TENANT RESPONSABILITIES AND REGULATIONS
1 Use of the Premises
To use the Premises for the residential use provided for in clause 3 in a tenant-like manner (which means to
use the Premises in the way you would expect a reasonable student tenant occupying as a single household
family to use them)
1.2 To Maintain the Condition of the Premises and the Furniture
1.2.1 To keep and maintain the interior of the Premises and the Furniture and all landlord’s fixtures and fittings
in the Premises clean and in as good condition (fair wear and tear excepted) as at the date of this Agreement
the parties agreeing to co-operate together both at the commencement and at the end of the Term jointly to
inspect and agree the relative condition at such times of the Premises PROVIDED that this obligation shall not
impose any liability on the Tenant which is cast upon the University by Sections 11-15 (inclusive) of the
Landlord and Tenant Act 1985 or any statutory extension or modification to them
1.2.2 To maintain the interior of the Premises in a good state of decorative condition and at least up to the
same standard that it was in when the Tenant moved into the Premises (fair wear and tear excepted)
1.2.3 To take due and proper care of the Furniture and keep it clean and in good repair (fair wear and tear
excepted)
1.2.4 Not wilfully to deface the Premises or allow others to deface the Premises internally or externally
1.2.5 To keep any garden or open areas of the Premises in a tidy and litter-free condition
1.3 To notify the University of defects and to allow entry
1.3.1 To report to the University in writing as soon as the same shall come to the attention of the Tenant any
disrepair or defect for which the University is responsible or any other material or significant items of damage
or disrepair however occurring
1.3.2 To permit the University and the University’s duly authorised surveyors staff or agents upon giving not
less than forty-eight (48) hours prior notice (except in the case of repairs requested by the Tenant or
emergency when no notice shall be required) to enter the Premises together with the necessary workmen and
appliances:1.3.2.1 to inspect the state of repair and decoration of the Premises the Furniture or any part of them and if
required by the University to ensure at least one (1) of the persons comprising the Tenant is present at such
inspection
1.3.1.2 to carry out any repairs or alterations which may be necessary during the Term pursuant to the
University’s repairing obligations
1.3.2.3 for any other purpose reasonably required by the University connected with the state of repair and
condition and manner of use or management of the Premises
and if following any such inspection the University gives written notice to the Tenant of any breaches of the
Tenant’s obligations in this Agreement then the Tenant shall as soon as possible carry out the works necessary
to remedy the specified breach or breaches to the reasonable satisfaction of the University and if the Tenant
fails to do so then the University will be entitled to carry out that work and the Tenant shall pay the costs of
doing so to the University on demand as if it was an arrear of rent
PROVIDED that where entry is made under clause 5.5.2.2 or clause 5.5.2.3 the University shall make good all
physical damage to the Premises caused by such entry and/or by the carrying out of any work permitted under
this Agreement .
1.4 Signs
Not to erect any sign poster or flag on the outside of the Premises or so as to be visible from the exterior of the
Premises
1.5 Social compatibility of Students
Not to behave nor allow visiting friends or guests to behave in a manner which might result in a breakdown of
the family group forming the household (the Tenant acknowledging that should such breakdown occur
withdrawal from the group will not be possible during the Term except as allowed for in clause 5.7)
1.6 Pets
Not to keep any animal or bird (including fish or reptiles) on the Premises except with the prior consent of the
University for guide dogs for the blind or visually impaired
1.7 Guests
Not to permit any person or persons to occupy or stay at the Premises other than those students comprising
the Tenant as specified in this Agreement although usual temporary visitors or guests may (with the approval
of the student group forming the household) be allowed to stay overnight at the Premises for reasonable
temporary short term periods set out in the Handbook
1.8 Unlawful Drugs
Not to bring onto the Premises any unlawful drugs or other such substances including but not limited to any
controlled drug under the Misuse of Drugs Act 1971 or other similar legislation
1.9 Noise and Parties
To restrict all noise (including music) emanating from the Premises to a reasonable level at all times and to
ensure that there is no audible noise outside of the Premises from 11.00 pm to 7.00 am except that where the
Tenant wishes to hold a party at the Premises he shall first notify the Head Leasing Service in writing and
obtain consent to such party from them and shall notify all neighbours of the Tenant and shall ensure that as
little disruption and disturbance to the neighbourhood is caused as possible and shall on such occasions ensure
that there is no audible noise outside of the Premises from 1.00 am until 7.00 am
1.10 Nuisance
To use all reasonable endeavours to ensure that no person residing at the Premises or any guest or visitor does
anything likely to cause inconvenience or annoyance or to be a nuisance to the University or any adjoining or
neighbouring occupiers
1.11 Regulations
To comply with the Regulations and any other regulations from time to time issued by the University in respect
of the use and occupation of the Premises and set out in the Handbook
1.12 Insurance
1.12.1 Not to do or allow to be done or fail to do or allow not to be done anything which will or might cause
the insurance of the Premises to become void or voidable or increase the insurance premium for such policy of
insurance
1.12.2 Not to allow or permit any naked flames or fires or other sources of combustion at or in the Premises
1. Regulations
1.1 Residents are subject to the general regulations of the University. These include behaviour in a manner
creditable to the good name of the University at all times and in all places
1.2 Noise emanating from the Premises (eg from stereos radios television sets loud conversations singing etc)
must be restricted AT ALL TIMES to a reasonable level so as not to intrude on the privacy of neighbours or to
disturb the other residents of the house. Special care is necessary to keep all noise to an acceptable level when
windows are open. In particular noise should be kept to a minimum during examination periods and after
11.00 pm
1.3 The outside doors and windows of the Premises must be kept locked at all times
1.4 Pictures and other decorations must not be attached to doors and walls in a manner that will damage the
wallpaper or wall surfaces. Adhesive tape or “Blu-tack” must not be used
1.5 Residents are required to keep the Premises in a clean and tidy condition to the satisfaction of the Head
Leasing Service staff who will arrange to visit the Premises from time to time. Residents failing to do this will
be charged the full cost of cleaning staff who will be brought in to do the necessary work if a situation is not
remedied within a stipulated period of time
1.6 Students are not permitted to install or store in the Premises any items of furniture or equipment which
are not easily portable and removable at the end of the contract period (except for a communal television set
in the common room or kitchen). Car batteries and heavy items which could cause damage to the Premises or
its contents are prohibited from the premises
1.7 Furnishings and fittings provided by the Premises owner must not be removed from the Premises.
Responsibility for the replacement cost of missing property rests with the occupants
1.8 Babies and children are not permitted to reside in the Premises let to self-selected groups of students
1.9 Residents are not permitted to sub-let their rooms at any time. Only the occupants named in this
Agreement may reside in the Premises
1.10 All serious cases of illness should be notified to the Head Leasing Service as soon as possible
2. Safety Regulations
2.1 Bicycles and other obstructions should not be left in hallways or on staircases or landings or anywhere
where they would hinder persons from leaving the premises quickly in an emergency
2.2 To avoid the risk of fire electric heaters should be situated such that any materials including curtains do not
touch the heaters. The use of radiant type electric fires with a heat-emitting bar or bars is prohibited
2.3 The use of double and triple adaptors which plug directly into mains sockets is not permitted (because they
place strain on the internal components of the socket, leading to poor connections arcing of current heat build
up and fire). It is permissible to use one 4-gang trailing socket so that a total of four appliances can be run off
the 13 amp outlet found in nearly all study bedrooms. Trailing sockets may be purchased from most electrical
shops. All appliances must be correctly wired with a three-pin plug suitably fused. All metal-bodied appliances
must be earthed.
2.4 Residents must not wire more than one appliance to one plug and the total load must not exceed 13 amps
2.5 If any faults are observed in switches time-clocks control gear and distribution boards and fuse boxes they
should be reported without delay
2.6 Hazards to other residents and visitors such as television sets which are precariously positioned on the top
of fridge/freezers are not acceptable
2.7 The use of fireworks in any property is a serious offence
2.8 Firearms, replica guns, air-weapons, crossbows, associated ammunition or paint ball weapons may not be
kept in Head Leased Houses nor discharged on such premises. Swords, martial arts devices and non-domestic
knives may not be kept on the premises
2.9 Residents are not permitted to store motorcycles/motor vehicles within the boundaries of the property in
which they have been living (including the front and back gardens and garage etc) beyond the date of expiry of
their residence agreement with the University (either term-time or vacation). Motor vehicles left beyond the
contract period will be assumed to have been abandoned and will be disposed of by Head Leasing contractors
at a charge to the students responsible.
3. Regulations Governing Parties
Queries regarding the holding of parties or social events inside or outside the houses or flats should be
directed to the Head Leasing Service
3.1 The House Representative shall ensure that the residents concerned inform all immediate neighbours well
in advance (a minimum of three days) and in the most polite manner that a party is to take place. The Head
Leasing Service must also be informed
3.2 In the interests of safety and the minimisation of damage to property party activities are to be confined to
the ground floor of the houses except for the use of upstairs lavatories and an upstairs room as a cloakroom.
In the case of flats the party must be confined within the individual flat
3.3 Professional discotheque equipment or the equivalent thereof is not to be used. Any equipment which
includes an amplifier should be controlled so that it does not disturb neighbours
3.4 When parties are held windows and external doors should be kept shut (to minimise noise disturbance
outside the premises) and regularly checked especially during warm weather. Arrivals and departures are to be
as rapid as possible. Prolonged and loud conversations on doorsteps are to be avoided
3.5 At all times positive steps should be taken by the residents of the houses to avoid loud noise. All disruption
to the neighbourhood whether it be directly because of the party itself or indirectly because of guests leaving
is to cease by 1.00 am. The noise generated by guests departing after this time will inevitably result in
complaints being made by neighbours (some of whom may have to rise early to go to work)
3.6 Immediately the party is over a safety check should be made for potential hazards such as burning
cigarette ends gas fires and cookers
3.7 Tidying up pots and glasses after a party makes a great deal of noise. Don’t wake up your neighbours with
the sound of crashing pots. Leave them until the morning!
3.8 The House Representative / Student Warden must be present throughout the party
3.9 Residents are responsible for the good conduct of their guests (and any damage caused by guests). All
residents under the guidance of the House Representative are responsible for complying with these
Regulations
3.10 If despite the best efforts of the House Representative and the residents an emergency situation
threatens or actually arises the residents are to notify immediately if necessary the Police and/or Security Staff
on duty at the University’s Security Office (telephone 01723 357266 or 362392)
3.11 Residents are liable to pay for any damage caused at a party unless the person responsible can be so
charged. If a complaint about any particular party is received it will be investigated by the Head Leasing Service
and if found to be justified the staff will:3.11.1 Take any necessary disciplinary action under the University Code of Discipline;
3.11.2 Consider banning any further parties in the offending house or flat for the remainder of the session
3.12 Head Leasing houses and flats are located in a very mixed neighbourhood. Many of the households in the
area have lived there since long before the student accommodation came into being. Some are old people who
have had to compromise to a substantial extent with a changing environment which is not to their liking; they
cannot influence it and lack of money prevents them from moving. Students living in the area must also
compromise and act as good neighbours thereby ensuring that householders feel that they are being treated
fairly and their rights respected
