Associated Students of

Article I.

Associated Students of Fort Lewis College

The Associated Student of Fort Lewis College (ASFLC) is afforded its power to serve the student body through the College’s Board of Trustees. This Constitution shall be the primary governing document of the governing body known as the “Associated Students of Fort Lewis

College.” The Associated Students of Fort Lewis College shall also be governed by a set of

Bylaws and a Procedures and Binding Rules (Protocols) Manual.

Article II.

Statement of Purpose

The Associated Students of Fort Lewis College, acting with exemplary character, originality, and in harmony with the values of the College community, will respectfully advocate for a studentcentered agenda promoting general well-being, effective communication, informed leadership, and efficient use of student resources.

Article III.

Student Senate

Section 1

. Powers

A. To make decisions regarding the allocation of the revenue generated by the Student

Activities Fee.

B. To make recommendations to the Faculty Senate, Administration, and Board of

Trustees regarding issues affecting the Student Body of Fort Lewis College.

C. To request information from the Administration, faculty, and Board of Trustees regarding issues affecting the Student Body of Fort Lewis College.

D. To take an official position on behalf of the Student Body of Fort Lewis College regarding actions taken by the State of Colorado.

E. To request sufficient clarification on a Resolution from the salient committee prior to a vote. To make such a request, a majority, or more than half, of Senators must present a petition to the chair of the committee in question.

F. To elect a Speaker of the Senate to the Executive Board at the beginning of each term.

G. To override an Executive Board veto of a Resolution with a two-thirds (2/3) vote.

Section 2

. Composition

A. The Student Senate shall consist of no more than fifteen (15) Senators.

B. To be eligible to hold office, a Senator must have successfully completed twelve (12) college credits at Fort Lewis College, be enrolled as a full-time student as defined by Fort

Lewis College, must not be on disciplinary probation or any more severe sanction, be in good academic standing, and maintain a 2.0 cumulative Grade Point Average.

Section 3

. Meetings

A. Regular meetings shall be held once (1) per active school week of the Fall and Spring semesters. The agenda for each meeting shall be publicly posted forty-eight (48) hours prior to each meeting being convened. Minutes of each meeting shall be publicly posted no later than forty-eight (48) hours following the adjournment of each meeting.

B. Special meetings may be requested, in writing, to the Chief Parliamentarian by all officers of the Executive Board or by a two-thirds (2/3) vote by the Student Senate.

Special meetings must be called twenty-four (24) hours prior to the meeting being convened. The agenda for the emergency meeting must be publicly posted twelve (12) hours prior to the meeting being convened. The minutes of the emergency meeting shall be publicly posted no later than forty-eight (48) hours following the adjournment of the emergency meeting.

Article IV.

Executive Board

The Associated Students of Fort Lewis College Executive Board shall consist of a Student Body

President, a Student Body Vice President, and a Speaker of the Student Senate.

Section 1

. Student Body President

A.

Powers i.

To communicate the position of the Associated Students of Fort Lewis College to the faculty, staff, Administration, and the Board of Trustees. ii.

To represent the Associated Students of Fort Lewis College at Colorado Student

Government Coalition assemblies. iii.

To appoint Committee Chairs and Court Justices. iv.

To exercise the Executive Board veto. See Article IV. Section 4.

Section 2

. Student Body Vice President

A. Powers i.

Preside over Senate meetings. ii.

In the event neither Parliamentarian is present during a meeting, the Student Body

Vice President will assume the powers of the Chief Parliamentarian for that meeting. iii.

The Student Body Vice President, complying with the Bylaws or the Procedures and

Binding Rules Manual, shall set the protocol of the Associated Students of Fort Lewis

College. iv.

To exercise the Executive Board veto. Please see Article IV. Section 4.

Section 3

. Speaker of the Senate

A. Powers i.

To request sufficient clarification on a Resolution from the salient Committee prior to a vote on said Resolution. This may only be done once (1) per resolution. ii.

To assign Student Senators to Committees. iii.

To appoint Parliamentarians. iv.

In the event the Study Body Vice President is absent during a meeting, the Speaker of the Senate will assume the power set forth in Article IV, Section 2, Subsection A i.-ii. v.

To exercise the Executive Board veto. Please see Article IV. Section 4.

Section 4.

The Power of Executive Board Veto

A.

The Executives shall have the power to veto any resolution of the Student Senate by a two-thirds (2/3) vote of the Executive Board.

Section 5.

Composition

A.

The Executive Board shall consist only of the Student Body President, Student Body

Vice President, and Speaker of the Senate.

B.

To be eligible to hold office, Executives must have successfully completed twelve (12) college credits at Fort Lewis College, be enrolled as a full-time student as defined by Fort

Lewis College, must not be on disciplinary probation or any more severe sanction, be in good academic standing, and maintain a 2.0 cumulative Grade Point Average.

Article V.

Student Court

Section 1

. Powers

A.

The Student Court has the power to review any appealed resolution or action of Student

Senate for constitutionality. The student court may overturn any Resolution or action of

Student Senate deemed unconstitutional.

B.

The Student Court shall also review appealed discipline. The Fort Lewis College

Administration may review any decision made by the Student Court, and any party may appeal any decision by the Student Court to Fort Lewis College Administration.

Section 2

. Composition

A.

The Student Court shall be made up of no more than three (3) students who meet the qualifications of a student senator. Student Court Justices may not serve in any other capacity in the Associated Students of Fort Lewis College during their term.

B.

To be eligible to hold office, a Court Justice must have successfully completed twelve

(12) college credits at Fort Lewis College, be enrolled as a full-time student as defined by

Fort Lewis College, must not be on disciplinary probation or any more severe sanction, be in good academic standing, and maintain a 2.0 cumulative Grade Point Average.

Section 3

. Appointment

A.

The Student Body President shall appoint members to the court as needed. Upon appointment, the member of Court shall be considered active. Upon appointment, the

Court Justice will serve until the end of the term during which she/he was appointed.

Court Justices may be re-appointed for a new term.

Article VI.

Committees

These Committees will be delegated power by the Associated Students of Fort Lewis College as necessary.

Section 1

. Constitution Committee

A.

The Committee shall consist of at least one (1) Student Senator and no more than (2)

Student Senators. The Chief Parliamentarian and Assistant Parliamentarian shall also be full members of the Constitution Committee.

B.

There shall be a designated time for the Committee to meet within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Section 2

. Student Services Committee

A.

The Committee shall consist of at least two (2) Senators and no more than six (6)

Senators.

B.

There shall be a time for the Committee to meet designated within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Section 3

. Legislative Affairs Committee

A.

The Committee shall consist of at least two (2) Senators and no more than four (4)

Senators.

B.

There shall be a designated time for the Committee to meet within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Section 4.

Financial Allocation Board

A.

Financial Director i.

Responsibilities a.

The Financial Director shall be responsible for processing all requests for funds to be allocated by the Associated Students of Fort Lewis College. b.

The Financial Director shall be responsible for providing information to all members of the Associated Students of Fort Lewis College regarding requests for funds and budgetary information. ii.

Appointment a.

At the beginning of each term of office, the Student Body President and the

Student Body Vice President shall appoint a Financial Director. In addition to meeting the requirements of a Student Senator, the Financial Director must also have successfully completed ACC225 or an equivalent accredited accounting course with a grade of “C” or better. b.

Will be a paid position and will work up to twenty (20) hours per week during the Fall and Spring semesters.

B.

The Board shall consist of at least one (1) and no more than three (3) Student Senators, the Student Body Vice President, and the Financial Director.

C.

There shall be a time for the Committee to meet designated within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Section 5

. Elections Committee

A.

The Committee shall consist of all Student Body Senators and Executives with strict enforcement of election protocols done by the Parliamentarians.

B.

The Committee Chair must be filled by a Student Body Senator not running in the upcoming election. If all Student Body Senators are running in the election, the Chief

Parliamentarian shall appoint a Committee Chair.

C.

There shall be a time for the Committee to meet designated within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Section 6.

Public Relations Committee

A.

The Committee shall consist of at least two (2) Senators and no more than six (6)

Senators.

B.

There shall be a time for the Committee to meet designated within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Section 7.

Ad Hoc Committees

A.

An Ad Hoc Committee may be formed whenever an issue arises that necessitates attention separate of the standing committees.

B.

Any Ad Hoc Committee may be made by a Resolution of Student Senate. The Resolution creating the committee must explicitly state the composition, means of appointment, meeting, responsibilities, and lifetime of the committee. A Resolution creating an Ad Hoc

Committee must pass by a majority, or more than half, vote of Student Senators. The committee must then, in its first meeting, decide upon its own meeting schedule.

C.

An Ad Hoc Committee may be filled by anyone deemed useful or necessary to the committee, so long as they are students, faculty, or community figures.

D.

There shall be a time for the Committee to meet designated within Procedures and

Binding Rules. If the Committee decides to hold an official meeting outside the regularly scheduled time, at least half of the members must be present.

Article VII.

Terms, Appointments, and Resignations

Section 1.

Student Senate

A.

Elected Senators i.

Up to fifteen (15) Student Senators shall be elected in the Spring semester. Terms shall begin during the final meeting of the Spring semester in which the Senators were elected. The term shall terminate at the end of the last meeting of next Spring

Semester. ii.

Student Senate elections shall be held at large. iii.

The fifteen (15) candidates with the most votes shall be Student Senators-elect.

B.

Appointed Senators i.

If fewer than fifteen (15) Senators are on the table at the beginning of a new semester, the Student Senate, shall have the power to appoint Senators with a twothirds (2/3) vote for three (3) weeks from the first day of classes.

7 ii.

An appointed Student Senator’s term shall end during the last meeting of the Spring semester following his/her confirmation vote. iii.

Candidates for appointment must be interviewed and approved by the Student Body

President, Student Body Vice President, and Speaker of the Senate prior to receiving a confirmation vote from the Student Senate.

C.

Resignations i.

If a Student Senator is unable to finish the term, he/she must submit a resignation in writing to the Chief Parliamentarian prior to leaving office.

Section 2.

Executive Board

A.

Student Body President and Vice President i.

A Student Body President and Student Body Vice President shall be elected on the same ticket in the Spring semester. The term for the Student Body President and Vice

President shall begin one (1) week prior to the end of the Spring semester in which they were elected. The term shall terminate one (1) week prior to the end of the following Spring semester. ii.

To be eligible, candidates must be enrolled in at least twelve (12) Fort Lewis College credits and have successfully completed twelve (12) Fort Lewis College credits. iii.

Elections shall be at large. The ticket with a plurality, or having the most votes, shall be considered elected.

B.

Speaker of the Senate i.

A Speaker of the Senate shall be elected by a majority, or more than half, vote from the Student Senate during the first Associated Students of Fort Lewis College meeting of the new term. ii.

To be eligible, Candidates must have been elected to the Student Senate for the term they wish to serve as Speaker.

C.

Resignations and Succession. i.

If the Student Body President is unable to fulfill the term of office, he/she must submit a resignation in writing to the Chief Parliamentarian prior to leaving office.

Upon leaving office, the Student Body Vice President shall assume the office of

Student Body President. If both the Student Body President and Vice President are unable to fulfill the term of office, the Speaker of the Senate shall assume the office of Student Body President. If no Officer of the Executive Board is able to fulfill the term of office, a special election shall be called by the Chief Parliamentarian. ii.

If the Student Body Vice President is unable to fulfill the term of office, he/she must submit a resignation in writing to the Chief Parliamentarian prior to leaving office.

Upon leaving office, the Speaker of the Senate shall assume the office of Student

Body Vice President. If the Speaker of the Senate is unable to fulfill the term of office, the Student Body President may appoint a Student Body Vice President. The

Student Senate must confirm the appointee with a two-thirds (⅔) vote. iii.

If the Speaker of the Senate is unable to fulfill the term of office, he/she must submit a resignation in writing to the Chief Parliamentarian two (2) weeks prior to leaving office. Upon leaving office, the Student Senate shall elect a new Speaker.

Article VIII.

Parliamentary Authority

Section 1

. Robert’s Rules of Order

Parliamentary authority shall be based upon the latest edition of Robert’s Rules of Order.

Specific rules of parliamentary procedure shall be outlined in the Procedures and Binding Rules

Manual.

Section 2

. Parliamentarians

A.

The Associated Students of Fort Lewis College shall have a Chief Parliamentarian and a

Vice Parliamentarian. Parliamentarians must be enrolled as full time students of Fort

Lewis College.

B.

The Parliamentarians shall be responsible for the enforcement of parliamentary procedure as well as enforcement of all protocols. The Parliamentarians shall be responsible for educating Associated Students of Fort Lewis College members on the workings of parliamentary procedure. The decisions of the Chief Parliamentarian will take precedent.

C.

The Chief Parliamentarian and Vice Parliamentarian shall be appointed by the Speaker of the Senate and must be confirmed with a two-thirds (⅔) vote by the Student Senate.

Upon confirmation, Parliamentarians may serve until the end of the Spring semester.

Parliamentarians may be re-appointed at the beginning of a new term.

D.

In the event no Parliamentarian is present, the Student Body Vice President may temporarily assume the position of Parliamentarian. Failure to have least one (1)

Parliamentarian position filled for three (3) consecutive meetings will result in the

Associated Students of Fort Lewis College not being allowed to meet until the Speaker of the Senate makes an appointment of the position.

Article IX.

Impeachment

Section 1.

Articles of Impeachment

A.

Articles of Impeachment may be brought by a Student Senator against a member of the

Associated Students of Fort Lewis College accused of violating the Constitution, Bylaws, or Protocol. In order to discuss Articles of Impeachment, the Articles must be seconded.

B.

The Student Senate, upon hearing all arguments, may approve the Articles by a twothirds (2/3) vote. If the accused member is a Student Senator, he/she shall be allowed to vote.

If the Articles are adopted by the Student Senate, the Student Court shall be convened to pass judgment.

C.

It will fall on the Student Senator sponsoring the Articles to prove the guilt of the accused member before the Student Court. The accused member shall be given the opportunity to defend himself/herself and have no obligation to self-incriminate. Upon hearing all arguments, the Student Court may find the accused member either guilty or not-guilty by a majority vote. If the Court is evenly divided or a majority of the Student Court finds the accused not-guilty, the accused member shall be acquitted of all charges. Upon acquittal the accused member may not be impeached again for the same incident. If the accused member is found guilty by the Student Court, he/she shall be removed from office immediately.

Article X.

Amendment

Section 1.

Amendments to the Constitution

A.

Any Student Senator may propose an Amendment to the Constitution. Then the Student

Senate must approve the proposed Amendment by a unanimous vote. If the Amendment fails in the Student Senate, then the Proposed Amendment may be put before the Student

Body during the Spring election by a two-thirds (2/3) vote from the Student Senate. If the proposed Amendment receives a positive majority from the voting Student Body, it will go into effect.

Section 2.

Amendments to the Bylaws

A.

Any Student Senators, Senate Parliamentarian, or Executive Officer may propose an

Amendment to the Bylaws. Then the Student Senate must approve the proposed

Amendment by a two-thirds (2/3) vote. The proposed Bylaw must then be signed by two of three (2 of 3) Executive Board Officers. Upon these signatures, the Bylaw shall go into effect.

Article XI.

Ratification

Section 1.

A.

The Constitution Committee shall submit this proposed Document to the Associated

Students of Fort Lewis College Advisors. Upon the Document’s approval from the

Advisors, it shall be reviewed by the Fort Lewis College Attorney.

B.

Following the approval outlined above, the Constitution Committee shall submit this

Document to the Associated Students of Fort Lewis College. The Student Senate must approve this Document by a two-thirds (2/3) vote and receive the signature of the Student

Body President.

C.

Following the approval of the Associated Students of Fort Lewis College, this Document shall be submitted to the Vice President of Student Affairs, who shall submit this

Document to the Board of Trustees for approval.

D.

Upon approval from the Board of Trustees, this Document shall be ratified.

BYLAWS

BYLAW I : OFFICERS

A.

Duties of the Officers

1.

To represent the Fort Lewis College Student Body at all functions that the College

President, College, or the Student Senate may deem necessary.

2.

To attend Student Senate meetings regularly.

3.

To meet regularly with the Associated Students of Fort Lewis College Advisors.

4.

To hire and supervise all paid Associated Students of Fort Lewis College personnel.

B.

Duties of the Student Body President

1.

Represent the interests of the Student Body to the Fort Lewis College Board of

Trustees, faculty, and Administration.

2.

To act as a liaison between the Associated Students of Fort Lewis College, Fort

Lewis College Board of Trustees, and the Fort Lewis College Student Body.

3.

The Student Body President shall be the Fort Lewis College Representative to the

Colorado Student Government Coalition.

4.

To keep the Associated Students of Fort Lewis College informed of faculty and

Administration current events.

5.

To serve as an ex-officio member of the Institutional Fee Review Board.

C.

Duties of the Student Body Vice President

1.

To serve as an ex-officio member of all Associated Students of Fort Lewis College committees.

2.

To fulfill all duties of the Student Body President in the absence of the President.

3.

To guide and coordinate the efforts of the Student Senate.

4.

To preside over the Student Senate meetings.

5.

To ensure preparation, publication, and distribution of the Student Senate agenda and minutes, and a correct, complete, and properly indexed record of the minutes on file.

6.

To determine the outcome of a tie vote in the Student Senate.

7.

To oversee the performance of the Financial Director and the Financial Allocation

Board.

8.

To ensure the formulation of the Associated Students of Fort Lewis College Budget for the following Fiscal year.

9.

To present to the Financial Allocation Board a budget for the operation of the Senate and ASFLC offices for the following fiscal year.

BYLAW II : SENATORS

A. Duties of Student Senators

1.

To attend Student Senate meetings regularly, and participate in all Discussions and

Action Items.

2.

To attend meetings of the Associated Students of Fort Lewis College Committees of which they are a member.

3.

To work as representatives of the Fort Lewis College Student Body.

4.

To represent the Student Body at any function deemed necessary by the Associated

Students of Fort Lewis College.

5.

To budget and allocate student funds.

6.

To spend at least one (1) hour time commitment in the senate office each week performing senatorial duties.

7.

To participate where necessary to ensure the efficacy of the Associated Students of

Fort Lewis College.

BYLAW III : Paid Positions

A. Duties of the Financial Director

1.

The Financial Director shall regularly attend Student Senate meetings.

2.

The Financial Director shall miss no more than one (1) of the regularly scheduled meetings of the Financial Allocation Board. Dismissal shall occur immediately.

3.

To oversee the governance, coordination, and organization of Registered Student

Organizations.

4.

To chair each meeting of the Financial Allocation Board.

5.

To have signatory approval on all expenditures of all Registered Student

Organizations I.

6.

To coordinate the annual budget process.

7.

To maintain an accurate accounting for all grant allocations, unallocated accounts,

Registered Student Organizations Presidents meetings, and Registered Student

Organization meeting minutes.

8.

To maintain the budget of the Associated Students of Fort Lewis College.

B. Duties of the Administrative Assistant.

1.

To keep and organize meeting minutes for both the Financial Allocation Board and the Associated Students of Fort Lewis College.

2.

To prepare and post the agenda and minutes of each meeting of the Associated

Students of Fort Lewis College.

BYLAW IV : Parliamentarians

A.

Duties of Parliamentarians

1.

To attend Student Senate meetings regularly.

2.

To ensure the Associated Students of Fort Lewis College is running according to protocol.

3.

To enforce all parliamentary procedures within the meetings of the Associated

Student of Fort Lewis College.

4.

To act as members of the Student Senate’s Constitution Committee.

BYLAW V : Suspension and Alteration of Protocol

A.

Parliamentary Procedure may be suspended by a majority vote of the Student Senate.

B.

Rules as set forth in the rules and procedures manual may be changed by a majority vote.

BYLAW VI : Standing Committee Duties

A.

Constitution Committee

1.

To maintain the Associated Students of Fort Lewis College Constitution, Bylaws, and

Protocols.

2.

To advise the Associated Students of Fort Lewis College on amendments or revisions to the Associated Students of Fort Lewis College Constitution, Bylaws, and

Protocols.

B.

Election Committee

1.

To be responsible for coordinating all aspects of Associated Students of Fort Lewis

College elections.

C.

Legislative Affairs Committee

1.

To maintain an ongoing surveillance of bills and other proposed legislative action whether it is federal, state or local, that might affect Fort Lewis College in any way.

2.

To keep contacts with legislative organizations in order to more effectively monitor national, state, and local legislation concerning higher education and Fort Lewis

College.

3.

To bring resolutions to the Student Senate concerning any legislative action that affects Fort Lewis College.

4.

To advise the Associated Students of Fort Lewis College on policies pertaining to the

Colorado Student Government Coalition.

D.

Student Services Committee

1.

To investigate the needs of students.

2.

To evaluate the efficiency of the student services provided by the Associated Students of Fort Lewis College and Fort Lewis College.

3.

To provide recommendations to the Student Senate regarding student needs and the efficiency of services provided.

4.

At least one member shall attend all Multi Modal Advisory Board (MMAB) monthly meetings.

5.

In the fall semester, Student Services Committee shall conduct a student survey aimed at assessing student needs.

E.

Financial Allocation Board

1.

The purpose of the Financial Allocation Board is to allocate funds to Registered

Student Organizations, register and hold Student Organizations accountable for use of student fees, and act as a liaison between the Associated Students of Fort Lewis

College and all Registered Student Organizations. The Financial Allocation Board receives authority through the Associated Students of Fort Lewis College.

F.

Public Relations Committee

1.

To inform the Fort Lewis College Student Body on the events of the faculty, the

Administration, the Board of Trustees, and the Associated Students of Fort Lewis

College.

2.

To advertise for the Associated Students of Fort Lewis College and its events.

BYLAW VII : Budget and Allocation

1.

Financial Allocation Board a.

The Financial Allocation Board receives authority through the Associated

Students of Fort Lewis College. b.

The purpose of the Financial Allocation Board is to make recommendations regarding the allocation of funds and registration of Student Organizations, hold student organizations accountable for use of allocated funds, act as a liaison between the Associated Students of Fort Lewis College and all Registered Student

Organizations, and to administer the Sustainability Initiative Grant.

2.

FAB Duties a.

Annual Budget Recommendation i.

The Financial Allocation Board is responsible for reviewing budget requests and submitting a budget recommendation. The annual budget for the fiscal year shall be prepared and presented for approval from the

Associated Students of Fort Lewis College in the Spring semester of each year. The budget shall consist of funds allocated to each Registered

Student Organization II and Registered Student Organization III as well as funds reserved for Initial allocations for level I RSOs, Travel Grants, and

Event Grants. The budget shall be prepared using revenue projections from the College Budget Office. ii.

The Financial Allocation Board will allocate an initial $100.00 to each

Registered Student Organization I in good standing registering in the

Spring semester according to deadlines as defined by the binding agreements per academic year. If Registered Student Organizations I do not apply by the deadline, they will receive a $50.00 allocation. These funds will be available upon registration and approval from the Financial

Allocation Board and the Associated Students of Fort Lewis College, in a reasonable and timely manner. iii.

All decisions regarding the initial budget recommendation will follow all rules and regulations set forth. The Financial Allocation Board shall review budget requests according to all protocols. b.

Financial Allocation Board Grant Recommendations i.

The Financial Allocation Board has the authority to review and recommend the approval of event grants.

Event grants are intended primarily for Registered Student

Organizations I.

2.

A Registered Student Organization will only be eligible for two (2) event grants per academic year, one (1) per academic semester.

3.

Registered Student Organization officers wishing to submit an event grant proposal to the Financial Allocation Board must submit the proposal to the Financial Director at least 14 days prior to the beginning of the event.

4.

The event must directly support the Registered Student

Organization mission, goals, and core purpose as stated on the annual registration form.

5.

The Registered Student Organization must be a primary and active member of the planning of the event and be the sole contact with the Associated Students of Fort Lewis College or the Leadership

Center Staff. ii.

Financial Allocation Board has the authority to review and recommend the approval of travel grants.

1.

Travel grants are intended primarily for Registered Student

Organizations I.

2.

A Registered Student Organization will only be eligible for two (2) travel grants per academic year, one (1) travel grant per academic semester.

3.

Registered Student Organization officers wishing to submit a travel grant proposal to the Financial Allocation Board must submit the proposal to the Financial Director at least 14 days prior to the beginning of the travel. iii.

The Financial Allocation Board has the authority to review and recommend the approval of Sustainability Initiative Grants.

1.

Any Sustainability Initiative will be eligible for only one (1) grant per academic year.

2.

All sustainability initiative grant proposals must be in accordance with the Fort Lewis College Sustainability Action Plan.

3.

All Sustainability Initiatives Grant proposals must be submitted by the third Thursday of October for review for the academic year. iv.

Registered Student Organizations cannot request travel or event grants on behalf of non-Registered Student Organizations nor other Registered

Student Organizations. v.

The Financial Allocation Board will evaluate grant requests in compliance with viewpoint neutrality. vi.

Travel, event, and sustainability grants may not be used for any of the following:

1.

Salaries, stipends, wages, or scholarships.

2.

Individual membership dues to any Registered Student

Organization or any organization. vii.

The Financial Allocation Board will make a decision on sustainability initiatives on a different day following the hearing process.

15 viii.

Representation from the Registered Student Organization requesting grant funds must be present during the specified meeting that the grant proposal is to be reviewed by the Financial Allocation Board. If no representation is present, said grant shall be postponed for up to two consecutive meetings. After that time, a new grant proposal must be submitted in order to request funds. ix.

Travel, event, and sustainability grants should be used within a reasonable time frame as determined by the Financial Allocation Board and the

Associated Students of Fort Lewis College. x.

The Registered Student Organization name must be included on all publicity for the event or program receiving financial support through the

Financial Allocation Board and the Associated Students of Fort Lewis

College. It must also include the Associated Students of Fort Lewis

College logo and disclaimer.* c.

Transactions in the Student Activity Fee Budget and the Sustainability Initiative

Fee Fund i.

All transactions in the Student Activity Fee and Sustainability Initiative

Fee Funds shall follow Fort Lewis College financial procedures. All receipts designated for this fund shall be deposited with the Fort Lewis

College Business Office. ii.

The Student Body Vice President shall sign all financial documents for

Associated Students of Fort Lewis College expenditures. iii.

The Associated Students of Fort Lewis College, through the Financial

Allocation Board, shall have the authority to disperse funds for any activity which, in the viewpoint neutral opinion of the Associated Students of Fort Lewis College, benefits the Associated Students of Fort Lewis

College membership, the mission and goals of the Associated Students of

Fort Lewis College as described in the Constitution, or the operation of the

Associated Students of Fort Lewis College. iv.

Senate shall restrict the expenditures of monies from the fund balance account to one-time capital expenditures; roll forward of excess budget due to fundraising, emergencies, and other unique circumstances. The initial request must be approved by the Financial Allocation Board prior to a vote from the Associated Students of Fort Lewis College. Any modification after the Financial Allocation Board approval shall require the approval of the Associated Students of Fort Lewis College. The

Associated Students of Fort Lewis College is the only organization which has access to the fund balance. d.

Final Student Activity Fee Budget Approval i.

All budgets will be presented by the Financial Director to the Associated

Students of Fort Lewis College for approval, and must be approved through a Resolution of the Associated Students of Fort Lewis College. ii.

All Registered Student Organizations II and III will present a budget to the

Financial Allocation Board for initial consideration. iii.

The presentation of budget must be presented to the Associated Students of Fort Lewis College by the first Meeting of April.

16 iv.

The Student Senate and Executive Council shall appropriate one line within the Associated Students of Fort Lewis College Unallocated Budget that will be specifically allocated to Registered Student Organizations I for initial allocations. v.

The final budget approved by the Associated Students of Fort Lewis

College shall require affirmative votes of two-thirds (2/3) of the total

Student Body Senate. vi.

The budget shall be approved by the Associated Students of Fort Lewis

College no later than the second to last meeting of the term, and become effective July 1 of the subsequent fiscal year. Any unexpected student fee funds shall revert to the Associated Students of Fort Lewis College fund balance. vii.

The budget, after the Associated Students of Fort Lewis College approval, shall be presented to the Fort Lewis College Budget Office for final approval by the Board of Trustees of Fort Lewis College. e.

Fiscal Responsibilities i.

The Financial Director will represent decisions made by the Financial

Allocation Board. ii.

The Financial Allocation Board will not allocate more than twenty percent

(20%) of the initial balance of any grant fund to a single organization over the period of an academic year. This does not apply to Sustainability

Initiative Grants. iii.

The Financial Allocation Board may not allocate any funds to a Registered

Student Organization or student group with a non-student membership exceeding twenty-five percent (25%) of the total membership. This calculation shall exclude faculty advisors. f.

Appeals Process i.

All appeals of the Financial Allocation Board decisions will be directed to and reviewed by the Student Body Court. ii.

More information is available in the Financial Policies and Procedures.

3.

Definition of the Levels of an Registered Student Organization a.

Level I Registered Student Organizations: i.

Will not have a Financial Allocation Board allocated budget other than their initial allocation. ii.

Will be focused more on the individual needs and interests of students. iii.

Minimum of four active members including a President, Vice President,

Treasurer, and Secretary to become registered or to renew Level I status. iv.

Will have a Fort Lewis College faculty or staff member serving as an advisor. b.

Level II Registered Student Organizations: i.

Will have an annual budget as approved by the Financial Allocation Board and the Associated Students of Fort Lewis College each fiscal year. ii.

Will focus more on campus wide student needs and interests.

17 iii.

Must have been a Registered Student Organization I for at least four (4) academic semesters and have shown substantial campus and/or community involvement and participation. iv.

Will have a Fort Lewis College faculty or staff member serving as an advisor. v.

Must show diversity in events and programming. vi.

Must have Bylaws or a constitution on which the Student Organization runs. These governing laws must be shown to the Financial Allocation

Board and the Associated Students of Fort Lewis College each budget season. c.

Level III Registered Student Organizations: i.

Will have an annual budget as approved by the Financial Allocation Board and the Associated Students of Fort Lewis College Senate each fiscal year. ii.

Will focus more on campus wide student needs and interests. iii.

Must have been a Registered Student Organization II for at least four (4) academic semesters and have shown substantial campus and/or community involvement and participation. iv.

Will have paid positions for administrative and/ or advisor positions. v.

Must show diversity in events and programming. vi.

Must have a constitution or bylaws that the organization is held to. These governing laws must be shown to both the Financial Allocation Board and the Associated Students of Fort Lewis College each budget season. d.

Changing the level of a Registered Student Organization i.

To increase or decrease the level of a Registered Student Organization there must be a 2/3 vote of the Financial Allocation Board and approval from the Associated Students of Fort Lewis College. ii.

Each Registered Student Organization II and III will be reviewed each budget season as to their Registered Student Organization status level. If the Financial Allocation Board and the Associated Students of Fort Lewis

College approves a change to the level, then the change would take place starting in the following academic calendar year. iii.

Registered Student Organization Probation

1.

If a Registered Student Organization II or III does not meet the requirements of their current level as deemed by the Financial

Allocation Board then the Registered Student Organization will enter a probationary period in the following academic calendar year. This probationary period would be for the entire academic calendar year. As part of the probationary period the Student

Organization’s budget will be cut by 50% of the current year’s total.

2.

During the Spring semester of the probationary year, the Student

Organization in probation would be invited to the budget hearings and would then be either relegated to the next Registered Student

Organization Level down or taken out of probation and therefore go through the same budget process as all Registered Student

Organizations II and III.

18 iv.

Registered Student Organizations applying to increase their Level must apply and be officially approved by both the Financial Allocation Board and the Associated Students of Fort Lewis College for new Level by the end of the Fall semester. Applications will only be accepted in the fall semester. After approval they will be invited to the budget process in the

Spring semester. v.

This decision will be made when:

1.

A Registered Student Organization does not fit the definitions of its current Level and would be better categorized on another Level.

2.

Financial irresponsibility is documented.

3.

A Registered Student Organization is not following Binding

Agreements.

4.

Membership a.

Financial Director: Committee Chair. i.

Maintains voting privileges in the case of a tie vote. b.

Three Student Body Senators: Appointed by the Student Body Vice President with two-thirds confirmation of the Student Body Senate. i.

Maintain full voting privileges. c.

Level I Registered Student Organization Representatives: Two non-Student Body

Senators appointed by the Financial Director and confirmed by a two-thirds (2/3) vote of the Student Body Senate. i.

Maintain full voting privileges. d.

Level II Registered Student Organization Representative: One non-Student Body

Senator appointed by the Financial Director from one-half (1/2) of the RSO IIs and confirmed by a two-thirds (2/3) vote of the Student Body Senate. i.

Maintains full voting privileges. ii.

Each Registered Student Organization II will have representation on the

Financial Allocation Board every other year rotating with the other half of the Registered Student Organizations II. e.

Level III Registered Student Organization Representative: One non-Student Body

Senator appointed by the Financial Director from each Registered Student

Organization III and confirmed by a two-thirds (2/3) vote of the Student Body

Senate. i.

Maintains full voting privileges. ii.

Sits for one academic year. f.

Unaffiliated Representative: Up to two members of the general student body not affiliated with the Associated Students of Fort Lewis College appointed by the

Financial Director and confirmed by a two-thirds (2/3) vote of the Student Body

Senate. i.

Maintains full voting privileges. ii.

Sits for one academic year. g.

Fort Lewis College Budget Director i.

Non-voting Ex-officio. ii.

Will be present as needed. h.

Student Body Vice President i.

Non-voting Ex-officio.

Responsible to provide guidance as needed and requested by the Financial

Director and Financial Allocation Board. iii.

Responsible to oversee and evaluate the performance of the Financial

Director and the Financial Allocation Board with regards to the opinions expressed by the Financial Allocation Board.

5.

Selecting/Removing the Financial Director a.

The Financial Director will be interviewed at least by the Student Body Vice

President. b.

The Student Body Vice President shall appoint the Financial Director with agreement from the Student Body President. c.

Removal of the Financial Director shall be done through the regular Associated

Students of Fort Lewis College impeachment process.

6.

Terms for Financial Allocation Board Members a.

Terms for all voting members will be one academic year. b.

Financial Allocation Board members may serve more than one (1) term. c.

Removal of Financial Allocation Board members will be done through the regular

Associated Students of Fort Lewis College impeachment process.

7.

Meetings a.

In order to conduct business, a quorum is necessary. A quorum will consist of a simple majority (i.e., ½ + 1) of the voting representatives. b.

Unless otherwise specified, all votes will need a majority of present members to pass. c.

The Financial Allocation Board shall conduct meetings once (1) per week during the regular academic year, excluding the first week of class, college breaks, and the week of finals. These meetings shall be announced in compliance with

Colorado Sunshine Laws. d.

All Financial Allocation Board meetings shall be open to the public. e.

The Financial Director will see that minutes are taken and posted by Friday following the meeting publicly. f.

The agenda for Financial Allocation Board meetings will be posted in the Student

Union Building Associated Students of Fort Lewis College posting area in the lobby 5 days prior to all Financial Allocation Board meetings.

8.

Officers a.

Qualifications and Duties of the Financial Director i.

Qualifications

1.

At the time of appointment, candidates for Financial Director must have successfully completed at least twelve (12) college credit hours and have a minimum cumulative grade point average of 2.0.

2.

Be enrolled in at least 12 credit hours, as verified by the Director of the Leadership Center and may be checked anytime during the interview process and throughout the term.

3.

Must have achieved a “C-“ or better in Financial Accounting (Acc

225) and/or Managerial Accounting (Acc 226) or the equivalent, as verified by the Director of the Leadership Center. ii.

Duties

1.

The Financial Director shall miss no more than one (1) of the regularly scheduled meetings of the Financial Allocation Board excepting a valid excuse as determined by the Student Body Vice

President before the meeting. If no valid excuse is present, dismissal shall occur immediately.

2.

The Financial Director shall miss no more than two (2) of the regularly scheduled Associated Students of Fort Lewis College meetings excepting a valid excuse as determined by the Student

Body Vice President before the meeting. If no valid excuse is present, dismissal shall occur immediately.

3.

To assist in the registration of Registered Student Organizations.

4.

To chair and ensure the taking of minutes at each meeting of the

Financial Allocation Board.

5.

To have signatory approval on all expenditures of all Registered

Student Organizations.

6.

To coordinate and preside over the annual budget process.

7.

To maintain an accurate accounting for all grant allocations and unallocated accounts.

8.

Will be a paid position and will work up to twenty (20) hours per week during the Fall and Spring semesters with the exception of official Fort Lewis College breaks.

BYLAW VIII : Final Student Activity Fee Budget Approval

A.

Final Budget Approval

1.

The Senate shall appropriate one line within the Associated Students of Fort Lewis

College Unallocated Budget that will be specifically allocated to Level I Registered

Student Organizations for initial allocations.

2.

All budgets will be presented to Student Senate for approval, and will be approved through a Resolution of the Senate.

3.

The final budget approved by the Senate shall require affirmative votes of two-thirds

(2/3) of the total Senate membership.

4.

The budget, after Senate approval, shall be presented to the College Budget Office for approval and final approval by the Board of Trustees for Fort Lewis College.

5.

The budget shall be approved by the Associated Students of Fort Lewis College no later than March 31, and become effective July 1 of the subsequent fiscal year. Any unexpected funds shall revert to the Associated Students of Fort Lewis College Fund

Balance.
