Legal: OSH Act of 1970 General Duty Clause Sec. 5. Duties (a) Each employer (1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees; (2) shall comply with occupational safety and health standards promulgated under this Act. (b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct. Employers are legally bound to “ensure that all employees understand the hazards to which they are exposed and how to prevent harm to themselves and others from exposures to these hazards? Six months ago, the office area was downsized. Candace and Ken now share an office. Robert is alone in a small office next door to them. And it begins… Kens clutter is overwhelming the space. Candace receives constant visitors and phone calls throughout the day. Ken can’t concentrate on his work and has been unable to keep up with his reports. Candace tells Robert items are falling off Ken’s shelves and she’s afraid she might be hit. Ken complains to you about the noise. What are the issues here? Candace is always cold. You provide her with a workstation warmer but it does not give off enough heat, so she brings in her own space heater. The heater makes the room too hot for Ken. He sweats profusely. His ineffective deodorant is evident. The hot room makes the air very dry, aggravating his allergies. Candace brings in a jar of potpourri to counteract the odor. What are the issues here? How could this situation have been prevented? You and she investigate and discover that Robert is in his office using a flammable spray adhesive to make his weekly inventory poster. The Safety person asks you for the MSDS for the adhesive. You vaguely remember hearing the term. What are the issues here? How could this situation have been prevented? Robert spots the binder on the shelf above Ken’s desk. He reaches for it and as he pulls it off the shelf, five large heavy binders begin to fall. One lands on his wrist leaving a large and painful red bump. The next day, Robert calls in to tell you about his wrist and he’s going to his doctor. Turns out his wrist is fractured.
