Agreement for International Postdoctoral Exchange Program Party A: Shandong University Party B: (School of postdoctoral station)________________________________ Party C: (Employed postdoctoral)Name:______________________ ID Number: _______________________ Translated Chinese Name: ______________ Nationality/Region:________ Party A, B and C, on equal and voluntary basis, in line with the "International Postdoctoral Exchange Program Rules" (hereinafter referred to as the "Rules") and “Shandong University Postdoctoral Management Measures” with the relevant provisions, agree to sign the following agreement on Party C’s postdoctoral research work for Party A: I. Working Period Party C shall conduct a two-year period of research from (registration date)__________ (month) ______ (year) ________ to (date)__________ (month) _______ (year) ________, during which Party C’s cumulative time at the station is no less than 21 months. The agreement will be terminated once the contract is expired. II. Party A’s rights and obligations: 1. Party A shall assist Party C to go through the relevant procedures, and based on the “Rules”, conduct regular supervision, inspection and review of Party C’s working performance. 2. Party A shall provide Party C with the annual grant funds of 300,000 RMB, including monthly maintenance allowance and performance allowance, starting from the date of Party C’s registration: 1) Monthly maintenance allowance ___________ RMB (before tax), covering living expenditure, medical insurance, international traveling expenses (a round-trip). 2) Annual performance allowance ___________ RMB (before tax), which will be paid according to the results of mid-term and final assessments carried out by 1 Party B, who is entrusted by Party A. 3. For accommodation Party A shall provide Party B with a renting furnished apartment equipped with basic living facilities. 4. Medical insurance 1) If party C is a foreigner, Party A shall provide Party C with the medical insurance at the annual cost of 1680 in reference to Comprehensive Medical Insurance for Foreigner and Countryman from Hong Kong and Macao, which covers the costs related to dread disease, hospitalization, accident injury and out-patient/ emergency insurance. Meanwhile Party C is also strongly recommended to purchase his/her own medical insurance covering his/her medical expenses in China. 2) If Party C is a Chinese citizen, he/she shall enjoy the same medical insurance policy as Party A’s employees. III. Party B’s rights and obligations 1. Party B shall be responsible for Party C’s mid-term and final assessments. 2. Party B shall be responsible for reviewing Party C’s research progress and conduct certain supervision. 3. If Party C applies to extend the time of his research work, Party B shall be responsible for the review of the application and have the right to suggest terminating Party C’s extension if he/she is not qualified. 4. Party B shall be responsible for Party C’s daily management during his/her stay at the station. IV. Party C’s rights and obligations 1. Party C shall enjoy the benefits related to his/her working and living provided by Party A. 2. Party C shall cooperate with Party A in going through the formalities of comprehensive medical insurance. If Party B is not eligible or does not need to purchase the Comprehensive Medical Insurance for Foreigner and Countryman from Hong Kong and Macao when he/she comes to China, he/she is required to show proof of purchase of his/her medical insurance before Party A shall begin to process 2 the relevant documents. Spouse and children who travel with Party C shall come to China with their own medical insurance. 3. Without Party A’s consent, Party C shall not give up his/her grantee status. If Party C cannot finish postdoctoral research in due time, and the two sides agree to terminate the agreement, Party C shall return the remainder of the grant funds, and pay liquidated damages which is equivalent to 20% of the total amount of the funds. 4. Part C shall not be engaged in any activities detrimental to the interests and security of the Peoples Republic of China during his/her stay in China. Party C shall observe relevant laws and regulations of People’ Republic of China and respect for Chinese people’s ethics and customs. 5. Party C’s working tasks and responsibilities (relevant contents provided by the station). Party C shall guarantee a full-time work for Party A in his/her stay at the station. Without Party A’s consent, Party C shall not be allowed to take any part-time job. VI. When Party C has his/her research results at the station published, he/she shall name Shandong University as the first unit,and indicate “the research results are sponsored by China/Shandong University International Postdoctoral Exchange Program”. Party A shall have the ownership of the published papers, works, patents of research results, and the research projects. VII. Party C shall fill in the program closure form of “Postdoctoral International Exchange 3 Program” when finishing his/her research at the station, and his/her cosupervisor shall provide the evaluation in written form. VIII. If Party C needs to extend the time of research, he/she shall have the permission from his/her cosupervisor and the approval from Party A, which shall be submitted to China Postdoctoral Science Foundation for record. The extension period is no more than a year and the funding issue can be negotiated between Part C and the cosupervisor. IX. If Party C’s spouse and children travel with him/her, Party C shall be responsible for their cost of living. X. If Party C conducts anything listed in Article 34 of “Shandong University Postdoctoral Management Measures”, or severely breaching the agreement, Party A shall have the right to cancel the contract. Party C shall return the remainder of the grant funds, and pay liquidated damages equivalent to 20% of the total amount of the funds. XI. Disputes arising from executing this agreement shall be settled through consultation between the parties. If all attempts fail, Party C can file a lawsuit with Party A’s local People’s Court. XII. This agreement is in triplet, effective from the date of signature and valid until both parties have fully and duly fulfilled their obligations. Party A, B and C shall hold one copy each which has the same legal force. All parties shall perform the obligations of this agreement.
