2). SECURITY/RESERVATION DEPOSIT INFORMATION
The deposit is required to hold any reservation and is completely separate from the rental
payment. $200.00 for seven (7) nights stay or less; $300.00 for holiday weeks or any stay over
seven (7) nights. Deposit and signed Rental Agreement must be returned to our office within ten
(10) days or the reservation will be cancelled. The deposit check will be shredded within 10 days
of departure, assuming there have been no problems.

3). RENTAL FEE
The fee for said ranch house shall be paid for by renter/s in advance, and is subject to:
Entire rental amount must be received in our office thirty (30) days prior to occupancy and
holiday rental amount must be received in our office forty-five (45) days prior to occupancy or
reservation will be cancelled.

No deviations in the number of renter/s permitted once this agreement has been signed.
If more renters arrive than stated on signed rental agreement, the stay will not be honored.
Reservation/Security Deposit A deposit, (see #2.), will be paid to the owner, prior to renter/s
inhabiting the premises for the purpose of holding the ranch house reservation until rental
payment has been paid. The deposit check is separate from the rental check and will be
destroyed according to the following: A. Rental agreement was adhered to and there was no
violation of said agreement. B. Rules/guidelines were followed. C. Key was returned to owner.
D. No damages, thefts, etc. occurred during renter/s period of use and responsibility. E.
Premises were left in clean and satisfactory condition. Furthermore, any discrepancies in
cleanliness, damages, theft or excessive use of utilities, which shall be cause for withholding any portion of said security/damage deposit, shall be at owner’s sole and absolute
discretion. Renter/s and owners agree that any damage incurred by the renter/s or their
associates during the rental period of the ranch house which is NOT covered by the security
deposit, the renter/s shall be held liable and responsible. In addition, any and all costs incurred
due to or because of the renter/s shall be the responsibility of the renter/s. Renter/s shall make
payment to owner through renter/s insurance or other means to repair
and or replace items concerned. Any violation of the contract, ranch house
procedures/guidelines, arrival and or departure times involving renter/s, occupants, and
all visitors, will render the entire deposit non-refundable. Any costs incurred by the owner
due to violation will also be the responsibility of the renter/s. Should the costs not be
recovered by the deposit, renter/s agree to pay all costs within 15 days of notification. A late
charge with be added to payment made 15 days after notification. Renter/s agree to pay any
and all legal fees and costs incurred due to the recovering of additional charges.
Legal venue for any dispute is Fairplay, Colorado.
Ranch House Uniqueness: Renter/s shall acknowledge that the ranch house property and
furnishings are maintained in a unique manner appropriate to the owner. Renter/s agree to
respect the ranch house property and furnishings.
Linens: The ranch house is furnished with all bed, bath and kitchen linens.
Kitchen: The ranch house kitchen is fully equipped.
Utility Usage: Because the ranch house is located in a rural area with limited utilities available,
it is expressly understood and agreed upon that all renter/s shall conserve
utilities including water, electricity, gas, appliances and septic. Wasteful usage of utilities will
incur extra costs which will be subtracted from the security deposit. It is also understood that
the ranch house has a sensitive septic system and all guests and visitors will
take proper care that kitchen and bathroom wastes are handled in a proper manner.

Well and septic: The ranch house has a limited well. Please conserve water usage. The septic
system is sensitive. Do not dispose of chemicals, grease and toxic substances in drains.
Check-In/Check-Out Times: The check-in time at the ranch house is 3:00 p.m. and check-out is
11:00 a.m. Deviations require prior approval from the owner. Please notify the owner of
estimated arrival time.
Ranch House Policies: Ranch house rules/policies and emergency phones numbers will be
provided at the ranch house. Renter/s agree to read and follow ranch house policies with
care and prudent judgment. Lack of adherence to the policies will result in incurred costs.
Cleaning Services: All renter/s agree to keep the ranch house in an appropriately clean manner.
Owner agrees to provide normal laundry and cleaning service after renter/s have
checked out. Any excessive cleaning other than from average use will be deducted from the
security deposit. Please ask if you have any questions.
Liability Release: It is hereby understood, acknowledged, and accepted that neither owner, nor
his agent have made or shall make any representations as to the condition, safety, or
circumstances that might evolve during renter/s use of the ranch house or premises.
Furthermore, all renters and associates visiting clearly understand any hurt or injury sustained in
connection with renting the ranch house is solely the responsibility of the renting parties. Owner
takes no responsibility for any injury sustained by renter/s and their associates while occupying
or visiting the ranch house. By signing this agreement, renter/s and their associates, hereby
indemnify, and otherwise agree to release owner from any personal liability, claims, or
compensations for any hurt or injury received while using the ranch house or premises. Renter/s
and their associates acknowledge that Puma Hills River Ranch is a working ranch with livestock
on the property. Renter/s and their associates must take full responsibility for their actions.
Renter/s also agree to hold owners harmless in case of any hurt or injury to renter/s, associates,
and horses while staying on the property. Due to the remote distance, varied weather, natural
conditions and unique habits and judgments of renter/s involved. It is expressly understood and
acknowledged that clear language is necessary to insure understanding between renter/s,
associates and owner.
As with all recreational activities, each adult will be asked to sign a liability waiver.
Further Safety Precautions and Liability Releases:
SMOKING IS NOT PERMITTED INSIDE THE RANCH HOUSE. Fire usage including, but not limited to,
use of candles, firearms , fireworks, outdoor fires of any kind except in the grill or fire ring
provided are not permitted. Smokers must smoke outside of the rental house/garage and to use
the sand pot for disposal of cigarette butts. Any purposeful or accidental usage of such items on
or near the property, will be at the risk of the renter/s who will assume sole legal
responsibility.
Horses: Pets are not permitted with the exception of horses that have been agreed upon and
paid for in advance. The rental fee is $15.00 per day/per horse. Owner will provide renter/s
horse/s with water and pens. Renter/s must provide feed and any other needs. Any hurt or
injury inflicted to or from renter/s horses shall be the sole responsibility of the renter/s with
absolutely no exceptions. Owners of the property likewise shall bear absolutely no responsibility
for any hurt or injury to renter/s or their associates resulting from renter/s horses.
Visitors and Vehicles: Daytime visitors are permitted at the ranch house.
Motorhomes, RV’s, trailers, etc. are not permitted without prior notification and approval.
Renter/s bringing horses are given ample room for stock trailer parking.
No Changes of Reservation: Due to, but not limited to any of the following: Weather conditions,
illness, injury, personal emergency, change of plans, etc., shall not be deemed grounds for
refunding any part or all of any payments. No refunds are given for any unused, reserved rental
time and/or unattended renter/s, horses, etc.
Cancellations: Cancellations are recognized after the renter/s has requested and obtained
a cancellation date from the owner. Deposits and rental payments will be fully refunded (minus
the processing fee) when cancellations are made more than thirty (30) days prior to occupancy,
holiday weeks require forty-five (45) days. For cancellations made 14 – 29 days in advance,
deposits may be applied to a future visit if the future booking dates fall within one year of the
original reservation date. For cancellations made less than 14 days in advance, all deposits are
forfeited.
This constitutes the entire agreement between the renter/s and owner and supersedes all other
agreements, written or oral, between them. It may not be modified. The undersigned clearly
understand and agree to the conditions set forth above by this agreement. BY
SIGNING THIS AGREEMENT, RENTER/S ACKNOWLEDGE THAT ALL INFORMATION GIVEN ABOVE
IS CORRECT AND THAT THE ENTIRE CONTENTS OF THE AGREEMENT ARE AGREED TO AND
UNDERSTOOD. FURTHERMORE, RENTER/S AGREE TO ABIDE BY ALL CONDITIONS SET FORTH.
