SERVICE AGREEMENT Moscow Date: ________________ The National Research University Higher School of Economics, hereinafter referred to as the University, represented by Natalia Maximova, Director of the Library acting on the basis of the power of attorney No. ___________ dated___________, on the one hand, and __________, hereinafter referred to as the User, passport No. ______ dated _________ on the other hand, have concluded this Agreement on the following: 1. Scope of the Agreement 1.1. The University shall provide the User with library, reference, information and other services stipulated in the Library Use Policy approved by the University Rector’s directive No. ______ dated ______ (hereinafter, the Library Use Policy), as prescribed by this Agreement. The Library Use Policy may be accessed through the University’s official website. 2. The User’s Rights and Obligations 2.1. The User has the right to: 2.1.1. Check out documents from the Library’s collections and reading rooms by showing the library card, pursuant to the Library Use Policy. 2.1.2. Use bibliographic, reference and information services, as well as other library services, including paid ones. 2.2. The User shall: 2.2.1. Read the Library Use Policy and comply with it. 2.2.2. Provide correct personal details when registering in the Library and notify the Library of any changes to their personal details within 7 (seven) days of the changes. 2.2.3. Treat the documents borrowed from the Library, as well as the University’s property located in the Library with due care. 2.2.4. Return the documents borrowed from the Library within the deadlines stipulated by the Library. 2.2.5. Return all documents to the Library and sign the Pre-Departure Checklist at least 3 days prior to leaving the University. 2.2.6. In case of loss or damage of the documents, replace them or reimburse for their price in accordance with the Library Use Policy. 2.2.7. Reimburse for any damage caused to Library property in accordance with the Russian legislation and the University bylaws. 2.2.8. Observe restrictions imposed by the license agreements with resource owners when using remote access to the Library’s e-resources. 3. The University’s Rights and Obligations 3.1. The University has the right to: 3.1.1. Determine the Library Use Policy and change it. 3.1.2. Define the terms of access to the Library collections. 3.1.3. Establish the list of paid services and their prices. 3.1.4. Apply sanctions to the User for violation of the Library Use Policy within the limits stipulated by the University Charter, Internal Regulations, Library Use Policy, and other University bylaws. 3.2. The University shall: 3.2.1. Deliver services to the User in accordance with the Library Use Policy. 3.2.2. Inform the User of the entire range of services it offers, including paid ones. 3.2.3. Create and maintain the conditions necessary for the User’s work in the Library. 4. Liability of the Parties and Dispute Settlement 4.1. Parties shall be liable for failure to fulfil or improper fulfilment of their obligations hereunder in accordance with the Russian legislation, the University Charter and bylaws. 4.2. The Parties are exempt from liability for failure to fulfil or improper fulfilment of their obligations hereunder in the event of any insurmountable circumstances beyond their control, including declared or de facto war, civil disorder, epidemics, blockade, embargo, earthquakes, floods, fires, and other force majeure circumstances. 4.3. This Agreement provides for extrajudicial resolution of disputes arising between the Parties during execution of this Agreement. The interested party shall send a written claim to the other Party prior to taking matters to court. The claim is sent by registered delivery. The party which has received the claim shall send a reply within 30 (thirty) calendar days of receipt. The party which sent the claim and received an unsatisfactory reply or no reply has the right to take the matter to court in accordance with the Russian legislation. 5. Duration of Agreement 5.1. This Agreement comes into force upon its signing by both Parties. It expires on the date of student or employee dismissal from HSE. 5.2. The Agreement may be terminated by consent of the Parties, at the initiative of either Party, or if one of the Parties violates the Agreement. Notification of the Agreement termination shall be sent to the other Party no later than 7 (seven) days before the date of proposed termination. The notification shall be sent by means which provide proof of sending it to the other Party. 6. Miscellaneous 6.1. In all other cases not stipulated herein the Parties shall comply with the Russian legislation, the University Charter and bylaws. 6.2. This Contract is drawn up in two copies of equal legal status, one copy for each Party. 7.
