procedure Indiana Testing, Inc., of Indianapolis, Indiana will be used to conduct testing and to provide the training for those who will supervise the program. 1. 2. 3. 4. 5. 6. 7. The selection of participants to be tested will be done randomly on an average bi-monthly basis with approximately 10-15 students selected. This variable schedule will keep students conscious of the possibility of being tested at any time during the year. Each student will be assigned a number that will be placed in the random drawing. Indiana testing, Inc. will conduct the random drawing. No student will be given advance notice or early warning of the testing. Indiana Testing, Inc. will follow all applicable guidelines and procedures in conducting the urine drug screen as prescribed by the Department of Health and Human Services. Students will remain under the supervision of Mitchell Community Schools during the drug testing. If a drug test specimen shows tampering or other deception during the collection, the student will become ineligible for all extra-curricular activities/driving for one calendar year. A report will be given to the parent/guardian. The principal/administrative designee will be responsible for escorting students to the collection site. Testing Results 1. 2. 3. This program seeks to provide needed assistance for students who have a verified “positive” test. The student’s health, welfare and safety will be the main reason for preventing students from participating in extra-curricular activities, driver education and driving to school. The principal/administrative designee will be notified of a student testing “positive.” The principal/administrative designee will notify student’s parent/guardian. The student or his/her parent/guardian may submit any documented prescription, explanation, or information which will be considered in determining whether a “positive” test has been satisfactory explained to the Medical Review officer. In addition, the student or parent/guardian may appeal by requesting that the urine specimen be tested again by Indiana Testing, Inc. at a cost to the student or his/her parent/guardian. If the test is verified “positive” the principal/administrative designee will meet with the student and his/her parent/guardian at a school corporation facility. The student and his/her parent/guardian will be given the names of counseling and assistance agencies that the family may want to contact for help. The principal/administrative designee will request a follow-up test after such an interval of time that the substance previously found would normally have been eliminated from the body. If this follow-up test is negative, the student will be allowed to resume extra-curricular activities, driver education or driving to school after the appropriate penalty has been served. If a second “positive” is obtained from the follow-up test, or any later test of that participant, the same previous procedure shall be followed. 4. 5. In addition, the school reserves the right to continue testing at any time during the student’s high school career any participating student who tested “positive” and did not make a satisfactory explanation. Information on a verified “positive” test result will be shared on a “need to know” basis with the student’s coach or sponsor. The results of the “negative” tests will be kept confidential to protect the identity of all students being tested. Drug testing result sheets will be returned to the principal/administrative designee identifying students by number and by name. Names of students tested will not be kept open in an open file or on any computer. Result sheets will be locked and secured in a location to which only the principal/administrative designee has access. 4 Financial Responsibility 1. 2. 3. Under this policy, Mitchell Community Schools will pay for all initial random drug tests. All “followup” tests will be the responsibility of the student or his/her parent/guardian. A request on appeal for another test of a “positive” urine specimen is the financial responsibility of the student or his/her parent/guardian. Drug education programs, counseling and assistance programs are the financial responsibility of the students or his/her parent/guardian. Confidentiality Under this random drug testing program, any employee, coach or sponsor of Mitchell Community Schools who may have knowledge of the results of a random drug test will not divulge to anyone the results of the test or the disposition of the student involved, other than in the case of a legal subpoena being made upon that person in the course of a legal investigation or legal proceeding. 5 MITCHELL HIGH SCHOOL RANDOM DRUG/ALCOHOL TESTING POLICY CONSENT FORM 2013-2014 In the interest of the safety of our high school students, Mitchell Community Schools has adopted a Random Drug/Alcohol Testing Policy. The policy requires that students involved in the extra-curricular program and driver education program are subject to random drug tests. Please review the Drug/Alcohol Random Testing Policy. A student will not be permitted to participate in any extra-curricular activity or driver in education until this consent form is signed and on file with the school. I, (name of student) have read the Mitchell High School Student Random Drug/Alcohol Testing Policy and do consent to submit to a chemical test should I be required to do so. I further consent to allow Mitchell High School to test the specimen I provide for illegal drug and/or alcohol content. I realize that if my test is positive for drug and/or alcohol use I will be subject to the consequences in accordance with the provisions of the Random Drug/Alcohol Testing Policy. I further consent to and agree to other terms and conditions of the Random Drug/Alcohol Testing Policy.
