April 2015 Terms and Conditions for McDougalls YBTOTY 2016 Please read these terms and conditions carefully. You will be legally bound by these terms and conditions from the time you submit an entry for the McDougalls Young Baking Team of the Year 2016 competition (the “Promotion”). 1. The Promotion is only open to teams consisting of one professional school caterer aged 18 years and over and up to three primary school pupils aged 7 – 11 years old ("Entry Teams"). Entry Teams will represent the UK primary school that the professional school caterer and school pupils work at and attend respectively. 2. Competing school caterers and school pupils must be UK residents and school caterers must work at the same UK primary school that school pupils attend. School caterers must be employed by a UK primary school or work at a UK primary school as an employee of a UKbased catering outlet for the duration of the Promotion Period. School pupils must be the required age of 7 – 11 years old on the date of the Live Final (i.e. Thursday 7th July 2016). Should an Entry Team be selected for the Live Final, the school pupils must be accompanied by two UK residents who are aged 18 years and over and hold valid CRB/DBS checks (the "Pupil-Minding Reps"). Pupil-Minding Reps will be selected at the discretion of the school and must be employees of the school the Entry Team represents. 3. All participants of the Promotion are deemed to participate in the Promotion with the full knowledge and consent of their employer. Participants should therefore seek permission from their employer before entry into this Promotion. Any tax liability as a result of participation in this Promotion is the participant's responsibility. Entry Teams should also ensure that the permission of the parents and/or guardians of the school pupils is secured prior to their participation in the Promotion. Entry Teams will be expected to provide written evidence of parents and/or guardians' consent. 4. The Promotion opens at 9am (GMT) on the 2nd November 2015 (the “Opening Time”) and closes at 5pm GMT on Friday 27th May 2016 (the “Closing Time”). The period between the Opening Time and the Closing Time is the “Promotion Period.” 5. Entry Teams are required to designate one person as the agent of the team to enter the Promotion and agree to these terms and conditions on their behalf. 6. Each recipe must contain at least one ingredient of local provenance (within 30 miles of the school address) and one of the following products: i. McDougalls Plain Flour ii. By entering the Promotion, an Entry Team grants the Promoter a perpetual, worldwide, nonexclusive, royalty-free, sub-licensable and transferrable licence to use, reproduce, distribute, and make derivative works of their entry in any media and through any media channel. 8. Each entry shall be an Entry Team's own work. By entering the Promotion, an Entry Team warrants that their entry has not been previously published or exploited in any part and will not infringe any copyright or any other right whatsoever of any third party. 9. Each entry must be suitable for display and publication online and should not be obscene or indecent or contain defamatory statements or words or symbols that are offensive either generally or to individuals of a certain race, ethnicity, sexual orientation or socio-economic group. 10. Each entry must not contain or refer to any branded products other than those of the Promoter and must not contain or reference any third party trade marks or logos (other than those of the Promoter). 11. The Promoter reserves the right to disqualify any entries received outside of the Promotion Period. April 2015 12. Entry Teams may enter the Promotion once. Entries made through agents, third parties, organised groups or any entry duplication method will not be accepted. 13. Shortlisted Entry Teams (“Shortlisted Teams”) will be selected from those entries made in accordance with clause 6 based on the judging criteria detailed at clause 20 below. Shortlisted Teams will be invited to compete in a live final (“Live Final”) that will take place at LACA – The Main Event on Thursday 7 th July 2016, at The NEC Birmingham. 14. Shortlisted Teams must make themselves available to appear in the Live Final. The Promoter will cover travel costs up to a value of £100.00 per Shortlisted Team. Any other costs incurred (including other travel costs) must be paid for by the Shortlisted Teams. 15. The Promoter, the schools that the Entry Teams represent and their representatives and the employer of the professional school caterer are responsible for the safety and wellbeing of participants and will work together to ensure they fulfil any applicable Health & Safety regulations. 16. Shortlisted Teams will be notified by email (via the email address provided in accordance with clause 6) no later than Friday 10th June 2016. Shortlisted Teams must then confirm that they can participate in the Live Final by no later than Friday 17th June 2016. 17. All recipes submitted will be presented to our panel of judges (the “Judges”) including a culinary advisor from Premier Foods and representatives from the Lead Association for Catering in Education and the Craft Guild of Chefs. 18. The winning team (the “Winning Team”) will be chosen at the Live Final by the Judges and the primary school that the Winning Team represented (the "Winning School") will be awarded kitchen equipment or food technology accessories which will be worth up to £1,000 in value and chosen by the Promoter in consultation with representatives from the Winning School (the "Prize"). 19. Both the Shortlisted Teams and the Winning Team will be selected based upon the quality of their recipe submission, as judged by the Judges. The judging criterion includes creativity, presentation, innovation, texture and taste. 20. If the Winning School is unable to accept The Prize for any reason, then the Promoter reserves the right to select an alternative winning team, selected from all remaining Shortlisted Teams in accordance with the judging criteria at clause 20. Likewise, if a selected Shortlisted Team cannot attend the Live Final for any reason, the Promoter reserves the right to select another entrant in accordance with the judging criteria at clause 20. For the purpose of these terms and conditions, an alternative winner shall be deemed a Winner. April 2015 21. The Promoter will send the Winning School the Prize within 28 days of the Live Final. 22. The Promoter accepts no responsibility for entries that are incomplete, delayed, not received, lost, damaged or unreadable, whether due to failure or non-availability of any website or otherwise, the submission of incomplete information or any other reason. 23. The Promoter reserves the right to disqualify any entry that is not made in accordance with these terms and conditions. Any decision of the Promoter as to eligibility to take part in the Promotion or the result of the Promotion will be final and no correspondence will be entered into. 24. There is no cash alternative to the Prize. The Promoter reserves the right to award an alternative Prize, of equal or greater value, should reasons outside of the Promoter's control make this necessary. 25. The Promoter reserves the right to delay, postpone or cancel the Promotion in the event of circumstances outside its reasonable control, which it considers make it necessary for it to do so. 26. The Winning Team and all Shortlisted Teams will be required to take part in non-paid publicity or advertising relating to the Promotion. The Promoter reserves the right to feature the name, photograph and location of the Winning Team in any future marketing materials, website publications, promotions and/or prize draws. The winning recipes and all shortlisted recipes will be printed within a recipe guide, which will be available to download via the Premier Foodservice website. No further remuneration will be received by the Winning Team or the Shortlisted Teams for the recipes featuring in the recipe guide. 27. To receive name and county of residence of the winner, send a stamped, self-addressed envelope to: Vicki Rainbow, Cirkle, Canon House, 27 London End, Beaconsfield, Bucks, HP9 2HN. 28. By entering the Promotion, all entrants consent to the transfer of their personal data to the Data Controller and its agent Cirkle (Cirkle, Canon House, 27 London Ends, Old Beaconsfield, Bucks, HP9 2HN) for the purposes of the administration of this Promotion and the winner consents to the transfer of its name and location to the Data Controller for the purposes of advertising, promotion and/or publicity in connection with the Promotion and the Premier Foods brand. The Promotion and any dispute or claim arising out of or in connection with it, including contractual and non-contractual disputes or claims shall be governed by and subject to the laws of England and Wales. Any disputes must be referred to the English courts.
