All Covered Individuals must disclose a Financial Interest to the Vice Chancellor for Research or his or her designee in situations in which the Financial Interest may present a Conflict of Interest involving the use of students, technology transfer activities or the outcome of research that is performed or directed by that Covered Individual with significant use of University funds, facilities or equipment. In addition, some federal agencies and non-profit organizations may require disclosure of a Financial Interest under certain circumstances. Compliance with these policies is applicable to all externally-funded grants and contracts. Disclosures must be made prior to the submission of proposals for funding and institutions must develop specific mechanisms by which conflicts of interest will be satisfactorily managed, reduced, or eliminated prior to the expenditure of funds on any subsequent award. If a new reportable Significant Financial Interest develops at any time following the submission of a proposal but prior to the end of the project period of any subsequent award, the filing of a new disclosure is also required. Who is an “Covered Individual"? The term Covered Individual" includes the Principal Investigator, Program Director, Co-Investigator, and any other person who is responsible for the design, conduct, or reporting of research, educational, or service activities funded, or proposed for funding. "Significant Financial Interests" are anything of monetary value, including but not limited to salary or other payments for services (e.g., consulting fees or honoraria), equity interests (e.g., stocks, stock options or other ownership interests), and intellectual property rights (e.g., patents, copyrights and royalties from such rights) of the Investigator and the Investigator's spouse and dependent children. The term does not include: • Salary, royalties, or other remuneration from the University; • Income from seminars, lectures, or teaching engagements sponsored by public or nonprofit entities; • Income from service on advisory committees or review panels for public or nonprofit entities; • An equity interest that, when aggregated for the Investigator and the Investigator's spouse and dependent children, does not exceed $10,000 in value as determined through reference to public prices or other reasonable measures of fair market value and constitute more than a 5% ownership interest in any single entity; or • Salary, royalties or other payments that when aggregated for the Investigator and the Investigator's spouse and dependent children over the next twelve months, are not expected to exceed $10,000. What Significant Financial Interests must be Reported? Each Investigator must disclose all Significant Financial Interests: • that would reasonably appear to be affected by the research, educational, or service activities funded or proposed for funding, by an external sponsor; or • in entities whose interests would reasonably appear to be affected by such activity. How is Disclosure Made? (1) The Office of Research Administration provides a copy of the appropriate Disclosure forms to all persons who meets the definition of a ‘Covered Individual’. (2) Each Covered Individual must complete Section A or B of the Disclosure form and return it to ORA. (3) To report a Detailed Disclosure of Financial Interest, also complete page 2. Place the Detailed Dislcosure form in a sealed envelope marked ‘Confidential’ and submit it to ORA with the Proposal Routing form and Summary Disclosure Form. (4) The Detailed Disclosure Form will be forwarded to the Director of institutional Compliance, 2 nd Floor Wannalancit (Elaine_Major@uml.edu) for review and evaluation.
